Why has she not sent the EAD renewal herself then? And why did she wait this long to take action? I believe you can submit an EAD renewal 180 days prior to the EAD's expiration. That is more than plenty of time to get the renewal in queue and make proper plans.

     

    Tell her she has 2 options here:

     

    1. Cancel the travel and stay inside the USA until AOS is done.

    2. Go on her trip, but it will be a one-way trip because she will not be allowed back in until she gets the right visa to enter the USA again, which is probably the spousal visa and takes 12-18+ months to obtain.

    She hasn’t renewed it herself yet because she has literally only told me all of this about 1 hour ago and she doesn’t know anything about the immigration process as she allowed her lawyer to do everything!! 

  2. Hi everyone!

     

    so my friend’s EAD expires in 2 weeks and she is meant to be travelling in 3 weeks (she is AOS and currently waiting for an interview for her green card). She said her lawyer told her to try and ring some immigration court and to bring all her documents when she travels to show when she re-enters.

     

    Correct me if I’m wrong but I told her that she can NOT travel at all if she has an expired EAD, and I also told her that I believe she can’t work either unless she has some sort of valid document - like a non-expired EAD? (She said her lawyer told her she can carry on working if she’s going through the process still).
     

    just want some clarification that what I’m telling her is correct and that her lawyer has really badly messed things up for her!! I also asked if her lawyer had sent off for her renewal of the EAD and she told me no!

    According to your timeline, you are eligible for citizenship this year on October 15. You can apply in mid July. I think it is very much worth it to hold out and make the rest of your life easier. You never know when rules will change on either side.
     

    Yeah, I do like the fact it’s a safety net and the fact that I can apply in July. With the tax business I did read that a us citizen does have to pay taxes on their UK “tax-free” savings account (ISA) which I find a bit bizarre.. 
     

    And yeah I was going down the route of me having a job offer already and also me being in the same job for a year in the states both earning over the certain amount which I’ll be able to bring my husband over.

     

    The only thing I’m torn between is that my job/career prospects are better over in the UK where I have had little to no luck in getting experience in what I want to do in America without me having to do another masters or something (I deffo feel this sense of urgency as I’m approaching my 30s LOL) and even my husband (who’s the us citizen) thinks we should just move without the passport... but he doesn’t understand the entirety of the complications

    When did you file for your CR1/IR1? I’m curious at whether this process takes just as long as the AoS.
    Personally I feel like getting citizenship is something that I should do but necessarily not something I want to do/feel is a priority at this point in my life. 
    GOSH it’s so hard to come to a decision! Lol

  5. Hi everyone!!

     

    I am a Uk citizen married to a us citizen, we currently reside in the states and I am currently on that 18 month extension letter waiting for my 10 year green card. Our plan was always to move to the UK at some point and I have been offered a job over there and I am trying to lay out all the facts/pros/cons about whether we should move or suck it up and wait to get my passport etc.

    Concerns of mine are as follows:

    1. if I were to move and officially abandon my green card can I enter into the US on an esta in the future when wanting to visit family/in-laws

    2. as I came in on an esta last time then got married/adjusted status will this cause a red flag when entering again? Or will I be fine if I show I have ties to the Uk like job/house/return flight?

  6. So I had my interview today!

    nightmare on the way there I put in the address wrong! The address was 6680 corporate center blvd and I put in 6800 corporate blvd (Orlando) which is a 15 miles difference lol! Super stressful, ended up turning up 5/10 mins late but there was a line anyway to check in so it didn’t matter at all and it wasn’t mentioned! Even though I don’t suggest this to anyone 😂 my stress levels were already high and then they got even higher! Lol

    our interview went very smoothly - first the IO went through I-130 with my husband asking him questions from that, then she went through I-485 with me. We gave her all supporting evidence which we had a joint lease, insurance, I’m a beneficiary for my husbands 401k, I’ve got him as my beneficiaries for my benefits, joint tax return plus a few more photos of us with our families - she already had the rest of them I’d sent with my original package. 

    Then all she really asked us was how we met and why our parents didn’t come to our wedding ceremony. Easy. She then gave us this letter saying how we needed to wait for it to get approved and ROC. 

    We both mentioned afterwards that my employment card expires on October 22nd with my employer wanting evidence of my status ASAP, and how we have booked to go on a cruise from 21st-25th October and if we are able to get something for that? (We knew about the stamp they can give out but wanted her to mention it). The woman was very kind and explained about the stamp but she didn’t know if they would be able to give it to us, but told us to hang on a bit to see if she can pull some strings. We waited back out into the waiting room and 20 mins later she said she ran our background checks everything looked good and to go grab lunch and come back around 2pm (it was 12.45 by this point). We did exactly that came back, waited another 30 minutes and got the stamp! 

    I don’t know if it was because of our circumstance, or if she was just being really nice, but now I’m stress free as was worrying about if I was gunna be able to go on this cruise!

    We had out AOS interview today at the Atlanta USCIS office.  Our appt was for 8 so we arrived at 7:30 and they called us at around 9.  Here’s how it went...the interviewer took our identification,

    asked us to swear that we would be truthful then she went through all our application. Questions asked:

     

    How did we meet? 

    What dates did we go on?

    When did we decide to get married?

    Have we met each other’s parents?

    When did we get married?

    Was it at the courthouse or a full on wedding ceremony?

    How many guests?

    Where does my husband work?

    What does he do there?

    She asked him what city I was born in and vice vera.

    She also asked each of the others date of birth

     

    Then she asked if we had updated evidence to submit:  I provided my most recent tax return, 2017 w2 and 2 months of paystubs (to show that my income has not decreased), updated lease agreement, updated car and medical insurance cards and new wedding pictures (we got married at the courthouse last year, but we had a large wedding with friends and family last month).

     

    All in all the interview took about 20 mins she said she would recommend approval but we received an RFE for the expired medical, so our case is pending until then, but thankfully they allow us to drop it off at the office rather than having to mail it in to a lockbox. 

     

    If your case was  submitted August of 2017 or  earlier I highly suggest getting a new medical so you don’t have any delays.

    i got it the end of october. The thing that worried me was that my HR manager emailed me asking me to send her some updated documents due to the EAD's upcoming expiry. I sent off my forms 3 months before its supposed to expire. I received the new i-797s already and on the paper it says that if I don't get my new EAD in time that that paper can serve as an extension of 180 days, (if it gets accepted that is). However it can't be used as a travel document.

    No I’m a July 31st but PD is 3rd August. But I thought nothing was going on with my adjusting but I was just using the old website.

    How many days in 2017 was he in the US? Did he work in 2017. Many scenarios depending on your specific situation. 

    I am the the resident alien (or non resident alien i don't even know lol) and i worked for 3 months out of the year, my husband is a US citizen and and has worked all year.
