HELLO GUYS,
WANTED TO KNOW THE DIFFERENCE OF CR1 AND IRI..MY HUSBAND FILED A PETITION TO ME FOR K3...BUT THE 129 F WAS STILL PENDING NOT YET APPROVE..BUT THE I 130 WAS APPROVED ALREADY..WE FILED THE DS-230 FORM 3 WEEKS AGO..DONT KNOW WHICH STATUS ARE WE IN NOW...WAS IT CRI OR IR1?THANKS AND GODBLESS!
The difference between IR (immidiate residency) and CR (conditional residency) is that the IR give you a 10 year green card, where as the CR visa only gives you a 2 year green card. The determining factor for eligability of an IR visa is how long you have been married at the time of the interview. For an IR visa you would have to be married for more than 2 years, if you don't meet that requirment you'll be given a CR visa.
If you get a CR visa, once in the USA, 3 months before the CR visa is about to expire you can apply to remove conditions and get the 10 year green card.
A CR visa is used to ensure that the marriage is not fradulant. When applying to remove conditions both husband and wife need to sign the application and attend the interview together. Additional evidence of an "on-going" marriage is also required. You can get more information in the forum that discusses lifting conditions.

So after the two year "green card" are you issued a Permanent "green card"?
Yes, 3 months before your 2 years is up, you need to file for Removal of conditional status. After you file and USCIS processes the case - with an interview with both the husband and wife they will approve a 10 year green card.

I have filed I-130 last week in Delhi.
The lady at the winow said we will hear from the chennai consulate within 2 months or so !
Now I have some questions regarding what next..
What they told us is to wait for the response from Chennai.
If anybody tried filing in Delhi and waiting to hear from chennai: how long did it take for you to get the packet 3?
did you do some follow up after your filing? if yes, could you please send me the email/phone# for communication?
Regarding afidavit of support, since my wife is not working here in India, we need to get the income of her parents(household members I 864A)
Is it needed for them to notarize the I 864A, since they are sending it from the US?
if she has a bank balance of 16500 USD which is the 125% of the poverty line income, would that be enough? It might be safe to include the income of her parents too right?
I can get an offer letter from the head quarters of my company which is in Washington where I can continue my job in the US. Can I include that in the aphidavit of support?
Since the objective of this is to make sure that I wont be a public charge
, An assured job offer would be a possible item to include. So is there a way I can include it?
I really appreciate if anyone could shed more light on these questions.

I may be wrong, but I believe the Affidavit of Support has to be from the petitioner - the US Citizen. I don't think the beneficary - your wife or her parents can be the sponsor.

Which embassy are you going through? I'm doing a CR/IR1 visa so can't help you with the specific question. However, the link below is for the Mumbai consulate. There should a a e-mail or telephone number you can contact to get information on the status of your case. I glad to inform you all that MY Case is completed on 1/31/2007 and forwarded to Indian consulate. This is a wonderful forum . I really appreciate all your help.

I am still waiting for a Postal money order to be sent to me via "snail-mail" and am hoping that a personal check from my U.S. bank is acceptable for the IV fee since if my wife was the "agent" she would not have direct access to U.S. certified bank checks or USPS money orders.
I'm quite positive that personal checks will not be accepted by NVC. Needs to be a certified check or a money order. Perhaps you can have a relative from the states get the check and then send them the money from london

I waited for the AUTOMATED NVC system message to say that the AOS fee bill and the Choice of Agent form have been mailed out before sending the e-mail. If the automated message is not reflecting that just yet, wait till next tuesday for the next update. If it's already reflecting it, then go ahead and send it.
Below is what we sent.. make sure you send the e-mail from the beneficary's e-mail account and not from the petitioners e-mail account. We received an e-mail response 3 days later

Hmm, does not sound too reasonable to me, as the documentation that was submitted still holds true, and they have contact information on all documentation for people who provide the documents like banks etc. The Delhi Embassy site also says that if you have submitted the documentation, you don't need to submit again, but they are Government, so we can't Argue.
Anyway, we will prepare the documents one more time, and submit if needed.

I really think that they'll want to see updated financial information.. since there could be a possiability that your financial situation has changed from the time you submited your orignal AOS. I would check with the Delhi embassy by phone/e-mail. It is always better to be safe (before the fact) than sorry (after the fact)
If I were you, I'd get all the supporting documents updated and send them to your parents to take with them to the interview. If they ask for it, they'll have them at hand, if they don't ask for it, then so be it.

My wife is in India, and this will be our first Valentines since our marriage. Not sure how "big" Valentines day is in India. I was always planning on sending her something anyway, and she brought up Valentines day in a conversation.. I told her, since it's not such a "big" deal in India, I'll send you a card and left it at that.. however, I found a website that will send 24 red roses, box of Ferrero Rocher chocolates, and a teddybear for $48... so it'll be a nice surprise for her since she's only expecting a card

My parents are getting interviewed in New Delhi in March, and I am hearing from various sources that people have to resubmit the Affidavit of supports or other financial information about Petitioner.
We submitted ours back in June, 2006. NVC was happy with it.
Any one experienced such issue?

Yes, you're parents will need to take an updated AOS packet from the petitioner. Even though your AOS was approved by NVC, it does not mean it is valid from the Embassy's perspective. You'll probably fill out the form again with almost the same exact information, but the supporting documents such as paystubs (most recent 3 months worth prior to the interview), tax transcripts for 2006.. updated bank statements etc will need to be the most updated you have

I'm preparing to submit the DS230 and I want to use the shortcut. I downloaded the Barcode Cover Sheet, and I'm just wondering if you changed the text where it says return with "completed DS-230 Part I" to indicate Part I and Part II.
I know it's a silly little thing, but I'm just trying to decide if I should change it.
Also, I'm attaching: birth cert., marriage cert., police cert., and photcopy of passport bio page. There are no prior marriages, military service etc. so I think that's all I need - if anyone wants to confirm that would be great

I did not change the text..since I'm going throug Mumbai, I only needed to send in Part I. It'll be interesting to read other people's comments on this. If you are uncertain about what to do, you could wait for the orignal but as you know it will delay the process slightly.
Try posting this in the regional country forum.. you may have better luck there perhaps.

Quick question. I used my home phone number on I-130 & 129F. Since i don't answer my home phone if i'm not familiar with the caller's number. Now i'm in the last part, I used my cellphone number on my DS230. They are reviewing it right now (2-4 weeks). do you guys think it will affect my DS230 or i might receive RFE with this?

Don't really have an answer for you on this one, since I was very consistant with keeping the same number of all the forms. I would be VERY surprised if it did casue an issue though.

After preparing the Affidavit of Support bill from NVC using James shortcuts, how is the single sheet with barcode utilized?
Is it folded and inserted with the bill and money order? Or should it be left flat and mailed in a large envelop?
You need to cut the Barcode (payment slip) at the dotted line. Use a paperclip and attach the check and the payment slip together into an envelope. I then put the envelope into a USPS overnight express envelope and sent it off.
I wrote on top of the envlope the NVC case number with my wife's Name and DOB as well as my own.

On the Mumbai site, it says that all the required documents need to be submited to your local VCF office. Does this also include the results from the medical exam? The reason I ask is that my wife is in Rajkot Gujarat, the medicals can only be done in Mumbai, and VCF states that all documents need to be submited 10 days prior to the interview.
So would that mean my wife would need to go to mumbai and get her medical done so she can submit it 10 days prior to the interview? Or can she go to the VCF office in Ahamdabhad and submit all the documents except the medical and do that a couple of days before the interview and take the results with her for the interview?
Also, at the VCF, what are the total fees that need to be paid?

We had gone throu this...and I am also very familiar with lots of applicants from Rajkot/Ahmedabad area....answers to your questions are as below:
(1) she can submit the paperwork except medical to ahmedabad VFS office. The rule to submit papers to VFS is max. 15 days before but min 10 days beofe. Pl remember these are 10 & 15 working days..so exclude weekends and holidays from it..(for ex, my wife's interview was on 1st feb so window to submit was 8th jan to 16 jan...as threre were few hoildays in between...so get the idea?)
(2) it is better if she can go in person to submit papers to VFS..because they need to see passport to put some tracking barcode on it...so its good to go in person as u need to carry passport and original appt letter.
(3) Rs. 365 can be paid in CASH...
(4) For medical, she can fix appt in mumbai one or two days before interview date and get it done in one trip. They give report same day...so she can carry that with her in interview...no problem.

I am having problems with the barcode generator. The barcode gets generated but when I try to copy and paste it the image does not transfer. Has anyone else noticed this problem? I am trying to send in the tax release form.
Can I just print it and stick it on the form?

Try the following
Here are the steps you need to take.
1) Use Jame's instructions to actually generate the bar code.
2) Do a "right click" with your mouse over the bar code and click on "save picture as"
3) Save the picture on your desktop.
4) Go to the file on your desktop and do a "right-click" on the file
5) Go to "Open with"
6) Select "Microsoft Office Picture Manager" as your first choice if you don't have that then use "Microsoft Paint"
7) If using Picture Manager, open the file put your mouse over the picture and do a right-click and go to "edit pictures" A panel will pop-up on the right side of the screen
8) Under "edit using these tools" click on the crop function. You'll see thick black lines around the picture.
9) Put the mouse over the middle - dottom horizontal line. Left click and move the mouse up so that the black line are now above the verbage "Powered by IdAutomation.com" and click on the "O.K" button on the pop-up window on the right hand side. That will crop your picture for you.
10) Now do a right click over the cropped picture.. click on "copy" go to the document where you need to replace the bar code and paste it.
11) Simillary if you are using Microsoft Paint.. you'll do something similar.. where you crop out the verbage and copy and paste it on the appropriate document.

Just curious if most have gotten the ROA1 in the mail or via email? I could swear I've seen some people say they got it via email but I don't see anywhere on the form that asks for an email address.
Not sure what you are refering to as the "ROA1". Did you really mean to say NOA1 or Notice of Action 1? If so, the NOA1 is also going to be sent to you through the mail. You would not see an e-mail for NOA1. Once you get your NOA1 with the recepit # you can sign up for automatic case status updates at the USCIS website at the following website https://egov.immigration.gov/cris/jsps/index.jsp
Once your I-130 has been approved, they'll send you an e-mail stating the case has been approved, but the offical NOA2 will come through the mail as well.

My wife had successful interview at Mumbai consulate yesterday .She got in at 7:30 and came out at 1:00 pm.
Your wife does not need to submit medical report at VFS, Ahmedabad, YOu can do it 1 or 2 days prior and carry with you during the interview.The VFS fee is just Rs.365 which is courier fee.Other than that i don't think any.
She was able to pick visa same day from the consulate.
P.S Documents submission at VCF is before 15 days not 10 days. They will not accept it b4 10 days.

The Rs365 is that paid in cash or does it have to be a bank draft?
Also, does she have to Ahmedabad in person, or can she have someone go their on her behalf? She'll already has to go to Ahmedabad for her Police clearence certificate, and I want to avoid her taking another trip just to drop of the documents if it's not neccessary.. it's about a 4 hour drive each way.

Jame's short cuts can only be used for CR/IR1 visa's. Since you are doing a K3 which is a combination of a K1 and a CR/IR1 visa, i'm not sure how or if you can use it
