    a friend of mine her husband is from Egypt it took over 2 years for him to arrive, she filed single both years amended the return after he arrived, and he is now a USC, as the IRS does not keep records of each persons marital status, it doesn't hurt anyone but the person who is filing the tax's due to the higher tax bracket.

    I never have but people have done it and then amended later and no issues came of it. when you are in a bind and you need them sooner rather than later it is perfectly fine to file single/

  3. The timeline to stay out of USA is as follows:

    The temp stamp in your passport serves as a temp green card but only for 1 year from the date of the stamp.

    if you stay out less than 6 months out of the year there is no issues over 6 months but less than 1 year you will disrupt your ability to file citizenship and the continued residency requirement resets.

    if you are out over 1 year with no reentry permit, you have abandoned your green card, and will have to start the process over from scratch.

If you want your child to come to USA, most certainly wife is not needed to travel, I think you are capable of taking care of your own child, if it is the expense for the child while you work, and you have no other family certainly would be best for the child to stay in the country with your wife, as millions of babies are born and survive in Egypt.

     

    With the surgery it all depends on the depth and complexity of the surgery, I had surgery on my dominant side, to fix a rotator cuff, and a torn labrum. My husband might have been here but was working a lot, and I was left to my own devices and had no issues.

     

    I know that you want your family here as soon as possible and the waiting game is hard, I am not trying to dimmish what you experience, but we will only know what we are capable of when we are forced to go at it alone.

    if your company allows you to work remote for the few weeks you are there, that would be up to them and their IT on how that woks.

     

    As far as paying for Canadian taxes you do not have to.

     

    you are not going there to live, you are not abandoning your residency, you are going on holiday so nothing would change.

     

    it is not likely they will ask you if you are going to work while you are there, your main objective is to go for a visit.

    if you know for sure the wife passes the income requirements for the household then she/you needs to send an email back to them, take a good look at the I-864 that was filled out make sure it is correct and then send it back with proof of income with wage and tax transcripts.

    we submitted the same translation for the Marriage lic all the way through, once the marriage lic is translated your good.

     

    As far as the police certificate as long as it is in the countries native language there is no need to translate it for interview.

     

    Remember in Egypt you will need to also provide a family registration of course unless your female, then not needed.

    sorry can expect a visa interview for spouse in Egypt for DQ in November to be sometime start of 2020 likely Feb or March, if you are lucky you might get one in Jan and that is just for the letter.

     

    If you get IL in Jan interview will be the following month. Make sure you join your spouse at interview, it seems those who do not go with the spouse will end up in some form of AP, I didn't get with my husband and he got handed an AP letter, no reason just straight into AP.

    sadly, even spouse visa get backlogged due to how busy some embassy can get.

     

    Those who were DQ in May are not getting interview letters for Egypt.

     

    Mexico is backlogged almost 1 year even for spouse visa.

     

    Embassy are just getting overloaded with not enough spots to put everyone, they only open so many spouse visa slots, K1 spots and visit visa slots.

     

    so if you just got DQ in November you can expect sometimes Jan-Feb even March of 2020 to get your interview letter.

    Did you apply online?  If so, did it ask for them?

    I could be wrong but if they are in their 30's and 40's the only one that can apply for them is the mother when she arrives and gets her green card.

     

    or am I lost as to what interview?

    I do not recommend a writ of mandamus, all that will do is force them to make a decision if the background checks are not complete it will come back with a rejection, it will then take 1-2 years to fully complete to second interview.

     

    going through the steps to chance the name will not likely have any effect on the decision of the case, if its a personal choice go for it, but if you think it will help the AP it likely will not.

     

    try sending off another email checking status all you can really do is wait it out. I have seen couples in both Pakistan and Egypt sit in AP for up to 2 years before.

     

    and more and more rejections are coming down the pipeline from Pakistan.

     

    IMO and I know its hard to do and easy for me to say but stay patient and send them an email every 90 days to check in.

     

    if you haven't seen an update since July I would shoot them off an email to check the status.

    1. send the proof of name change to embassy

    2. its just another small piece of evidence on marriage not that it makes it bonafide in the name change. I never changed mine, the AP for my husband lasted 42 days

    3. what took place at interview? did they keep the passport? have the updated CEAC date regular?

    I am about to start a new job in the beginning of December and decided to visit my family first. I have an ongoing application for AOS (got married in April 2019 on K1, filed AOS/EAD/AP in May 2019) and have been issued combo card EAD/AP in August.

     

    My question is: when I was moving to the States in February 2019, I had to get a round trip flight (because it was way cheaper). Back then I picked December 12th 2019 (it was hard to estimate when I would be visiting my country again) and have now rescheduled a flight to November 14th. Both on the ticket and in my passport, there's still my maiden name printed. Is it going to be an issue if I travel using EAD/AP that has my new last name (I have kept my maiden and just added a my husband's one after "-"). 

     

    Also, any advice what other documents should I take with me (I'll definitely take a copy of my marriage certificate) to be paroled into the States again in early December? Do I have to file ESTA coming back to USA? Poland has just been enrolled in visa waiver program starting TODAY and ESTA is a completely new system to me.

    if you have your combo card you can't file for ESTA.

    didn't you put out a post that you sent a letter to withdraw the petition, sending an email to the embassy to withdraw even if not in an official letter is going to create issues, your really going to be better off going back to Egypt and getting married and to file the CR1.

     

    Personally do not risk it getting through the interview getting the visa and having it caught later and having the green card stripped deported, and given a ban.

     

    The ban would come if they question it at interview and you try and find a way to back it out. (side not: I am not saying that you would do that) however it is too big of a risk to continue at this point.

    currently Egypt is about 5-7 months backlogged.

     

    you can expect it to be at least that long to get an interview, those from May are still waiting, some even as far back as March.

    Is that okay ?

     

    And the confirmation page doesn't state my interview date and time as my k1 confirmation page 2 years ago! 

    Is that normal ?

    the confirmation page for your CR1 will not have the date and time on it since the letter came from NVC

    if your in non immigrant AP your on the way to being issued, if you have a middle name you could have given it, if there is non, you enter it as it reads in the passport.

    I just knew about the petition today and I really know how bad to make misrepresentation to obtain a green card

    if they are from Egypt they can surly expect the green cards to be revoked, Cairo doesn't play around with people who lie to obtain green cards.

    Update: Will get passports on way delivery ready next Monday September 9th..  Ceac status still showed administrative processing (spouse). Mine issued.  We are so anxious to find out when parcel arrives on Monday. Still am on stomach butterflies. What you think??(my brother - petitioner F4 category)

    I hope that you are both going to get your visa, but it sounds as if his might still be in process, and they might be sending his back with out a visa, I hope the best for you both.

    Thanks to the great advice here, everything was successful. My mother wrote a letter explaining our living / household situation (separate financial households, etc.). Both she and my father signed it, included their social security numbers and a copy of both driver's licenses. We emailed it as a .PDF, and a week later received a reply that it was satisfactory, and to please mail his passport. 221g case closed, whew! :)

     

    His visa was issued on the 4th, and he received his passport back today, ready to go!
