  1. Well, then I guess I can assume that they are taking a direct flight there so as to not need an AP at all.

    Good point however.... not to assume they are taking a direct flight but that they MUST take a direct flight...

    No worries, i wouldn't plan to travel outside the US, the flight does to Honolulu than straight to Guam. :) Don't worry I wouldn't make that mistake...

    It IS a US territory and i can legally go there without an AP

  2. My Husband and I may be going to Guam for 4 - 6 months. He is doing a software activation for the company he works for. I just filed for my AOS on Monday. What would happen is I'm in Guam when they set my interview date? Would I be able to have my interview in Honolulu?

    Just trying to anticipate what to expect. we'll probably be heading for Guam the beginning of May. :help:

  3. After reading this document: http://www.kamya.com/ssn/em00154.pdf it is not clear to me why EAD is even needed except after the initial 90 days of entry.

    "Some I-94s issued to K-1s are stamped or annotated 'EMPLOYMENT AUTHORIZED,' and some are not. Either way, the I-94 is proof a K-1 alien is authorized to work."

    So...is this incorrect or what?

    This is the Grey Area I'm TRYING to figure out...

    Careful what you ask everyone will you think you're trying to get around the law vs figuring out it!!! ;) (still not sure how I "figured out a way to get around the law")

  4. Do you feel that the rules do not applly to you because SSA issued you with the wrong card....

    If you did not need an EAD to be able to work then why would we all have to file for one along with our AOS...

    Yes unauthorized work is normaly forgiven at AOS interview when you are married to a USC....

    Question you have to ask yourself is "is bending the rules worth any risk that might put a ? over my AOS?"

    The reason I am asking these questions is because I've heard several ppl say that you CAN work on a K-1 for the 90 days after entry without an EAD, and some say another 90 after that (the time you have to file for AOS)

    I didn't KNOW if receiving this social card on a K-1 was normal

    that's why I am asking.

  5. I've heard different opinions on this matter, or maybe I"m simply confused and the answer if obvious.

    I do not have an EAD.

    I received my social security card, it is not marked in ANY way that I am not work permitted.

    the instructions that came with it (amongst many other instructions) state:

    "if you are an alien without permission to work in the U.S., your social security card will be marked "NOT VALID FOR EMPLOYMENT". We will notify U.S. immigration officials if you use the number to work

    If you are an alien legally in the U.S. with temporary permission to work, your social security care will be marked "VALID FOR WORK ONLY WITH DHS AUTHORIZATION".

    My card is not marked either way.

    It is a simple, normal, everday SS Card.

    Did I get lucky, and Can I use it to work? OR will I run into problems with my AOS?

  6. I am 100% unsure why you feel you did something wrong. Maybe I missed something, and I did something wrong!

    I got my Social after I had married on my K-1.

    She's still here on the grounds of her K-1 visa, the only difference if her name has changed. As long as the Visa hasn't expired or isn't CLOSE to expiration ( 1 week away) You shouldn 't have a problem.

    Tell her to go into the Social Security office, to take her Birth Certificate, Marriage Lisence (or certified copy), Visa, Drivers Lisence. And apply! You just need the marriage lisence to prove the name change.

  7. Okay Two questions today!!!! Isn't this fun?

    #1 My Husband said he doesn't EVER keep his W2 (at this point I considered ringing his neck.. jokes) What do I do? Is there anyway to get them? (are they like what T4's are in Canada?)

    #2 Okay on all my K-1 Visa paperwork when asked when I would live once I moved to Montana I put my husbands parents address (where he was residing at the time) Now that I am here and married we have got our own place of course! Do I need to file something in order to tell them I am living at this new place before I file for AOS? Or can I just put the new addres on all my AOS paperwork?

  8. He was a student in 2006 and wouldn't qualify using that tax return. But if we send in 3 years worth they will see he qualified when working at the same place he does not, 3 years ago before school. He will easily qualify this year. And we have a letter from the employer etc stating income level.

    Yes that's what I was asking, if my co-sponser must be a joint-sponser.

  9. In the instructions for I-864 under "Who Completes and Signs Form I-864" it reads "The U.S. Citizen or lawful permanent resident who files a Form i-130 for a family member, Form I-129F for a fiance(e) etc etc.

    I only have to get my Husband (was fiance files I-129 for me..) to fill out the I-864 correct?

    Even though I had 2 people for my K-1 Petition.

    He has now started a new job and can easily meet the standard. So I don't HAVE to have two again just because i did before do i?

  10. I have my Visa!!! I'm in YVR right now waiting for my plane to board.

    I will write a full review later! Here are some quick thoughts

    My Doctor neglected to check a couple boxes and it took them a long time to get ahold of them in order to get the proper paper work.

    They told me and the others there we needed to have Tax returns for all Affidavit of Supports, not just self-employed. Although I'm sure we know more about the process than she did. haha.

    Once you go through security no washrooms.

    Bringing Fiancee a plus. Only asked me around 3 questions!!!
