  1. My USCIS  case completion time went back to 6 months today. It used to say” we are taking longer than expected until yesterday “. It’s already been over a year now and was hoping I would be scheduled for interview soon. I already have my biometrics done before the pandemic. My local field office is Sacramento CA. 
     

    My question is : Did anyone else experience this with their application where case completion time went back to 6 month from “we are taking longer ....?  
     

    did you actually had to wait further 6 month for the interview to be scheduled ? 
     

    hope someone can share their experience 

     

  2. I had my interview on May 20,2019 and was approved at the interview. However, it went to Administrative processing and still stuck on same status. While I wait, i tried to create my uscis account and verified my identity. I can now see i551 case on my account with the following status: 

    May 24, 2019

    In Process

    USCIS has accepted your application, petition, or request for processing.

     

    I am confused as what this case could be. It has different receipt number(IOEXXXXXXXXXXXXXX) which we never received in any form of communication. Could it be the same case that consulate is processing abroad ?  I know the abroad case is tied to NVC case number which is only traceable on CEAC.

     

    The administrative processing is killing us although interview was approved and its already 10 days, so just trying to play the guessing game to stay positive.

My wife had her interview on May 20 for her f21 visa at US Embassy in Nepal and she was approved at the interview and was given a white approval card which says approved and instruction to collect passport. The status on ceac shows Aministrative processing since then and after looking up on VJ, it sounds like normal after interview. 

    Now when I log in into ceac on page where we uploaded all our AOS documents and civil documents, the  AOS section shows INCOMPLETE and has 864EZ line item as missing. I already submitted the regular 864 during the NVC process and everything showed completed until after interview. They din't ask for any further documents at the interview or even after interview. 

    They didn't keep  any documents at the interview as well beside Medical and kept passport. All the copies of original documents, 864, tax documents and even the passport photo was returned back after interview. I was in impression that they keep copies of civil documents and the tax documents but they didn't and i am kinda confused. May be they just use the scanned copies that we uploaded during NVC??

    Is it normal or did embassy mess up something ? May be that can bring impact on the admin processing ? Can anyone who recently got approved verify for me if they have similar situation ?

    It's not even big deal. They only care if you are legally married. As long as you have a valid marriage certificate recognized by the local government, that's all that matters. They will only barely take a look at the wedding pictures. Those are secondary evidence. What they are interested in the most is the bona fide relationship. As you have been married for over 2 years, have you filed tax returns as married and list your spouse, have you commingled assets, bank accounts, insurances, ... Evidence of time spent together, trips together, ...that sort of thing. 

    Yes, we filed joint tax for 2017 and 2018 and I have her on my medical benefits, pension , life insurance.. We spent out anniversary in bali indonesia and have all receipts , boarding passes. I will take all those to the interview but its just matter of if they even look at them. 

    For bank account I wasn't able to add her as they require her to be here physically and have social security. 

  6. Please excuse me if this has been asked previously. I couldn't find any similar scenario so thought might create a new thread and see if anyone has similar situation or any feedback. 

    Ok, so we got married at Arya  Samaj temple in India and it was Hindu marriage. We did perform rituals as advised by the temple priest and they issues a marriage certificate. I took that certificate to local marriage registrar and got it registered on the same day and they issued  official registration of marriage certificate. The process was advised by a lawyer for quick turnaround, infact it only took a day for entire process. The lawyer guided through entire process. I am not familiar much with Indian marriage law and took lawyer advise along the way.  I didn't take any photographs at temple wedding as it was just my wife , me and couple of witness.

    We used the same marriage date and both the certificate from temple and registrar office at 130 and nvc and now we are scheduled for interview. 

    Now comes the tricky part . We also had traditional big fat wedding after a week of temple wedding with 100s of guests and did all the rituals as required by hindu marriage. We submitted all the pictures from that wedding at 130 and side loaded at NVC and planning to take to the interview. 

    So, is that technically considered marrying twice to the same person and create any flag during interview ? Please note the temple wedding was a hindu religious wedding and not a court marriage . I know some people do court marriage and do traditional one. I only had couple of weeks for the wedding off from work and we went that route to accommodate our timing, also it was advised by lawyer for quicker process. We also got the marriage certificate certified by Ministry of foreign affairs and that took almost a week. 

    Anyway, I would really appreciate if anyone could help me or have similar situation . I know I could tell the next traditional wedding was celebration but the pictures i have submitted shows it more like wedding with all hindu rituals. I couldnt have submitted those pics and create less confusion but its been already done. 

    How do I explain this at interview? We been in relation for almost 8 years (arranged through family ) and married for little over 2 years now . We have plenty of communication logs , few face to visits with tons of pictures. She is on my medical insurance, pension plan, authorized credit card user but i know those documents are barely reviewed at the interview. 

     

  7. Could anyone who recently had interview at US Emabssy in Kathamandu share their experience ? I see very fee reviews under consulate review with not much detail. Could you please share your experience here in detail or on consulate review page ? 

    What type of questions they asked, what documents were they more interested in term of supporting documents? Any feedback would really be appreciated and would be great help.  

  8. Hi - We made a couple of mistakes on DS 260. We missed mentioning one of the address that my wife had lived and also her intern Job history for employment history. We did had those information on form i130A when filing petition for my wife. but for some reason we forgot to mention on DS 260. Now we have mismatch information and was trying to see if we can amend it at the consulate. 

    If so, what's the process? Should my wife just tell the person who collects the documents at the consulate or mention to the officer who interviews upfront? I know officer start asking questions as soon as we get to the windows so not sure if she need to stop him/her  before and mention it. 

    Or should she just mention it if asked about employment history. She dint had any other job beside the short term unpaid internship.

     

    Has anyone have similar experience and if so how did you amend it and had successful outcome. Any response would really be appreciated. Also , any fellow Nepalese forum members who went through similar problem..

I know this has  been asked million times on this forum but I just wanted to ask to any fellow Nepalese filers who went through NVC process and if you guys side loaded the documents(evidence of relationship) at NVC stage . I am in the process of collecting my financial and civil documents and sending it to NVC soon.  I didn't include enough evidence when filing i130 but got approved. I have collected enough evidence between filing i130 and getting approval and would be happy to include them if it really helps. I have seen fellow VJ.s members mentioning to side load if your embassy is a tough one but as per Nepal I don't think its there yet. Any feedback from any fellow Nepalese VJ,s members would really be appreciated. 

  10. This is what I did and entire process took less than 2 month from filing to receiving refund. 

    1.Get your spouse passport certified(Not Notarized). The passport issuing agency back in your country should be able to do that. In my case Ministry of foreign affair office did it. I am not sure if USA embassy will do that but you can inquiry with them. 

    2. Get the certified copy mailed in to the USA. 

    3. Find an IRS Acceptance agent local to your place. I used H&R Block. 

    4. Make an appointment with the agent. Make sure you mention you want to file your spouse ITIN(Individual Tax Identification Number) along with your tax return. 

    5. The agent will prepare form w7 for your spouse ITIN and file your tax at the same time. The agent will verify your certified copy of passport and send it along with the form to IRS. 

    6. SInce your spouse won't have ITIN/SSN, the form needs to mailed and can't be e-filed. 

    7. You will need signature of your spouse on both w7 and tax form.

    8. You can mail them the forms to have it signed and send back to you again. Once you get the signed forms back just mail the entire package as mentioned by your tax agent.

    9. IRS will receive your both forms and start the process.

    10. They will issue ITIN for your spouse and apply that ITIN to your tax form and send for further processing. 

     

    This will let you do both at a time and will not require to send the original passport.

     

    You can also just process w7 and wait to receive the ITIN and then file taxes but for me doing both at a time worked out well. I paid less than $100 to h&r block to do my taxes and w7.

  11. Get certified copy of your passport and send it. IRS doesn’t accept notarized copies. Usually you can get the certified copies from ministry of foreign affairs or similar government agency in your country. I submitted certified copy of my wife passport and was able to get ITIN for her in 6 weeks. 

    Again, research on getting certified and not notarized or attested. Usually you can stop by agency who issued your passport and ask about it. 

  12. Background: We both are originally from Nepal and I am currently permanent resident in USA. My wife is still in Nepal. I have applied i130 for her and is in process since march 2017 at California center.

     

    We have been in relationship since 2012 and officially married in 2017. We married under Hindu Marriage Act in India instead of Nepal and got our marriage certificate issued by Indian government. We submitted the same on our i130 application. Will the consular raise any issue about that as to why did I not go Nepal and married there instead of India? Will that be a red flag? The marriage was carried under Hindu act with witnessed signing the marriage certificate. We also had our parents and relatives. Pictures of wedding submitted. 

     

    I would appreciate if anyone with similar situation could share their experience.

  13. I filed ITIN for my spouse who is still abroad and has i 130 in process for F2A.  I filed on March 10 and I know its little early to expect ITIN with the way IRS process application. However, if i dont receive my ITIN or if my tax return is not processed by April 15, do I need to file extension?  I submitted my return with ITIN application on March 10. 

     

    Another related question regard ITIN:  

    I did my ITIN process through H&R Block and they just asked me to send W7 which I mailed along with my tax return. Later I was just browsing and came to find that you also need to submit a letter to IRS saying that you are considering yourself as a resident for tax purpose only. The agent at H&R block didn't mention anything about it when submitting my application. Will that create any problem? Has anyone got their ITIN without sending the letter  ? BTW i also send certified Passport copy with W7.

     

    Last question : The application packet was delivered to Austin Tx -73301 although I had the zip code on my envelope as 78714. Is it normal or did USPS mess it up ? I cant even call IRS and confirm as they say we can't call until 8 weeks i guess.

  14. Looks like the information chart for California Service Center is missing processing time for 

     

    Permanent resident filling for a spouse or child under 21

     

     

    I have my application pending at CSC(WAC) and was checking the processing time when I realized that it no longer list that particular category. Does that mean CSC don't process i130 filed by permanent resident for their spouse and my application might have been transferred to different service center ? I haven't received any notification for my case being transferred yet.

    Eligibility Requirements for VAWA Self-petitioners:

    • The intending self-petitioner must prove that s/he is a spouse, child (unmarried and under age 21)/parent of an abused child (unmarried and under age 21), or parent who was physically battered and/or subjected to “extreme cruelty” by a U.S. citizen or lawful permanent resident spouse, parent or adult child.  Such abuse may include evidence of:
      • physical abuse, violent acts or threats of violence, sexual abuse or exploitation, verbal abuse and degradation, emotional abuse, isolation, intimidation, economic abuse, coercion or threats to take away children or have one deported

    I don't see how it leads to abusing VAWA.

    Here is the scenario. Please suggest if this case qualify to apply for VAWA?

     

    Girl and guy falls in love at their work place. They hang out on weekends and visited few places. Guy and girl both seem to like each other. Started talking and sharing stuff and eventually decided to get married.Guy had recently broke up with his ex like few weeks back when he and the girl started hanging out together. The girls moved in with guy and marries with each other in a week. He promises to spend rest of his life  with her and all those big dreams. Girl too innocent believes him and get married to him with all excitement. As per girl immigration status: She was an F1 student and later got TPS based on her country. 

    Everything was fine for a week or so after marriage. 

    Problem : The guy ex gf  knows about his marriage and starts calling him and his family threatening him that if he don't accept her she would die and all kind of #######. The guy decides to separate with this new girl until things get resolved and the new girl moves out thinking things will get resolved between him and his ex and then she can move back in. But its been a while since he is been ignoring her and she is sure that the guy just played some sort of game to get the girl for a while and then now he don't give a damn. The girl is emotionally broke and going through lot of mental issues. 

     

    Can she apply for VAWA as she has to face mental and emotional stress for a game played with her? She is still married but the guy don't seem like interested in any aspect towards her
