    You weren't a resident yet, so the law didn't apply to you.  You weren't eligible to buy the ACA Marketplace insurance before then.  So technically it's not so much an exemption as not applying.  You weren't a resident living abroad, but simply a citizen of another country.  So the physical presence test doesn't apply.

  2. Dear all, 

    I have a question regarding a healthcare penalty. 

    I have arrived to the US on my K-1 visa in June 2017. Was married in June 2017 and added to my husband's insurance plan the same day. 

    I am a US resident according to physical presence test (more than 183 days). We are doing the taxes and filing as "married filing jointly". 

    Are we supposed to pay for absence of healthcare coverage in JAN- MAY or can use an exemption? I am confused because by the moment I was leaving my home country in June I was resident there and by the end of a year I lost my residence (and became a resident of the US).

    I didn’t get any mail or email, I just saw my online status changed last Friday, so I hope to get the letter this week. 

     

    And I really hope there will be a combo card because my AP status didn’t change...

  4. Hi all, 

     

    Still can’t believe on the day 163 my EAD status changed to “card is being produced”! 

     

    Does anybody know how much time it takes to print the card and deliver it? 

     

    Also, before the status was changed we made 3 SR and only the last one was assigned to the processing and only after we contacted the local congressman. 

     

    No updates regarding AP and AOS...

     

    Glad to read that people are already attending interviews!

    In June 2016 I visited the USA for the first time and in March of this year we had our second visit and he came to visit me here in New Zealand.

    I have a passport stamp in my passport from my visit to the USA but he has no passport stamp in his passport from his visit to New Zealand.

    We have lots of photos and documents that he was here, he paid for a hotel and car rental with his credit card so it shows his name, but I guess you could do that online too.

    I have no idea why there is no stamp and it's so strange to me why there isn't. 

     

    Has anyone else had this and it became an issue for proof of having met?

    If as you say you have a lot of photos, why can't you submit something which definitely shows that it was taken in NZ? Also, if you have boarding passes, it can help.

    is there anyone experienced in I-129f expedite? 

     

    The is only one thing I'm interested in- how much time it really takes after uscis accept the request to expedite to the decision (NOA-2/RFE etc)? 

     

    The petition was received on 01.19, in march we sent all required docs to expedite and got the letter dated 03.24 that our docs for the expedite have been accepted. Total silence after that. 

     

    To have everything in time, seems like I have to enter the US latest by the end of July. I can see that people who applied with the petitions the dates around us have already started to get approvals even without expedite and really very worry :(

    What I am am bringing to my interview is an exact same replica package of what was submitted to the NVC (or USCIS, I can't remember) originally.  You only bring it to the interview so that if they claim something is missing you can produce it right then and there.  That is my understanding.  My wife is super organised so I am lucky in that regard and yes her tax stuff (which I'm clueless about as in the UK we don't file taxes each year unless self employed) was signed and dated.  It does say they should be signed so I'd advise you get him to do this before your interview.  Is he the one in the US?  Where are you? 

    Thank you. He is in the US and I'm in Moscow. No problem for him to sign these docs I just thought it must be signed and stamped by tax service or someone else!

    could you please clarify the information regarding the financial documents required, the US embassy web site says:

     

    1. Financial documents from a US citizen petitioner:
      • Copy of original, signed tax returns for the last year (both W-2 and 1040). If copies of tax returns are unavailable, provide transcripts from the IRS.
      • Form I-134 (Affidavit of Support)
      • Bank statements
      • Employment letter

     

    for 2, 3 and 4 everything is clear for us, but for 1, my fiancé sent me the scans of w2 and 1040 and there is no any signature on them. He said he received it by mail. Should he go somewhere and get signatures/stamps?
