When you are stuck in a predicament, you try to use any avenue available that might help.

If in the end, none of the avenues help make your situation better; at least you know that you tried everything.

She can email the Embassy.......but it will be a waste of time......AP can not be expedited or waived.....

She already emailed the Embassy and it was a standard language that it’s under administrative processing, so it was pointless.

I realize administrative processing can not be expedited or waived.

What I would like to know is if she is allowed to make an appointment at the Embassy and inquire about her husband’s visa status.

She is already going to visit him and spend time with him, so she figured if it’s allowed she would inquire at the Embassy in person.

Just not sure if it’s possible; if so what the method is to make an appointment.

  3. Hi,

My US citizen cousin got married in Pakistan in January 2018 and her husband had his interview in June 2019. Since his interview the case has been in administrative processing with no status update.

My cousin is planning on going to Pakistan to visit her husband in March and she wants to the following:

As a US citizen is she allowed to go (with or without an appointment) to the US Embassy in Islamabad to inquire about her husband’s case status/ visa status?

Thanks for advice. She is very stressed out.

My cousin did send an email to inquire about her husband’s visa status since it’s been more than 6 months and no update. However, she did not receive any relavant information.

  4. Okay thanks!

My wife is sponsoring 5 family members, and that includes the primary beneficiary.

In part 3 section 29, my wife would indicate 5 correct?

Since my sister in law is sponsoring 4 family members (not including the primary beneficiary because my wife is sponsoring) does my sister in law state 4 or 5 in part 3 section 29?

The statement in part 3 section 29 says to include principal immigrant and family members, so it’s confusing.

    hi

    yes,

all 3 of you have to mark yes on 3 1

each of you have had to put the beneficiary first, and then each of you will list the derivatives

    Thank you for responding!

I was thinking the following but am not sure:

mother in law would indicate yes in part 3 section 1 (because she is the petitioner, regardless if she can financially sponsor or not).

my my wife would list yes in part 3 section 1 (because she would sponsor the principal immigrant and 4 other family members.

my sister in law would check the box in part 3 section 2 (because she would sponsor 4 family members).

If you or someone else can confirm the above please.

And my final question is the following:

In part 5 section 1 of the form does my mother in law indicate “9” for the number of persons being sponsored in this affidavit? (Even though my mom cannot financially sponsor the 9 family members)

My wife is sponsoring 5 family members and my sister in law will sponsor the other 4.

For example:  You and your wife make enough to be the Joint Sponsor & Household Member for 5 of the immigrants.  So your household would be 2 + 5 = 7

Your SIL is the Joint Sponsor for the remaining 4 immigrants.  Her household would be 1 + 4 = 5.

Essentially, the two different Joint Sponsors will divide up the intending immigrants between the two of them.

Thank you sooo much for your help!

For the 9 immigrating family members my mother in law is not financially sponsoring any. She is on social security so not enough money.

My wife and I will be sponsoring 5 family members and my sister in law will be sponsoring 4 family members.

I have attached a screenshot of part 3 of form I-864.

Based off of above scenario, does my mother in law check “yes” in section 1 and then list off the 8 other immigrating family members?

My wife would check “yes” in section 1 and list off the 5 family members she is sponsoring?

Sister in law would check “no” in section 1 and then list off the 4 family members she is sponsoring?

In part 5 section 1 of the form does my mother in law indicate “9” for the number of persons being sponsored in this affidavit??

My wife would indicate 5 persons in part 5 section 1?

My sister in law would indicate 4 persons in part 5 section 1?

    Your MIL's household: her and 9 immigrants = 10

Your and your wife's household: 2 of you and only those immigrants you will sponsor.

Your SIL's household: her and only those immigrants she will sponsor.

It is a big deal if you can declare to be in the same household or not.  If you were in the same household, then you could combine income.  But you are 3 separate households, so you can not combine income.  The law does not allow all four of you to declare yourself as a single household to combine income.

So on my mother in law’s I-864 she will have 10 persons in her household.

On my wife’s i-864 she will have 2 persons in household?

On my I-864 a I will have 2 persons in household?

on my sister in law’s I-864 she will only list herself in household?

on my mother in law’s I-864 she will only list her income, correct?

I sincerely appreciate your help with this!!!

Related people can live in the same house and not be considered the same household.

Does your MIL declare any of the three of you living with her as tax dependents on her tax return?  How old is your SIL?

No, she only declares herself on her tax return. My sister in law is 26. Sister in law files taxes on her own. My wife and I file taxes jointly.

Its not big deal for us to declare in same household or not. We just want to make sure we are doing it correctly so no mistakes.

Thank you all to who read and those helping!

  9. I may have not written my post clearly so I apologize for any confusion.

    Our situation is this:

My wife and I, my sister in law, and my mother in law reside in the same house.

My mother in law petitioned for her brother. There are 9 total family members.

Since the family size is large that is immigrating, my wife is going to be joint sponsor 1 and my sister in law is going to be joint sponsor 2.

Does my mother in law include the 3 of us (her  2 daughters and myself) in part 5 section 7 of I-864 form where it asks to list “siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here.”

Also does my wife and sister in law submit form I-864 each and I submit I-864a?

    Thank you in advance!

  10. I think you misunderstood our situation.

my mother in law petitioned for her brother and there is a total of 9 of them.

My wife and I reside with my mother in law. My sister in law resides with her mom as well.

I want to know if in part 5 section 7 of I-864 if my other in law should include the 3 of us? And subsequently if she would include our income on part 6 of the form?

would my wife and sister in law file forms I-864 each and I submit I-864a??

  11. My mother in law petitioned for her brother back in 2005 and the case is almost current.

The brother is married and has 7 kids! So my wife and I, and my sister in law are going to be joint sponsors for the petition my mother in law filed.

Does my mother in law include the 3 of us: my wife and I and my sister in law in part 5 section 7 of I-864 for household size? My wife and I and my sister in law the other sponsor reside in the same house as my mother in law.

My mother in law would list 1 for herself

Mother in law would list 9 for persons sponsoring in this affidavit.

So would my mother in law’s total household size be 13?

Also would my wife submit I-864 as first joint sponsor and I submit I-864a?

my sister is law submits I-864 as second of 2 joint sponsors?

I know it’s really lot of information, but please someone help.

  12. I’m helping my cousin with his affidavit of support form (I-864) that he is filling out for his beneficiary (his wife).

My my cousin makes around $15,000 a year which is below the $20,575 poverty guideline for a household of 2. So my cousin is going to get help from his parents for support.

The parents file their tax return jointly.

In part 6 of I-864, would my cousin list his mom as person 1, listing her relationship along with her income; and his father as person 2, listing his relationship and his income?

So will my aunt and uncle complete 2 separate I-864a forms? My aunt lists her individual income in i-864a and my uncle lists his income in i-864a? And my cousin completes I-864?

Aunt and uncle don’t have to complete I-864? My aunt and uncle submit naturalization certificate with their I-864a to prove citizenship status?

    Thanks for help in advance!

Have her come to the US, activate her visa, gain a re-entry permit and then leave.  She will have two years to resolve whatever is going on.

How do you activate a visa and how long does that take?

I thought my mom's visa was already "active" when it got approved?

With a re-entry permit what is the process?

How long does she need to remain in her country?

If it is long term like a year or more then she can come to the US to activate her permanent residency status then apply for a reentry permit. A reentry permit allows her to be out of the US for up to 2 years without a risk for her loosing her residency status.

We are not sure how long she will stay before moving here. My mom found out someone went to court to try to claim the little land that my mom has. My mom is going to fight this case before she comes but it might take a while.

  15. Hi everyone,

My mom got approved for visa about month and half ago that I petitioned for her.

Something totally unexpected came up that was not planned for. The visa stamp in her passport is only for a few months and my mom can't come before then.

Is there anything that she can do to extend the visa date or anything else, so we don't have to reapply for a visa again?

I wanted to know have they change the date of issuing Visa Bulletin ?

As first it used to come out every 10 of the month but now it is not coming ?

If anyone knows which date will they issue it

I was thinking the same thing. In the past it seemed as if the visa bulletin got released by the 10th of the month. Now it seems like every month is released after the 10th.

I wonder what the reason could be.
