  1. Had my interview October 7th in NYC Federal Plaza. Waited for an hour and the initial interview was less than 5 mins. Interviewer asked for our birth certificates as well as our children’s , my passport and photo album. He flipped through the album in 1 second. 
    He asked me for my address? Followed by 5 questions to which they were all answered no. (Criminal activity)

    He asked my husband where he works and if we have any new information to update besides the birth of our child. We both answered no and that was it. 
    We were sitting there like two dummies not knowing the interview was already over. Lol Then he said “that’s it” while getting out of his office. He was basically throwing us out. I didn’t even get a chance to put the documents back in my bag. 
    We never received an update. I had to call to find out the status and was told we were approved and to expect the notice in the mail.  Yay!!!!!!

    Sure. My appt was at 8:00am. There were 6 people in line already but the process was very quick.

    Bring the biometrics notice they send in the mail and your i.d. with you.

    Also bring your marriage certificate if you changed your last name.

    The guard did ask me for it but I didn't have it with me but it was ok. 

    They give you a simple form to fill out with your Name, Height, weight, eye color and hair color etc

    Then had to go on another line to get a ticket number to be fingerprinted and photographed.

    Biometrics notice was stamped in red and will  it back and then you're all set!

    Cellphones should be turned off completely. 

    Everything took 30 mins. Arrive 15 mins prior to your scheduled time.

    I was unable to resubmit the application because things changed between me and hubby. He has become physically and emotionally abusive towards me and has stolen the money we originally used to file the i130 and 1485.

     

    I did not call the police about the abuse because he threatened to withdraw the application if i did. However, I did call the police to report that he stole the money from me.

     

    I have a lawyer who is filing the i360 and i485 etc for me. This is the list of things i have to accompany the application.

     

    1. Copy of hubby's birth certificte (US citizen)

     

    2. Marriage certificate.

     

    3. Copy of bills in hubby's name and my name.

     

    4. Affadavit from a mutual friend who witnessed the physical abuse and knew of our marriage and us residing together. He witnessed hubby choking and punching me.

     

    5. Affadavit from another friend that i told about my experience. 

     

    6. Original Affadavit from my dad and best friend in support of the marriage (originally submitted with the i130 and i485).

     

    7. Affadavit from a friend who i told about what was going on.

     

    8. Police report from where i called the police when he stole the money.

     

    9. My personl statement explaining the abuse etc.

     

    10. Local police clearance 

     

    11. Police clearance from the UK as i gave only been here for 6 months.

     

    Is this list of stuff ok?

    Do you have joint lease, bank account? Is your petition primarily based on physical or emotional abuse?

    Maria43 if you don't have police reports or pictures then you can have a psychological evaluation. I'm in the process right now thanks to everyone here! I found one for free close to my home.

    Other members will chime in but it will help your case. I've learned so much on here. 

     

    Also read the older closed threads. Most of the questions you probably have might have already been asked in there. Very informative! 

  5. Hello all and happy new year! I need a little help with my forms. Form I360 Do I fill out any of Part 4 if I'm in US?                                     Form I912 I am using low income. My daughters and I receive WIC and they get SNAP benefits but I don't. Will the agencys' letters stating they receive benefits be enough or Do I have to choose #1 in Part 1 and complete  Part 4, the means tested benefits table?                                      

    Do i put the amount I receive from SNAP for #7 (total additional income)              

    I am self employed and get paid cash. Will a notarized letter stating my pay be sufficient since I don't have paystubs?

  6. Hi everyone. I'm new here and I've been following this great thread. I've learned so much on here and I would like to thank everyone for all their advice and inputs especially Sandra!

    I was told i qualify for Vawa but I'm not sure. I just have a few questions but first let me give a little summary.

    I live in N.Y. I Came on a b2 visa in 2000.I have been married to a USC for 3 yrs now. We were highschool sweethearts and friends for over 10 years. My husband was the sweetest person but behind closed doors he was a totally different man when he got upset. He would get physical everytime he drank or had a hard day at work. Verbally,mentally and physically.I threatened to call the cops one time, took pics when he punched me in the face and he found them and broke the phone. I never tried calling the police on him again because he has friends in different precints where we live (they would often come hang out together at our home) and i was also afraid of him going to jail I also didn't want to jeopardize his job. and i was really afraid of the repercussions of getting him arrested and having the police ask about my immigration status.I was just too afraid.

    He would often choke me, slap me around, pin me to the wall, take my keys and cellphone to work with him, threaten to have me deported and take my daughter away. I took pics (not many) when i could and sent them to my email and then deleted them just in case. He's thrown meals that I've cooked at me when it wasn't what he felt like eating. He would take my pay when i came home from wrk and leave me with $50 for transportation and food for the week. My only 2 witnesses are his brother and mother and they don't want to get involved so they won't write an affidavit.

    I finally moved out after he punched me in my belly when i was 4 months pregnant and i haven't looked back. I have an affidavit from our mutual friend who took me to the E.R that day.I want to know if i have a case. And if i do...

    Can i file i360 i485 i765 i912 g325a concurrently?

    I have declaration,photos, Marriage certificate, bank statements, lease, phone bill, ConEd bill, passport pics, tax returns.

    I'm waiting on police and state clearance, friends and family affidavits of good faith marriage and good moral character.

    How can i show that my husband is a USC? I've tried getting a copy of his birth certificate or vital records but NY doesn't allow spouses to obtain copies.

    Is it ok if I don't have a police report?

    We filed joint taxes last year and my daughter from a previous relationship is on there but not our baby. She doesn't have his last name.he's never even seen her.

    Will that be an issue on our taxes?

    Do i have to send in a copy of my daughters' birth certificates?

    Should i mention that I have an ITIN in my cover letter even though it's already on the tax forms? Should i send a copy of the approval ITIN letter?

    My husband never placed me on his insurance.Only my daughter. He would agree to do it and then get upset and change his mind. He would said he rather see me pay out of pocket or suffer than put me on there. Yes i know it sounds mean! Will it be an issue that I dont have any proof of insurance?

    What documents or copies do i need to include with i765 besides 2 passport photos?

    When can i do the medical? Is it best to wait after vawa approval?

    Do i need a Psychological evaluation? I don't have funds for it.

    Thanks so much in advance. I appreciate all the support here. I have no one to talk to and this is the only place I can get advice. I've called a few local places for Vawa advice and haven't gotten anything. Sorry it's so long.
