  1. Hello,

     

    My husband came to the US on a K1 from Cuba last fall. We got married and went through the AoS process and he received his US green card in March of this year.

     

    He wants to travel to Cuba to visit family, but we feel nervous about him traveling under this current administration and its increasingly nightmarish immigration policy and disrespect for immigrants, even those that maintain permanent residency. Is it safe for Cuban citizens that are US  permanent residents to travel to Cuba and return to the states without hassle under Trump? Have any Cubans or partners of Cubans done so in the past year?

  2. Hello everyone! For everyone having interviews, congrats! I have a few questions. I am a K1Visa applicant, married November, applied to adjust mid November.  My case tracker, like many here, still says case received/fingerprint fee recieved at the end of Nov. We did our fingerprints mid December. For those who are having interviews -

     

    1) did your case tracker change and/or did you receive notice by mail or email?

    2) What does this notice contain?

    3) How do you schedule an interview, and does the notice contain information on what to prepare?

    Finally I have a question about using a joint  sponsor. I currently make enough to serve as the sole sponsor for the Form I864, but in previous years I was in grad school and making less. I wanted to use my father as a joint sponsor on the form I864. Because he is my father, do we need to do a form i864a contract between sponsor and household member? I don't intend to use him for support, however, I thought it would be important to show that I've had support for the last three years.

     

    Now I am confused as to how I should fill our the form I864 and if I need to fill out a I864a?

Keep in mind though that most K-1 entrants do not send any evidence and they are approved just fine. Below is what I sent, we did not even have a joint bank account at the time, I mostly wanted to show that we got married and were living at the same address basically.

      • Photos and receipts from the day intention of marriage was filed
      • Fee receipts from City Hall and wedding appointment document

    1. Either "K" is fine, or write in the "1" or whole entry as desired. The I-485 is reviewed by hand so as long as they can read it, it's fine.

    3. No....245(i) is a very limited case that almost nobody qualifies for anymore (you have to had been in the US as of almost 2 decades ago now).
    4. My wife answered "No" as a K-1 is not an immigrant visa.

    6. My wife put her 2 most recent physical addresses for #5-8, then the other addresses she lived at for at least 1 year or longer, per the instructions. It says ""if not already listed above", so we didn't list the address we named in #7-8.

    8. Yes. Better to disclose it and explain it if asked than to not disclose it and think you're hiding it. Read the questions literally and answer them honestly and completely.

  7. Hello all! My husband and I are compiling our AoS paper work. He came from Cuba on a K1 and we recently got married. I have some questions, that I have posted elsewhere, and would be most appreciative for your help.

     

    Medical

    My husband never received the DS-3025 during his medical exam. He has the Cuban vaccination card that his doctor gave him during the medical a few months ago, but never received the US vaccination form. If any one knows Cuba, it is impossible to call the doctor or hospital and have them mail or email us a copy. So now, after some advice from a very helpful VJ member (thank you @Suss&Camm! :) ) it seems our only option is to go to a certified doctor here and ask them to fill out a portion of the I-693. Has anyone gone through this process?

     

    I-485 Questions

    24. What is your current immigration status? (If it has changed since arrival.)

    "K1 Visa Holder," correct? He came on a K1, we married, and now are doing AoS.


    Part 3: 1. Have you ever applied for an immigrant visa to obtain permanent resident status at a US Embassy or Consulate Abroad?

    Does our K1 visa application count? 


    Part 3: Did you write the addresses of old residences and employer in Spanish (or local language) or English, how they would appear in Cuba (local country) or US?


    For residences and employment there are two sections - the first two questions ask for most recent, then the next two ask for most recent residences/employment out of US, should we just follow in chronological order? For instance, my husbands current address is in New York, US, and his previous was in Havana, Cuba. Do these need to be listed in the separate sections, or consecutively?

    Part 8:  1. Have you ever been a member of, involved in, or in any way associated with any organization, association, fund, foundation, party,  club, society, or similar group in the US or any other location in the world including any military service?

    My husband spent 9 months doing the obligatory Cuban military service, in a general position. Would we have to mark YES for this question? And it has implications for the following questions:

     

    49. Have you EVER received any type of military, paramilitary, or weapons training?

    We are hesitant to answer yes because he truly did the most basic form of general military service. Thoughts?

     

    55. Have you EVER served in, been a member of, assisted, or participated in any military unit, paramilitary unit, police unit, self defense unit...etc?

    Would we answer yes to this since he was technically in the military?

    So our issue is that my fiance never received a  DS-3025, when he did his medical in Cuba the doctor just filled out the Cuban forms required for an embassy interview.  Right now all we have is his receipts and the vaccination card. The doctor in the home country is supposed give you the  DS-3025  form, no? We didn't know about it which is why we are trying to sort this now. 


    Since we don't have one, I am thinking he will have to go to a doctor here to complete the I 693?

    My fiance is Cuban and arrived to the US on a K1 visa in early September. We got married last week and are applying for Adjustment of Status. I wanted to make this forum for anyone going through the same process, previously, currently, or in the future, in order to share helpful information and advice.

     

    Questions

    Does anyone have a checklist of documents/information they submitted along with their AoS, SS, and EAD applications? Are all documents, including marriage certificates, meant to be submitted in copy form? 

     

    As K1 visa applicants that were approved, do we have to submit as much evidence about our relationship as we did for the I-129F and visa interview? Does this include photos, messages, call logs, shared bank accts, etc?

     

    Finally, since our fiance's completed their medical in Cuba or wherever their home country is, do they need to do this again in the US? If not, what paperwork from their initial medical exam do they need to submit?

One question we had was about opening a joint bank account together. Has anyone done this with their foreign fiances in the US? Moreover, because my partner is Cuban, my current bank cannot open bank accts for Cuban nationals according to OFAC regulations. What have others done in this situation?

    Thanks! Just an FYI I think the "document type" section for #2 applies to non-us countries. We've tried legalizing docs at those firms in Cuba before and they told us the US doesn't recognize the Cuban legalization.

    Has anyone or had their 0 go through the college registration process?  What paperwork did you/ they bring?  And where in Cuba did you/ they get them?  As he would not want to go through high school again and I was told he would not be able to get financial aid without official transcripts. 

    Hey any follow up on this? We have the same question. My fiancé is thinking about doing his LLM, since he has his law degree from U of Havana and we are wondering if we have to legalize his law degree here? We have his official transcripts but they're in paper form, I don't think universeity of Havana has digital transcripts - do they?

It's crazy and amazing that he's finally here :) he had a very easy time going through security, they asked him no questions, and he was able to buy a one way direct flight from Havana to NYC on JetBlue thru Havanatur. (FYI for any Cuban finances, they can buy their tickets thru havanatur or other travel agencies in Cuba). Another follow up I have is about your AoS process. Did you apply for social security and work permit before getting married and submitting your application for the green card? Or did you do them all at once?
