How Do You Format a Rebuttal Letter?
A typical rebuttal letter contains the following issues:
Name of the Addressed
The addressed is the person whom you are writing the letter to. It is this person whom you have a dispute with and whom you would like to set the records straight. This person could be a trader, teacher, lawyer, friend, or employer, to mention but a few!
Date
All written communications have to be dated for the sake of easy future reference. This is why it is imperative that you include the date on the letter. Needless to say, the date has to truly reflect the actual time and day you wrote the letter.
Main Body
This is the most important portion of the letter. It is this portion that contains the arguments that you are putting forth to counter the initial allegations or accusations. It is necessary to be concise and courteous throughout. Any deviation from this standard may often inflict undesirable consequences.
Your Name and Signature
Lastly, you have to write your name underneath the letter. This is proof that you are the one who authored the letter and are hence in agreement with its contents. You also have to append your signature in between your name and the closing remarks.
How Do You Write a Rebuttal Letter?
While drafting the letter, there are some things you have to care about. In the first paragraph of the letter, you have to identify yourself. You have to draw a connection between the person you are addressing and you.
For instance, if you are addressing your tutor, remind him of who you are and how the two of you are related. This will let him ‘get the point’ much faster than he would. It also eliminates unnecessary ambiguities given that he handles many students at a time and may hence not be in the position to recall you in person.
In the second paragraph of the letter, you have to officially deny the decision reached beforehand. This could take the forms of official complaints of the service or a repudiation of an earlier assertion. While at it, you have to provide tangible proof and evidence to back up your allegations or stance.
Lastly, in the final paragraph, you have to lodge a formal request in pursuance to the issues you had identified earlier. This could take the forms of a refund, a reconsideration of an earlier stance, or a review of the decision altogether. Finish the letter by signing and dating it.
Tips for Writing a Rebuttal Letter
- Always be polite and professional. Remember, that even though you may be in disagreement with your employer, they will be more receptive to your point of view if you present your point in an open and amicable way.
- Specifically address the points that you disagree with. Your employer will need to know exactly where the discrepancies in their evaluation and your opinion lie.
- Provide Evidence. If you are in disagreement with your employer, they don’t only want to hear why you feel that way, they want to see it. If you provide solid visible evidence, there is little that they can do to dispute your argument.
- Close with a brief summary of your rebuttal. You want to make sure that your key points are driven home

the very best thing i read is the following:
The Consular Officer explains the negative information in writing and sends the file back to the United States. USCIS evaluates those concerns and will then issue a Notice of Intent to Revoke (NOIR). The NOIR details the problems encountered at the visa interview – maybe there was conflicting information or the foreign national doesn’t know enough about the U.S. citizen.
Typically, you have 30 days to respond to the NOIR. You have to show USCIS why your I-130 petition should stay approved and why the Consular Officer made the wrong decision. If you’re successful, the case will be sent back to the U.S. Embassy or Consulate and a second visa interview will be arranged.
it goes on to say
you have only 30 days and that means USCIS must receive the letter and proofs within 30 days (not a day longer)
and that this is your only chance to submit proofs of the relationship that USCIS will not look at anything mailed after the 30 days (or in separate letters)
I had a NOID not NOIR so i wrote a good brief and i numbered the 2 issues (did not know what books i read and would make me convert to Islam)
then i outlined my answers and sent rebuttal with proofs sending in emails dated years before that interview showing he did not request me to convert and that we talked about the difference in literature (even explaining the word literature) between the 2 countries
I find that emails prove a lot more than chats as the date of the email is easily seen

I didn’t say it is a laughing matter! And yes! I can and have written a letter. Again, I was merely asking for format suggestions.

Do you mean the rebuttal? As other have stated it is case specific. Organization is key. The NOIR has listed points from the counselors notes. I listed our rebuttal in the same order beginning each number with the point in the NOIR and finishing with our response and/or listing evidence. I compiled my evidence behind the rebuttal and numbered them to make it easier to match them up.

time spent finding out what we can tell you is wasted time as none of us are witnesses to your relationship and what has happened and what the embassy has a problem with
this is up to you to prove your points and disprove their's
this is not meant to be harsh but meant to make you move fast to answer the NOIR
the # of days to answer can be 30 or 30 business or 60 but still any of those goes by too quickly

I’ve already begun the process of responding. I just wasn’t sure as to what needed to be included in terms of format. I don’t believe it is a waste of time to seek clarity from others who have experienced this. Isn’t that what Visa Journey is about? Helping and supporting others who are going through the process? I was encouraged to post and ask my peers for help in this forum. That’s all... was just seeing if there was an example in terms of formatting.

Somebody else's NOIR won't help you...the reasons will be specific to your circumstances and case.

Hello... my husband and I have received the NOIR for his CR-1 visa. I was wondering... does anyone have a redacted sample of an NOIR that I could take a look at to determine how to go about creating this document? I have researched quite a bit and found many other documents such as "waivers, etc..." but nothing that speaks to what the NOIR should look like and no example. I know this may be a lot to ask but I'm just trying to get it right so that I'm not just sending in a random "letter". There were no instructions other than prove your relationship is bonafide in your response. LOL>

Husbands appt was for 6:45am. Was interviewed at 10am. Said the CO was awesome and extremely friendly and supportive! Because my husband has children with another woman and classified himself as married on previous visitor visa application, they had to clairify that. He was honest and stated that he was never married before and explained why when asked. The CO gave him a blank paper and asked him to attest to that fact and then take another oath in writing that would go in the file. Then gave him a paper stating “before adjudicating your immigrant visa app, your case must undergo further administrative processing. We will notify you by either email or phone as soon as admin processing is complete. If you have not heard from us within 90 days, you can send us an email at... to request an update”. At first, I thought this meant he was denied but after further
Research it seems this is common and most get their visas after. Anyone know of this or experienced this before? Other than that, great interview overall!Based on what I gathered, this happens often... so, after 90 days, you contact them to see where they are. You can also check on the CEAC website to determine if you are still in AP. You enter your visa details and it will update you on the status.
If you hear of anything else, in terms of a solution, let me know! Hopefully, the AP will be quick and easy! Did they say why you were placed in AP?? Good luck to you!

THank you! It was like 7 days. But you should look at timelines for all spouse visas for Nigeria to see and compare. There’s also a page that completely explains everything step by step. I highly recommend you search for that! VJ has so many amazing resources. I literally never had to go anywhere else to be in the know and understand the process. Read everything very thoroughly! Ok thanks! I called them and they said that it will probably be sent next week. Im not really worried it’s just that I’ve seen others post that it gets sent on the same day the interview is scheduled so that’s why I was asking... regardless, it will be on its way soon! Yay!

Edit: The papers won't leave NVC until you are scheduled for an interview.
My interview is already scheduled and was scheduled like 2 weeks ago so why would it still be saying “at NVC”? I’m just going to call them, as usual.

Hello everyone... i have a question... my husband's interview is scheduled 7/19/18 but I have no idea when our application left the NVC nor when the Consulate received it. How would I know those dates? I see that they are included in our timeline submissions, but I don't know how to find out that information. Aside from the medical and gathering all documents for the interview, are there any other steps before the interview that I need to know about? Thanks in advance everyone!

My POE was Newark, I wasn't asked a single question , the Immigration officer took my packet, stamped my passport and welcomed me to the United States. Within 1hr I was done, the only sad part was they took my suya (😭😭😭 , my Nigerian folks would understand) the journey has been a tedious one and I'm so glad to be with my dear hubby. I wish every one success , and my prayers are with you guys. Just hang in there, it would soon be over .
