    Don't worry too much about the processing time posted by USCIS. You can assume VSC starts working on your petition if you submitted yours one year ago. The VAWA I-360, for most cases, takes 12-14 months currently to get a final decision. More important, the actual processing time is case by case.  For example, the following cases submitted at the end of Jun 2016 or beginning of July 2016 are still undecided( to name just a few):

    The number of pending cases are ALL pending cases (running total) that VSC has on hand at the end of each quarter, not just what they received on the same quarter.

    And YES, your visa classification is B21, Family second preferences even after divorce. Look at I-360 approval notice to find these information. Forget about prima facie, which is used for welfare, not for GC.

    Your priority date is the date your I-360 was received. The priority date is printed on the I-360 receipt, as well as on the I-360 approval notice. I did not mention prima facie.
    Yes, you can file I-485, I-765, I-131 when F2A date is 10/2016 or late.
    You can file I-765 under C31 with I-360 approval notice now.

    Check Visa Bulletin against your priority date on your I-360. You can file I-485 and I-765, I-131 once your priority data is current (meaning there is a visa number for you). If your priority date is not current, file I-765 based on approved I-360, under C31 to get an EAD. Then, use the EAD to apply for SSN and then driver's license.

    There is something wrong with your case, you or your attorney should contact VSC. The friend I helped got her EAD produced on 12/5/2017, and mailed today (12/8/2017). It takes three days from card produced to mailed:

    Of course, AOS is your purpose to file VAWA I-360. However, you may need to find out if you need to file I-601 or I-601A before filing I-485.
    I saw some case on J1 visa, USCIS allow them to file J1 waiver before AOS on approved VAWA, although J1 is not C1D.

    If you also filed I-485 and I-765, you will receive biometrics appointment in 1-3 months. For just VAWA I-360, biometrics won't be required.

    The fact that you got this RFE clearly indicates that evidence and affidavits that your attorney submitted did not satisfy VSC. You do not need to convince people in this forum, neither your attorney. You need to work closely with your attorney to submit as much as possible evidence and affidavits, including whatever you submitted to support the true faith marriage previously, since VSC will only work on your responses to the RFE. If you do not have primary evidence, you have to explain why, in details to convince VSC.

    You can transfer the priority date established for the I-130 to the I-360 self-petition application. It is important to understand that this results in a shorter waiting time if you are waiting for a visa number.

    There are a few VAWA I-360 cases that can be approved on the initial review/adjudication. If your VAWA I-360 was approved in 4.5 months, you should be  one of the lucky slef-petitioners.

    I already answered your question:
    If your abusive spouse or ex-spouse is an US citizen, you can file I-485 + EAD (C9) anytime with your I-360 receipt. However, if your I-360 is denied and your I-485 will be denied, which may put you in removal proceeding.

    Since you have a conditional GC, you do not need to file VAWA I-360. Instead, you may be able to file I-751 with a waiver based on abuse or battering  for permanent residency.

    Just want to post a message to thank Sandranj for her help in filing VAWA I-360. I filed VAWA I-360 for a lady at the end of Jun 2016, and PM Sandranj for many questions, which were promptly answered so that I filed her case correctly, even without a RFE. Now that her VAWA I-360 is approved,  I would like to post her timeline as well as a thank you message for Sandranj.
     
    Timeline:
    6/27/2016: VAWA I-360 filed
    7/7/2016: I-360 receipt received
    7/11/2016: Prima Facie received
    1/5/2017: I-485 and I-765 filed
    2/17-2/21/2017: I-485, I-765 receipt received
    3/22/2017: Biometrics appointment
    3/27/2017 EAD approved (received about 10 days later)
    May 2017: Contacted Senator for case assistance
    Jun 2017: VSC informed Senator that her background checking caused her case out of normal processing time
    Aug 2017: VSC informd Senator that her background checking complete and sent to final adjuducation
    9/18/2017: Case (VAWA I-360) is approved!

    If the Judge granted the divorce after you filed I-360, your VAWA I-360 petition should be ok. If the Judge granted the divorce before your VAWA I-360 was properly filed, then you should submit additional affidavits to explain that the divorce was connected to the abuse. You can file I-360 within two years of divorce.
