  1. What determines whether it's illegal is the intent of the alien at the time they entered the United States. If an alien enters with a non-immigrant entry pass or visa that specifically disallows "immigrant intent" (as most of them do), yet has the intention to remain in the US and become a permanent resident before leaving again, then they have a "preconceived intent" to immigrate at the time they enter the US - that's illegal. It's also a very murky aspect of immigration law because intent boils down to what was happening in their head at the time they entered the US. Immigration officers can't read minds, so instead they look for evidence of preconceived intent.

    If a CBP officer sees what he or she believes is reasonably good evidence of preconceived intent then they will have many options available to them. They could just deny the alien entry as a matter of discretion. They could take them into secondary inspection and question them (extensively) about their intentions. If they determine the alien lied about something during the interrogation then they could summarily eject them from the US using a process called "expedited removal", which is essentially immediate deportation. If they don't go as far as believing the alien lied, but they don't necessarily believe their story, they can still deny them entry as a matter of discretion. In some cases, CBP has been known to carefully document the evidence of intent that they have found, and require the alien to sign a statement declaring they don't intent to immigrate as precondition to allowing them to enter. If the alien subsequently applies for adjustment of status then USCIS has them for material misrepresentation - evidence of their preconceived intent, proof of that intent by their AOS application, and their sworn statement to the contrary constituting a lie to an immigration officer. They'll be deported from the US with a potential lifetime ban.

    My mom she got her 10 years Visa when I was A conditional Green card holder in 2008 .

    and now she have a medical issue and she need treatment here , and the medical in my born country not good at all ,

    I hope anybody tell me more detail about what document do I need to file.

  2. Hi, everybody, I am pretty new on this forum. I have a situation and I hope somebody could help me with the best possible advice. I had my N400 interview scheduled for June 4th at 1pm. When I went to CIS local office (Orlando), IO asked me what I was doing there since my interview was descheduled. I was shocked when he told me that because I never received any notice. He kept asking what my address is , and I provided it to him as well as other letters received by BCIS during my N400 application (fingeprints notice, interview letter,...)He could not understand how come I never received a descheduling notice letter. He kept saying one of those letter was mailed on May 24th. He apologized and he said he is unable to perform interview because he did not have my file. I left pretty sad :( and confused. I called 1-800 twice. First time a waste, second time a nice IO officer told me she would do a case status request and asked me my email and some other basic info. I did also scheduled an infopass for the following week. I received a quite generic email saying "performing additional review on your case". I went to infopass appointment, nice IO said my file is not here , and he would do a status request as well. Two weeks ago I received a letter on the mail from the National Benefit Center with same wording as email previously received. (performing additional review..)At this point, I am lost and worried :( because I do not know what is going on and BCIS does not come with a detailed answer. Has anybody gone through the same? What could be the reason? Am I on the long wait list now??

    If it helps, I applied based on 5 year LPR.

    Me just two weeks before my original interview I received a descheduled letter , and just a week later I received a reschedule letter for anther month but I decided to go for original interview but when i get there they told me my file not there yet , so i had to come back in reschedule interview date,

    most cases is the files dosn't made it to local office in time , but worst thing if the file is lost .

    Yes this morning I passed the final hurdle to becoming an American at my USCIS interview. It all went very smoothly, I wasn't nervous and felt fully prepared - until she slid the first question across the desk to me!



    'When is Columbus Day?'



    To which my immediate internal thought was "oh ######, that isn't one of the questions, #######?!" and mild panic immediately set in. She asked me to read it aloud, which I did, then she handed me a blank sheet and told me to write out "Columbus Day is in October", which I did. Then she told me I had passed the reading and writing test, at which point I laughed and said "thank goodness, because that question wasn't on the list and I didn't know the answer", which made her laugh too!



    She then asked me the following questions:

    • What does the Cabinet do?


    • When do we celebrate Independence day?


    • What was Benjamin Franklin famous for?


    • What was the war between the north and the south called?


    • Name a branch or part of the government?


    • What does the Constitution do?

    And I'm pleased to say I instantly knew each answer and passed, I was just pleased to avoid all the questions to do with 'rights', which are confusing.



    I then spent another 20 minutes answering questions I had answered on my application, to make sure I gave the same answer I guess. Then we went right through the list of general questions: Are you a terroroist, have you ever been in jail, are you a drinker, do you owe any taxes and many more, all of which she met my eye as I answered each one. I was amused however, when she asked me if I'd ever been a prostitute and it was the only one she didn't glance up to eyeball me!



    And that was it, she got out her big APPROVED stamp and punched my file. I commented on how huge my file was, and she laughed and said yes they keep everything from day one, I said I had a similar sized one at home too! She confirmed the Oath Ceremony will be in the next 2 months, that it's a big deal, I should dress up and bring family and friends with camera's!



    Then as she walked me out she asked if I would like to make a speech at the Oath Ceremony! She explained they choose one person to represent each group taking the Oath and I would have to speak on what this means to me for 5-10 minutes, after the Judge introduces and speaks a little. I said I would be happy too and she said they will let me know if I am selected.

    And that was that, approval to be American achieved! kicking.gif

    Me I live in Tulsa and they said the oath will be in Couple months too and I'm waiting.

    I'm just wondering when the oath will be exactly in Tulsa.

    Then he asked me to read a sentence about Columbus day and asked me 6 questions. I got them right and then he told me congratulations and gave me a form checked congratulations- passed the test and recommended for approval.???

    I want to ask you who interviewed at you? is it the Embassy consul who provided the 6 questions? and what are those questioned ? did you remember that? can you tell me what are question they provided you to answers? is it on K1 interview portion. Pls write the words of questions and provided the answers you did to them..

  5. Congrats! Did they say anything about the wait time for the oath? - or if same day oath would have been a possibility at OKC office?

    there is no same day oath in Oklahoma City . But they have oath cermony every month in Oklahoma city . but if you live in anther place in state of Oklahoma , that will be depends on that palce where you live . Me i live in anther county so they do oath cermony every couple months.

  8. No, I would not go to the descheduled appointment. I suspect it is highly unlikely you would be interviewed that day and if they de-scheduled the appointment, also unlikely that they would have your file at hand. There was obviously a reason for it to be descheduled and they have already sent you a rescheduled appointment. Attend the new appointment date instead. The reasons for the deschedule include all sorts of reasons which would probably make it very unlikely you would be interviewed if you did show up: your biometrics may not be finished yet, the interviewer will be out of the office on training, other work related business or holidays/time off, the office is working on different types of applications instead of N400s that month, the office is closed for maintenance, computer updates, etc., things like that - all reasons which would preclude you from being interviewed even if you showed up. Now that you have the rescheduled date, relax, study and the day will come sooner than you realize. Good luck!

    I was originally scheduled for my interview next week. Last week, I received a letter descheduling my interview. I have now received a letter with a new interview date for next month. My question is: should i show up on the original date my interview was scheduled and hope they will go ahead and interview me, or just wait until next month? Is there a chance they will interview me in original date?

  10. I think for a citizenship application I would wait until you got another interview date rather than attending this one in the supposition it really wasn't cancelled. There is no harm that comes to you for 'failing to show up' for a citizenship interview the way there is when you have an AOS or Removal of Conditions interview. You are still a permanent resident and your status doesn't change. If the interview deschedule letter is in error, you will receive another letter asking why you didn't show up and you would obviously send them a copy of the de-schedule letter. Yo would have no problems. At this level of the Immigration process, however, I suspect that the interview actually was descheduled and you will receive another appointment very soon.

    yesterday me and my wife had an appointment to remove my conditional residence...when the interviwer called for my wife(she is the us citizen) ...the 1st thing he said to her" ur marrige is fake ...u may face 5 yrs in prison" ...she asked why? and she siad no its not i love my husband and he loves me ...then he kept asking her things ...she doesnt remmber my mother s name and happened with me too coz i couldnt remember hers mother name ...and that the only...at the end we both couldnt remember some details about us and our families but they wree like 4 things we could nt answer ....yet we provided all the documents they asked for ...tax return+rent+letters from firends and relatives+our bank account ...for me the alien the interviwer said nothing to me like ur marriage is fake or something like that ...he said ok" we ll study this and make decision in few weeks " want to mention that my wife already was married to a person from brazil yet he was residing in us ...she divoced him coz he was abusing her phisically and mentally ...she called the immigration and cancled everything coz my wife and her ex wew in the process to file for him to be legal in usa...me and her really making nice home and love each other ....please any can help me here ; what may happen to me and her ?????? for me, the interviwer was a kind of rude with her .why??? please i need answers

So Mohammed has been here over a year now..all is well he has a good job in the hospital here and we've settled into a good routine...the only not so good thing is how much he misses his family. He talks to them online of course, but the reality of American life, 2 busy teenagers, the 2 of us working opposite shifts just life in general makes his time with them short. We have discussed the possibility of his mom coming to visit..she doesnt work there but she owns their home and there is a new grandbaby there who she watches while his younger brother and wife work. She would need his sister who is 33 and not married to accompany her. Anyone have any luck with this type of thing? It would be an awesome Christmas gift for him this year....

    Your mom can apply for B-2 tourist visa and you can send her an invitation letter, affidavit of support, letter from your work, copy of green card, and a copy of your wife's passport to take to the interview. Also if she has a bank account in Morocco she should bring the last three statements and proof that she owns a house there. I sent that to my mom and she got a 10 year visa. If your mom applies for herself only there is a good chance she will get a visa. if she applies with your sister there is a good chance she will be denied. I suggest that your mom applies for her visa first and then wait a month and then have your sister apply. Your sister may be denied but she can try her luck and spend $100tongue.gif .

    Just wanted to share my experience this past Wednesday. My interview was scheduled at 8:45, called in at 8:30. The officer couldn't have been nicer; we were chitchatting about grad school and my career options. I was out by 8:45 and waited another hour to get an oath letter for the 12th. He only asked to verify my identity and taxes for 2007 and 2008. My application was based on 3-year thing and he didn't ask for anything else to that effect.
