  1. Just in case anyone has use of my updates: after a rejection due to above explained mistake on USCIS end, we wrote to our senator (####### Durban in IL) and they were very helpful! His office send out a note/inquiry and we received a notification that the case was reopened for review - on May 9, which was 2 days before last deadline for us to submit a motion to reconsider. That was very good news, and we also didn't have to pay the fee!

As we didn't get any news on new interview date for few months, we asked senators office if they can inquire. Reply they got was not too helpful - we are in the queue. But then about 2 weeks later we got a notice of new interview date, to happen in 2 weeks from the notice date! It was also written on a "regular" paper and not like notices they usually send out. I believe it did make a difference that senators office made the inquiry!

Interview done, went well, more felt like a conversation, got notification next day that GC is approved and now waiting for the actual card to arrive. One chapter can be closed! in two years we go again..

  2. Unfortunately, as i suspected this might happen, it did - my application was denied! Reason for I-130 is that we failed to show up for the interview, and I-485 due to I-130 being denied as there is no valid grounds to adjust the status. This was clearly their mistake, as we requested the interview to be rescheduled, which they received, and on the phone they confirmed i need to wait for new interview date. Instead, they sent a denial. I called and got a service and an Infopass requests put in. Will have to wait now to see what the outcome of those will be.

I can submit a motion to reconsider or reopen, but I just feel it is stupid that i need pay 675$ for their mistake! Does anyone know here if involving a congressman would help here? Or my only chance is to pay?

    Thank you!

  3. EAD and AP card received!

Also received the interview date - March 18th. They sent it to my old address, even though I changed it back in August and the address change is clearly in their system! But my problem now is that i can't attend on March 18th as i will be traveling. I called them and put in a rescheduling request, but the officer said it takes 15-30 days to reply to a request, which is at my interview date! And from what i am reading, they can actually reject my request to reschedule! I hope that won't be the case...

  4. After i submitted a case inquiry (i was over the processing time for EAD) i finally got a reply (on the very last day) - status changed to "Card/ Document Production "

This changed only for EAD case #, so i wonder if i should submit a separate inquiry for the Travel Document? I thought that they are issuing only one document that is both EAD and Travel. Does anyone know how that works?

Beside that, my AOS case is still in the "Ready to be schedule for interview", since August 2018! I am in Chicago, not sure if this is normal to have it so long in this stage..

EAD and the GC are two different things and processed at two different offices.

I filed the AOS package on the 1st of August.

You should have called them 1 week after faxing/mailing the evidence out.

Thanks hoangthaihuyI called them and they did receive my RFE but didn't update it in the system. The agent also said to contact them only if there is no change after 60 days of the received date. So i guess nothing left to do but wait..

  6. My GC status is in the "ready to schedule interview" since August, so two months now and no interview date. At the same time i got Request for Initial Evidence for EAD and AP! Seems like they didn't like the fact i used and old version of the i-765 form, even thought it says clearly on the website: Starting 09/17/2018, we will only accept the 05/31/18 edition. Until then, the 07/17/17 edition can be used. My package was sent in June! I am really confused here why this is and then why also AP got RFIE, as that form didn't change!

Btw. does anyone know if i need to also send another set of photos as well, since i need to resubmit the whole thing?

    Thanks!

  7. Here is an update on biometrics in Chicago - very fast and painless! It took me an hour to get there (public transit, not the nicest area of the city) and i was done in 5 minutes, including wait time and the fingerprinting! Really fast!

But - we got a Request For Initial evidence for the I-864. It said we either: didn't sign it, didn't include proper documents or was out or date. Now i am really not sure which one of these is the reason, but re-sending it today. Hope we don't mess it up.

Hvala ti puno! :)
