  1. Anyone else note that there are no MSC (NBC) RFE NOA1's here? I returned my IMBRA RFE 7/5 priority mail and have not heard a peep from MSC.

  2. First of all you are talking apples and oranges here. Alimony is NOT child support. Alimony is payment to a spouse because the courts have determined the other spouse is at fault for ending the marriage, the other spouse makes substantially more money than the spouse to whom alimony is paid, etc etc.

    Child support is governed by the yearly income the NON-custodial parent earns and is usually awarded by the courts according to a table in every state. Child support is also determined by many other factors including other children the non-custodial parent may have.

    BOTTOM LINE GET A LAWYER!!!!

  3. OK thanks, I have already completed the DS-230, I-864 and DS-156 and sent them to her in PDF format. I was thinking the processing time

    I have been focusing on my CR-1, have all the forms completed and signed. Now it looks like the CR-1 will be held up and my K-3 actually complete before the CR-1. I know what steps will occur with the CR-1 after USCIS sends it to NVC. Are these basically the same for the K-3 except for completing the DS-156 for the K-3 instead of DS-230 for the CR-1? I have looked for a timeline comparing the two processes, can someone point me to it.

    After your I-129F is approved, your case will be forwarded to NVC where it won't stay long. NVC will give it a case number and forward it to the embassy/consulate in Taiwan. The beneficiary will then get packet 3 which includes a bunch of info and forms (DS-230 and DS-156 included). The beneficiary has to submit the DS-230 (Part 1, if I remember correctly) and send in the checklist. Then you wait for an interview date. I've been doing both the K-3 and CR-1. Have a look at my signature.

  5. Does anyone know what the "A" number is on the front of the RFE? Will that be our NVC number?

    I was so nervous about this RFE, I called the "misinformation" line this morning and waited on hold for darn near an hour, for them to tell me to write "NONE" beside ques. #2 and N/A beside ques. #3.

    I really can't understand why the RFE was so poorly put together (deficient). For a place that doesn't like you to leave things "blank"......I wonder what the heck they were thinking when they didn't provide a proper alternative to leaving the ques. blank :huh:

    Anybody notice that the signature box was kinda small??

    Sometimes I wonder about that place........:wacko:

    Well anyways its over and done....on its way back to the NBC....hopefully things will get moving now.

  6. Sure it is a federal holiday but all service centers are run by contractors and its my guess they are getting a whole S*&tload of overtime because of IMBRA.

    My fiance sent out the form (RFE) yesterday and today we were touched. :)

    Our status is the same but the last update's date is: 07/04/2006.

    how can you be touched on a federal holiday?

  7. Where did you enter "NO"? The instructions say to check all that apply if you have ever been convicted of those crimes against nature. I assumed if you had never done any of them and signed your name you were attesting to that fact.

    The form also says I am legally able and intend to marry my fiance upon her arrival in the US - guess what - we're already married!!!! SO I guess that means all of us K-3 filers are committing purgery!!!!

    sent my RFE back monday afternoon. have to admit though, i did like some others described and added a "hell no" (actually, just the "no" part) under Item #2 just to be perfectly clear.

    does anyone else find that their instructions leave a bit of room for, uh, interpretation?

  8. You can add me to this, I submitted mine about the same time but I never did receive an e-mail that my I-129F was sent to CSC.

    Received my RFE for the IMBRA for the K3 today. At least we know that they are doing something. All we can do it get them returned and wait some more. Hopefully it's a short wait.

    And I had heard from so many that the K3's were not affected - NOOOOOOOTTTT!!!!!!

    On the Nonimmigrant Fiance Visa Application Form DS-156K there is a question about marital status that reads: "How and when was marriage terminated?" Okay I get the "when" part but "how"? If there is anyone else there who was previously married and filled out this form, can you let me know what you wrote? Domo arigato!

  10. Good idea, I have a digital sender that transforms everything into PDF's. What documents did you scan... The DS-230? If the person has Adobe Acrobat on the other end they can even fill them in, Adobe reader will not allow this though.

  11. One part of IMBRA says USCIS has to verify that any one USC petitioner can only sponsor one immigrant at a time. That suggests to me that USCIS has to enter these applications into a computer system BEFORE processing and then run some type of query to make sure there are not multiple applications underway. touch 1...USCIS gets application, touch 2...USCIS enters into computer system, touch 3...USCIS runs query, etc etc. Given the immigration frauds that have occured in the past I believe USCIS processed the applications and then turned them over to to a data processing contract which entered them into the database. Just my opinion....

    The lack of touches for me means that they've stopped working on my petition and are waiting for me to return the RFE. Booooo
  12. I was told once you are in the NVC processing stage you can appeal to the embassy where the visa will be issued to start the medical processing on their end. I have suggested to my wife that she start this with e-mail to the embassy tomorrow. I will let you know what we find out. This was suggested by someone who did the same thing successfully on a China visa. Basically NVC is DOS and the embassy is DOS.

    Has anyone ever had their application expedited for medical reasons or know of someone who has? If so, can you give me a summary of the medical condition, how the expedite request was made, whether it was approved, and, if so, how quickly the visa was issued?
  13. Well I hope for your sake this guy knew what he was talking about. He is saying your husband can call the embassy in Germany and ask them to expedite processing of a case that is still at NVC because your husband is in the military? Hmmm.....

    Well the VWP is an option whereas a B-2 visa is not an option. But if the CO does any checking at POE he or she will see you in the computer via your passport number anyhow.

    true...visitor visa would be stupid *lol*. What if I travel on the VWP? I used it back in February to may to visit my hubby. I have one strong tie to Germany and that is the Approval notice of the I-130.

    I just called Customer's and Border Protection in the US and was told the following(btw he was a really friendly man):

    - do NOT come over until you have the stamp in your passport and received the package from the embassy they gonna give you a whole bunch of problems at the POE

    - let your husband call the US embassy in Germany to tell them to speed up the progress (hm i dont know why but ok....he says because he is in the military that would be an option)

    - since we have already filed in February he said that the embassy can do something about it.

    So ok....I will let him call the embassy.

    We were told we could not DCF in Taiwan unless we got married there. Why would SA be any different, it is still the Department of State that runs the embassy where you apply.

    Since work was slow I copied and pasted this page from the US embassy in SA.

    The Petitioner and Beneficiary must both be present and submit their passports for identification purposes. One copy of each of the required supporting documents must accompany the petition. Forms are also available at the consulates.

    Completed Form G-325A (Biographic Information) from both the beneficiary and the petitioner

    Valid U.S. passport for the petitioner and a valid passport for the beneficiary.

    The original full, unabridged Marriage Certificate. If you were married in South Africa you must apply for this specifically. We can provide an application form that should be submitted to your nearest S.A. Dept of Home Affairs office. Final decree(s) of divorce or death certificate showing termination of ALL previous marriages.

    It does not matter in south africa where you are married, the important part is whether or not you are a resident to them (resident meaning living or working or studying for a extended length of time).

    You can marry wherever you want for South African DCF just the residency thing is the issue, you do not have to be a permanent resident though.

  16. From the look of your timeline every bit of personal information on you has already been entered into the USCIS and DOS computer databanks including your passport number. If you do not already have a visa I think you are asked if you have ever applied for a visa of any type when you do apply. What will you tell them then? You have applied for an immigrant and non-immigrant visa via the I-130 and I-129f and they know it!!! It is my humble opinion you will be wasting your application fee.

    I bet this question had been asked so many times.....well however I dont find the answers i need...so sorry about asking again :P

    Ok since I dont have a flat and a job by the end of july anymore I was wondering if I could get a visitor visa to stay at our house in the US till the interview is scheduled in Frankfurt. I mean what am I supposed to do? The problem is that I dont have any ties to Germany anymore (well no flat no job) so #######??? I dont wanna take the risk entering on the VWP cos I would of course stay as long as possible (so 89 days. I mean what do they think? I am going through all the goddamn procedure and got approved and then I wanna enter the US to stay there illegally??? Huh??? Doesnt sound realistic to me.

  17. I am confused by both posts here. We were told by the US Embassy in Taiwan my wife could NOT get her medical done before the package is delivered to her after the DS-230 and I-864 are completed. We asked because I was in Taiwan in February to get a medical for my extended Taiwan residency permit and we thought as long as we were at the hospital why not get both done.

    Are you saying you got the medical forms off the web and scheduled your medical exam and had them delivered to the embassy before they even got your package? If so under what case number would they be filed?

  18. As has been suggested on other posts it will be a lot easier for you to go to Canada on a regular basis than for your wife to come to the US. Once you do file the I-130 and it gets processed USCIS will have her passport number in thre system. It all depends on how cautious the customs officer is when she crosses and what questions are asked and how they are answered.

    After receiving the NOA-1 and a case number, my lawyer never did file a I-129f for 1 month. I asked him to return all my papers; I don't need his services no more. Another lawyer informed me since so much time has passed an I-129f might be a waste of money as the I-130 may be approved sooner. So I didn't file an I-129f.

    When I google for a I-824 everything says it's for a copy of the original approval.

    Since they sent the original to the lawyer, I’m thinking they want me to file an I-824 to get a copy of the original.

    And I’m confused as to why they think she’s here in the USA. I called the lawyer and asked him, he said THEY messed up. Nothing indicates she’s here.

    So do I file the I-824? The I-130 was approved in 3 months. Something fishy here,

  20. Same thing happened to me. And my wife is in Taiwan and there was nothing on the I-130 application indicating otherwise. It was simply an error in processing on CSC's part. CSC does have an e-mail address and a fax form you can complete if you think they made a mistake in processing your form. I sent both the fax and e-mail and received a reply within 30 minutes. You can also fill out the I-824 and pay the additional $200 to get the application sent to NVC.
