Hi all! Can someone please clarify this for me....

I saw this link on the "how to get an SSN guide" https://s044a90.ssa.gov/apps10/poms.nsf/36f...b4?OpenDocument and paying attention to section C, it says:

1. Aliens Work Authorized Without Specific INS Authorization

The following lists nonimmigrants, by alien classification, who are authorized to work in the U.S. without specific authorization from INS. The alien’s I-94 will not have the INS employment authorization stamp and the alien will not have an EAD.

and K-1 is in that list.

Questions:

1. Can a K-1 holder work without applying for the EAD?

The way I understood it is that the alien can work eventhough the I-94 does not have the employment stamp and the alien will not have an EAD.

2. If the alien marries the petitioner, pending the AOS, he/she is still under K-1 visa? If so, can he/she still work under the condition quoted above?

Mari and I have come up with a plan for handling the interview and travel back from Manila to the USA and I would appreciate any information on whether it is a reasonable one.

We are quite confident that we will be approved at the interview. I know nothing is 100% certain but we have a very simple case and Mari and I are very careful and thorough in preparing the required information.

Our plan is that I will meet her in Davao a few dasy before the interview, help her finish packing for the big move, fly to Manila together with all her stuff and check in at a hotel, go to the interview together, remain in Manila, a few days later go to the embassy to pick up the Visa, and then fly to the USA together. So we would book our flight to the USA for five to seven days after the interview date.

Are you aware of anyone who has done this or planning to do this? Is this plan just too risky?

Although you can ask to have your visa picked up, there is no assurance that the consul will agree to it. You might want to schedule your flight at a much later date if you don't want the hassle of rescheduling (and the fee that goes with it) . 5 to 7 days for visa delivery is being a little too optimistic.

It won't matter if she (the beneficiary) doesn't work. I was unemployed when I went to my interview.

I read from some posts here that there are embassies which don't allow the petitioner to be there together with the beneficiary during the interview...Now, if I got it right your fiance is with you during the interview...So, does it mean that the fiancee/fiances petitioners are allowed to be present with the benificiary fiancee/fiance at USE during interview??? Does it apply to all cases or to some cases only???

Hi! Glad you find them helpful. And you read it right, my fiance was with me during my interview.

I also read that there are some embassies that don't allow the petitioner to be present during the interview. But in the case of the USE in Manila, the petitioner can be with the beneficiary all through out the interview process (from the pre-screener to the consul). And as far as I know, it applies to all cases, not just K-1.

Those of you who had interviews and approvals of your K-3 or K-1 visas from the Manila Embassy, how many days after your interview did it take you to receive you visa from DELIBROS?

Also, where was you delivery address (Town or Provence?)

Please excuse me if I am posting my questions in the wrong area/format. Im curious about picking up the visa at the USE Manila after approval. i see that a few posts show picking it up 2 days after approval but the embassy info seems to suggest that it takes a week. Can anyone shed some light on this ? i sure would like to bring my fiance home after we attend the interview. I also have a crazy question. Why cant you get married at the embassy ? It is U.S. territory.

we also have the same query with Dave and Flory, regarding the visa..you picked up your visa at the USE, right? how did you do it? you didn't go through delbros?You got approved October 4 and picked it up Oct. 6. And that was fast, you picked it up after 2 days.

Yup, we picked it up at the USE. We, or mostly my fiance, asked the consul if he can do him a favor and just let us pick up the visa. My faince asked for the next day pick up but the consul was shaked his head and said it might not be possible because their system was acting up so I piped in and maybe it will be possible on Friday, two days after instead of just one. He gave in. And he gave us the pick up stub (it was violet).

After the interview with the Consul, we went out and sat again and waited for our number to be flashed (for the releasing) only to find out later that there was no need to wait after all because we have the stub already. We sat there waiting for 30mins. If you read my interview experience, I didn't go through window 37-38 for the releasing and Delbros payment.

i'm trying to find hotel close to the Embassy and St Lukes. anyone have experience with Cherry Blossoms, Bayview, or Lotus Garden Hotel? or can you suggest another.

Luz and I stayed at the Lotus Garden on my first trip there. It's OK and within a 10 minute walk to the embassy. You might also check out the Best Western Hotel La Corona hotel that is close also. $60/night and I like it much better.

I read recommendations on Bayview since it's across from the Manila Embassy, and I have also read that Best Western is pretty cool as well. Cheers!!!

We stayed at Best Western and Bayview. Both are nice but we found it really odd that Bayview's Housekeeping doesn't have ironing services and they don't allow any flat iron in the room. They have outside service for it but you can't get your ironed clothes back until after 24hrs. That was really a bummer for us because we travelled, so naturally all our clothes were all wrinkled from being packed. We got there the afternoon before our interview day and we had no choice but to go the embassy wearing wrinkled clothes. Good thing (at least from wrinkled clothes' perspective) our interview was postponed.

I liked Best Western more and their suite room is really nice and spacious. And if you stay there for your interview, you get to go to your interview looking smart (no wrinkled clothes!)

To all folks who may be interested.... here is my long overdue interview experience. The process is not as confusing as that of the medical but it is a lot more nerve wracking.

I made a layout (again) of the embassy (i hope i don't get in trouble for this ) so that you'd at least have an idea as to what the room looks like before you get there.

This is based on MY interview experience. You may notice that my CENOMAR is not included in the documents that were asked from me but, more often than not, they will look for it. There may be other documents that will be asked from you so you better bring all the required documents and all the necessary supporting docs (for late registration of birth, etc.)!

A deem November the Approval Visa Pick-up Month cuz we're all trying to pick-up our visas. The heck with Delbros… It's madaya that we apparently do not have an option but to beg to pick it up the visa. We’re our own delivery service! Besides, who wants to wait around for it to be delivered? This entire process is a fine lesson for us Americans because I have never waited this long to get anything done. In the States, it's all about now now now and right dahamn now. LOL! In the Phil, it's all about when when when, and how much freakin longer. LOL!

Yup, we were able to pick up the visa. Towards the end of our interview, my fiance just asked the consul if he (the consul) can do him (my fiance) a favor and let us pick up the visa the next day instead of having Delbros deliver it. He reasoned that our interview got delayed because of the typhoon and that if we wait for Delbros, I might miss my flight. We both know that it is advised NOT to make travel plans yet until we get the visa but hey... it worked.

The consul was nice enough to agree and gave us a pick up stub. We went back to the embassy, showed the stub and got my visa. If you're planning to go on the interview, it won't hurt to ask if you can pick it up.

wow thanks for that info PW and sillygirl (for her post). i am planning to go to his interview. bahala na kung meron pang uncertainties si mister consular officer mag make out nalang kami in front of him... hahaha i hope it wont get to that point but desperate situations call for desperate measures. we were planning to ask nga the consul person if we can come back and pick up the visa nalang... atat eh noh??? i know it's bad to do travel arrangements before the visa is issued but im hoping and praying that everything will be okay so i went ahead an booked it. even planned to get married sa sabado ng thanksgiving since his family (cousin) overthere is inviting us to spend thanksgiving with them. grabe ang timing sobra, we fly back on the 21st of november, i go to work on the 22nd, then after work drive na to vegas. I was so busy & depressed lately that I haven't had the chance to wish everybody goodluck on their interviews and congratulate those who passed. And for the November folks, I know you guys gonna have a party, but don't count me in coz my fiance & I broke off the engagement two weeks ago. It's a long story & it's really "petty" but that's part of life that I just have to accept I guess.

hello everyone. it seems that there's no PLDT in my bukid so i bought a SMART sim. i dont think it's a smart idea though since i couldnt use it to call them??? am i missing something here? i thought buying a smart sim would solve the problem. everytime i call, all i'm hearing is tot tot tot... anyhow any suggestions? i did call the washington and it says our case is still pending. would have wanted more specific answer like whether if the embassy got our case or not etc ... thanks!!!

I'm guessing you got the prepaid one, right? It won't work. I tried that and even the postpaid line for Smart it still didn't work. I think only PLDT with IDD calls can be used to call the 1-900 number. They sure know how to make it difficult to contact them!

I want my fiance to get a copy of the medical exam and vaccination report. Will there be an issue requesting a copy from St. Lukes? Does anyone know or have experience with this...??? Thanks in advance. Cheers!

She will get a copy of the vaccination report and it is adviced that she photocopy it. As for the copy of her medical exam, I don't think that is possible unless you ask the USE.

I asked the releasing nurse if everything was OK with my medical exam and all she told me was they will send it to the USE and I will know on my interview if there are any problems.

Guess there was nothing wrong with my medical, good thing psychiatric exam wasn't required, or I might have been in big trouble. I was really going crazy then!

Thanks for this info ellmoi and uling... we did call (John called this morning)....and followed up our request for expedition and early appointment interview...we were told to get our packet at St. Lukes...fortunately, I am in Manila (I arrived Manila thursday evening) and I got the packet with our appointment schedule:

I know it's been a few days already but i jst want to say CONGRATULATIONS!

Thanks guys! I still can't believe it.

Panicked - there were no last minute surprises. I think the fact that my fiance was with me made a big difference. Some of the other girls really got grilled and they couldn't ask if they were approved or not. The consul asked eash of us only four questions.

John_and_Marlene - the pre-screener asked me about it but I just told her that I was in the Phils. already when we got the NOA2. She told me that I should have it and made a note in my form but the Consul didn't even bother to ask me about it.

Uling - i didn't get his name but all my fiance did was chat with him I think that worked!

I said I'd post my interview experience and what I've observed but I can't really sit down and do it right now. All our plans have changed. Instead of flying out bymyslef on the the 14th as originally planned, I will be leaving with my fiance on the 9th so there are really a lot of things to do.

Hopefully, I'll be writing my review (lol) when I get to the U.S.

That's another thing. We are going back to the USE this afternoon to pick up my visa!

My fiance asked the consul if it is possible to pick it up the following day (Thursday as i had my interview on Wednesday), but the consul said it's not possible because the system is acting up. So he said we can pick it up Friday, 2pm! When we got out, the guard saw the stub that I was holding and he remarked that we are the only ones who got expedited that day.

My fiance wasn't sure at all that it was possible but I told him it doesn't hurt to ask... so there! He told me that my stubborness pays off at times.

So for you guys, who would be going with their fiance for their interview, maybe you can also ask to pick it up instead of being delivered by Delbros.
