A job offer is not current income.  You can not use a job offer for the I-864.

Seems like you didn't have a qualified Joint Sponsor for your son's interview.

You need to find a qualified Joint Sponsor, your job offer is not good enough.

I had a qualified joint sponsor, her income was very high, my lawyer would say me if it was not right joint sponsor

And second joint sponsor was with very good income

  2. Hi friends,

    My PD April 04,2016

Interview date was April 17, 2018

Uzbekistan consulate did refuse to approve my son's Immigration visa

As a reason they said they do not believe to the join sponsor

I said fine, and submit another joint sponsor, after two weeks I have got this email below

"Thank you for your email. US Immigration law requires that the consular officer analyze the totality of the applicant’s circumstances, including, but not limited to: age; health; family status; education and skills; assets, resources and financial status; also, where appropriate, the affidavit of support. If, after conducting the interview and evaluating the totality of the applicant’s circumstances, including any applicable documentation, the consular officer is not convinced the applicant will not be a public charge in the United States, they are obligated to refuse the applicant under section INA 212(a)(4)(A). Our records indicate that Mr. ....... application is refused under INA 212(a)(4)(A) for public charge.

This refusal may possibly be overcome, if the applicants are able to provide sufficient evidence of their ability to be self-sufficient in the United States. Depending on circumstances, this evidence may include a job offer, proof of health insurance, an affidavit of support from a close relative, or other evidence as appropriate."

As you see they did not mention anything about my second joint sponsor, and asking me to submit totally different things as a job offer (my son is 17 and he is studies at school)

I presume the US Law did not denied having a joint sponsors in your case yet...

I said ok again, and provide them a job offer letter from a very prestige  Financial Company who agrees to provide to my son a medical benefits, payable sick days etc..

But again after two weeks consulate updated his case and again they put a status as REFUSED.

I am sure that Trumps policy about chain migration is the main reason of this refusal

What should I do, I am totally broken, I raised my son alone and he has nobody without me in this life, my 75 years old sick parents can not take care of him anymore

    Please friends advise me,

P.S. I had a lawyer and he could do anything

You can find another joint sponsor, or try to work a part time job to get the income you need. The visa will be available once you meet the required income. It is not rejected forever, it is only on hold temporarily.

The interview date was on April 17, the last day of tax so in a hurry i just filed my tax without waiting the another 1099 form from my second job, than I made  a tax  amendment and my my income is increased now

Now with new gross income I even do not need a joint sponsor, but my lawyer said that he does not recommend me to show my amended tax because consulate can hesitate and think that I was made this  purposely after the visa was denied

and it can be like tax fraud for them

    PLEASE ADVISE WHAT TO DO?

well at least not 60 days. Should you have submitted also that confirmation page with your IV package? Does the check list says that? If so, then  I would print out the RFE letter or e-mail and the confirmation page of DS and send them the papers in a letter.

Oh thanks for telling that, I had no idea about sending the RFE with confirmation page

    Thanks again

  5. Hi Guys,

I submitted IV packages to NVC 2 months ago and got an email from NVC saying that DS-260 is not completed (my lawyer forgot to tell me that I should have to do it by myself)

Two days ago I submitted DS-260, so how long does it take to review DS-260 and complete the case?

Saylin's NVC wiki says, since you sumbit a missing doc to NVC , it takes another 60 days to review it, does it mean that my online submitted DS-260 will take 60 days to be reviewed?

    Thanks in advance

    Milly

  6. Hi Everyone,

The worst thing happened to me :(

2 months ago I hired a lawyer to complete my son's NVC part, I went through and got approved by USCIS by myself, so yesterday I have got a letter from NVC saying that DS-260 is missing, can you imagine my lawyer forgot to complete it,

I submit DS-260 yesterday and please guys can you tell me approximate waiting time for DS-260 to be reviewed ?

    Thanks a lot

    Milly

    P.S. Never trust a lawyer

Wow, we have the same PD!

    • If the petitioner signs the form I-864, but is unable to meet the financial requirements, another individual must also sign a separate form as a joint sponsor to meet the financial requirements.
    • Each sponsor needs to submit taxes and W2’s if he or she is not using an IRS printout, or provide a reason for not filing taxes.

    Thanks AnnaMBoros,

Is it necessary to submit a pay stubs?

My friend who is a co-sponsor she is a president of her own company so she do not have a pay stubs I mean W2 and checks, so can she provide her company's IRS transcripts?
