    I read differing reports on this. Some say that if it is true when you file, that once filed, you can separate/divorce and it will not affect the process, others say that at the time of the interview and/or oath you must still be living in 'marital union' (that is the phrase you need to research) or you will be denied and have to wait the extra two years.  I find more evidence pointing to the latter scenario if I am honest.

     

    Regardless of what you choose to do, do observe the golden rule : do not ever lie to USCIS. Ever.

     

     

     

    Thank you for your honest advise, I am not even thinking to lie, just I could not find the answer to my question about " Will divorce affect to obtaining Citizenship in 3 years?" I have got to many different answers from people thats the reason why I posted this Topic on this website

    So for short - no, he can not be a joint sponsor unless he has at least a green card.

    Click on that link - that is our "best friend" right now. You are looking at "F2A" category and you are interested in 2 columns:

    Column B tells you when you are eligible to start NVC processing (the 6 steps). Column A tells you when you are eligible to be scheduled for an interview. With PD April 4th (same like mine), we are pretty much concerned about the Column B now so we can start the filing process.

    First i called nvc, after a couple of weeks i received a letter with my case number and notifying that there's no visa available.

  5. You will need to wait most properly a couple of more months before you can submit your documents to the NVC.

    You can prepare most of them already, also try to get your police certificates in a month or two so that you have

    them valid when NVC stage appears. My gut feeling says maybe 3-4 months more wait. Others will know more.

    So you are saying that Ds-261 Choice of address will be available to fill after 3-4 months ?

    I was so happy when got the NVC case number I thought they started to process my case... I didnt know that there will be another waiting time even after getting IIN and case# from NVC

  6. For Immediate Relative cases (USC petitioner required), then it would not take long at the NVC after USCIS approves the I-130.

    For Family Based cases like yours where the petitioner is an LPR, visas are limited. Your son needs to wait for an available visa. The current wait when an LPR petitions for an unmarried child is about 2 years.

    How did you get your green card? US spouse?

    I have got my GC through the marriage with USC but we are separated now

    I have a very sad story... My husband has a drinking problem so our marriage failed, the other reason He didnt want to apply for my son (his step-son)

    So I had to file by myself as a LPR
