  1. Just to clarify because there seems to be a lot of confusion on who is the petitioner and who was the beneficiary of the K1 to the GC. 

     

    My name is Zoe and I am from the UK. My wife is the USC and we are in a same sex relationship which is probably why people are getting a little confused when I say Wife because the automatic thought in peoples heads in the partner to the wife is usually a man, the Husband. So just to throw a little spanner in the works we are Mrs and Mrs ;) 

     

    Me, Zoe, filed the AOS. I signed it. My wife is the USC and signed the I-864. I will write the letter to withdraw it my I-485, I just don't know where to put that it was filed because I thought everyone sent it to the same place (that Chicago lockbox or wherever it was) Its, been 16 months since I filed and I have been through a lot since filing anything including the K1 so I can't remember. 

    When I contacted them to tell them they hadn't sent me a receipt for the I-485 they told me they didn't keep those records longer than 6 months and I would need to contact the office where I filed, which was where I thought I was asking.

    I get so confused because of the terminology they use, Is the place I filed the same place as where It should be being processed? 

     

    When it comes to sending them a copy of my I-797c for my I-485 application then they have no chance of getting that from me because they didn't send me one and no matter how hard I tried to get one, they wouldn't give me one. so its tough luck really.

     

    This process has been a pain in the a** start to now for me but I still want to withdraw my application in the correct way, even if they haven't done everything by the book for me and my wife.

    There is no petition in this question. The UK person applied for AOS. He no longer wants a greencard. He writes the letter to withdraw his application. The USC petitioner did not apply for a greencard so has nothing to withdraw.

     

    ZoeUK--I am sorry to hear it has come to this. From past posts,  I know your struggles here with the application  and health issues have been quite the ordeal. Best of luck on a better future. 

    Wuozopo, I would just like to thank you for your kind wishes. Its nice to see that you have been reading my posts and remembering what I have been through. I also hope you are well :) 

     

    Also, This was my thought, that it would be me that needs to withdraw and not my wife as I don't really remember it being anything about her on the form. Only me and my wife for the I-864. 

     

     

  3. Hey guys,

     

    I am very sorry that I have no idea where to put this post so I figured I would put it here and if it should be somewhere else then someone will advise and move it.

     

    I am wondering if anyone can advise on how I officially withdraw my GC application? 

    I see on a website that it says I have to give them the office where I filed. I have no idea where this is... Does it go to the same place where I originally sent it or to the place where it should be being processed? Phoenix for example

     

    Also it asks for a copy of my receipt notice which is impossible to give them because they didn't send one and when I tried to obtain on, I got passed pillar to post with no resolution. I received a letter back that simply stated they were arranging my interview and never actually answered my question. 

    Anyone know where i should be saying I filed and what to do if I cannot provide them with the forms they are requesting because they didn't send me in the first place.

    You applied for AOS, correct? Was your payment cashed? I saw another thread that said you had some confirmation of acceptance. Did you do biometrics in the us?

    Yes that's correct. I applied for the AOS back in July last year and I also went to the biometrics. Check was cashed and I recieved everything as I should for the EAD and AP but not my I485. 

    I'll have to keep trying with the form :)

    InfoPass appointments are only posted once a day Monday-Friday, typically between 12:00 am and 2:00 am. They are first come, first served. Depending on your local office, you'll have to try a few days in order to get an appointment. 

    It's a headache and it will take some waiting, but should be relatively easy to resolve. An InfoPass is the best option to get a clear update on your case and the best way forward. Plus, it's free.

    Oh I see what you mean, put in i485 instead however i have tried this on my laptop and my phone and it is not bringing up any options so I am guessing their site doesnt even work right now. 

    I went to an infopass appointment a while ago because they said what I had provided as proof of birth wasnt sufficient and at that point they told me they hadnt even receieved my case yet. 

    I will keep checking but in the mean time I am going to apply for ead with the evidence I have. If i am waiting for an appointment anyway i may as well try right?

    It wont let me request online and the i797c is not an option either. There are no info pass appointments available at my local office either  I have emailed people and done what they told me to do and nothing. :(

  7. Has anyone else failed to receive an NOA1 (i-797c) for their I-485? 

    I never got one, only got a RFE which I responded to. I can not view my case online as it now says invalid but it did show back in October last year. 

    I am panicking now I have to renew my EAD and AP as I cannot for the life of me get them to send me one. I cannot afford for pay the $1000 to obtain a new one and I feel so alone in the process. I cant afford a lawyer at this stage either. 

    What do I do? :'( :'( 

  8. Hey can anyone help me, I am so confused and very annoyed. I don't have the paper copy of the i797c to say that they receieved my i485. The only thing I can find that they sent me was the biometrics i797c which states the receipt numbers and that it's for the i485-i765.

    I need to reapply for my work and travel but I am told by them that I can't renew it for free without the i797c for i485. I contacted the number a few weeks ago, they put me to teir 2, they called me back and said I had to write an email to lockbox. I waited and waited until I finally receieved an email back that said they dont keep the records longer than 6 months and I need to contact the uscis call center. The ones who gave me the email in the first place. My EAD is going to run out before I can even apply at this rate. 

     

    What does everyone's first copy of the i797c look like for their i485?

     

    I can not view anything online because when I put my number in its says its invalid. 

     

    Grrrr sorry guys but I am really losing my patients. I'm upset that this is taking so long to correct things. When I called back they said they have emailed my states facility and I should hear something within 30 days. It's too long, they said I can book an info pass appointment but they dont have any available since you can only get one on like a Wednesday or something stupid. 

     

    Please help me.

  9. I just looked through all my paperwork and for the I-485 the only things I ever receieved were 

     

    1. I-797c - rejection notice. This was originally rejected due to not signing a page. I signed it and mailed it all back to them 

     

    2. RFE - saying my proof of birth wasnt sufficient. I responded to the RFE with my birth certificate (which had already been sent with my original application) and some other birth records. 

     

    I received my EAD promptly with I-797C for both work and travel but never receieved anything for my AOS I-485 application. 

    I receieved the email to say they had receieved all applications and I could view them online but nowadays the AOS application wont show anything. 

    So basically I have no proof of them actually processing my AOS and I need to renew my EAD

     

    When i mentioned this to them on the phone they were about as much use as a chocolate teapot. 

     

    What on earth do I do to renew my EAD if I dont have an I-797c to say I have an AOS in process?

    Yes I did receive the I-1797c and I took it with me to get my fingerprints taken last year, did you do that?  And when you try to view your case status online, what does it say? I was able to view my status before and today when I checked it shows " we are unable to provide information, please call..." and that's why I called, I was hoping to get some good news but well...

    I totally understand your frustration and I am not enjoying this whole visa adjustment whatever this and that process at all. But yeah lets still hope for the best.

    I can't remember if I took that notice with me but if the biometrics letter asked for it, I would definitely have taken it with me. I am sure i never received it though as the only things i remember receiving via mail for it was the rejection notice because my wife forgot to sign the check and the RFE

    When I try to view it online through my account cases it just shows some logo and displays nothing, no error message or anything about calling. When I called and typed my receipt number in through the automated service it said it could not retrieve my case at this time, please check that you have typed the correct receipt number. 

     

    I was able to check online for a long time and thats the reason I know they received mu RFE response because it went from saying something along the lines on they were waiting for more information to ready to schedule an interview. When I call them they seem to think that I a complaining that it is still on that status but I am aware my processing times are 14-22 months (stupid amount of time) but my real issue Is that they didn't send me an i-979c. 

     

    They got this wrong from the start and I feel like I am having to jump through hoops to correct their mistakes. Like when they didnt take my k1 packet on entry and filled out my i94 with the incorrect name, or when they said my birth cert wasn't sufficient even though it was the original I sent them. Hell even my biometrics was a flipping dilemma because they told me when I got there after waiting that I couldn't have my tiny lip piercing in which is not mentioned anywhere beforehand, it has been in every single picture for immigration and on the day, I could not for the life of me get it out. I had to speak to a supervisor and convince them to still do it and see what got said and if it was rejected.

     

    This probably wouldnt be so stressful had I not of gotten sick 2 months after arriving here and spending time in hospital with sepsis. 5 surgeries and I'm still not fixed. I dont work because of illness so I'm not actually bothered about having the permits but I want to keep my driving license.

    I just called USCIS today and they said the San Francisco office is still processing applications that were submitted in Jan 2017, which means I still have to wait for another 5 months. My combo card will be expired in September that means I'll have to renew it ( and I have no idea what the process is, have to work on that now).

    Did you receive the I-979c for your I-485? 

    You know the white paper that says they have received your petition and it is being processed. I received the RFE for more evidence but never received that first NOA. I called them and they said they cannot send another NOA to say they have my case pending and I cant view the status online, so I am concerned that when I try to renew the EAD they will ask for that letter but they never sent me one. Because I am unable to view it online I also am unable to send them a screenshot of my pending case and I know this is going to be a nightmare. 

    I always say if it wasn't for bad luck I wouldn't have any :(

     

    It's also interesting to know that other people's applications went from ready to schedule an interview to the card being mailed, so there is still a chance that they will skip my interview, which I still hope and pray that they do because it's just something else to stress about. 

     

    I feel this has been a nightmare from day one of arriving here in regards to immigration, I just want one thing to go smoothly.

     

  12. Hey guys, I was wondering if anyone has had the same circumstances as me.

     

    I applied for my AOS mid last year (2017) at the same time as my work and travel permit. This was an adjustment from the K1 fiance visa

     

    When I applied for all 3 I received a Letter saying they had received my petition (both travel and work permit) these were just on standard plain white paper. Then I received a RFE saying they had rejected my AOS application due to sending secondary evidence of proof of birth (this was wrong as I had sent them my original BC). I didnt receieve the plain white paper copy to say they had received my petition just my RFE. When I responded to the RFE it told me i had to send the original copy of the letter they had mailed to me, so I did. 

    I never received anything after that and the only reason I know they received my response to the RFE was because I checked it online and it eventually changed to ready to be scheduled for an interview. 

    I got my EAD card so that's great but I never received a letter to say they had received my AOS and were scheduling for an interview. 

    My filing place is in Pgoenix which is a 14 to 22 month waiting list so this means my EAD will expire before I receive my GC or even an interview. 

    I know I dont have to pay to reapply for the the EAD however I don't know what to do about the fact that they never sent me anything to say they had received mu response and it was accepted and being processed. 

     

    Anyone else had this issue?

     

    The only thing I have to say I applied for my AOS is the email that simply says they received mu case and this is the receipt number, and that I can check it online here. Please wait to receive your letter before checking it online. 

     

    I'm stressing about this immigration process so much because I feel they have just caused me loads of problems, one after the other. 

     

     

    Was also wondering what exactly should I be taking to an AOS interview? 

    I feel like I knew exactly before my K1 even came though but with everything that has happened since getting here, I have just lost track of it all. 

     

    I'm interested to know if you received the first NOA if you received and RFE because I cannot find one which is unusual since all my immigration stuff is in one place.

    I am hesitant to send my off just yet as I am at the stage of no man's land. I am waiting for an interview and my luck is that I would mail my passport and then find out I have an interview and the required passport would be elsewhere lol. 

     

    I managed to do all the immigration myself and yet I panic at the thought of doing my passport myself for the first time haha.

    I renewed mine shortly after moving here, it's really easy, fill out the online application, print it off, sign it, send it along with the required documents to the UK. From memory it took a couple of weeks to come back, was delivered in 2 packages by DHL - 1 with the new passport and 1 with my documents :)

    Thank you so much for your response. Were you waiting for a green card or interview when you mailed it off?

    Also did you have to take a new picture on the online application?
