Paulonto reacted to Jorge V in Conflict: 5 or 8 weeks from I-171 to Case number? (London(
You can't change the paperwork but you can simply file a new petition in London. You'll have to create a new application and pay the $535 fee again, but it's possible.
However, you mention that your spouse, the USC, lives in America. In order to qualify for DCF the USC spouse must reside in the relevant country (the UK in this case) as a legal resident for at least 6 months. Individual USCIS offices can impose slightly less strict rules, and I think the London office specifically is a bit lax on the 6 months thing, but at the very least your spouse would have to have legal residency in the UK (not a tourist visa) and be residing there at the moment you file the I130.
You also mentioned that since you applied from the US you'd have to wait for 5-7 months. That's just for the I130 approval, and it's really closer to 8 months. After the I130 is approved you still have to wait on the NVC to process your case and then schedule your interview. This adds 4-6 months for a combined total of 12-14 months from filing to visa in hand. DCF in London takes about 3-5 months from filing to visa in hand as the NVC is skipped altogether and the I130 is approved in 2 months or so.

Paulonto reacted to Jmatts in Conflict: 5 or 8 weeks from I-171 to Case number? (London(
As your petition approval was right ahead of mine, you should have your Case Number already or very very soon – I got the letter in the mail today, mailed 20 April after a petition approval date of 18 April (!!). Feels like an incredibly quick turnaround after an agonising wait for that I-130, so fingers' crossed it's all smooth sailing from here...

Paulonto reacted to Rahrah0526 in Question about items on criminal background check
I just wanted to put a follow-up comment here for any future VJ-ers in a similar boat. My fiance had an animal neglect charge that resulted in a fine only, and a common assault charge that had no fine/jail/etc. He had his interview this morning and was asked briefly about both charges but was approved!! Thanks to all for your help!

Paulonto reacted to Kirtanam in London Embassy asking for DS-160 Confirmation for CR-1 Visa?
Hey guys,
Thank you so much for you help and replying back to my question.
Just wanted to give an update.
My spouse went in for the interview and at the desk they asked for the DS-160, however my spouse told them that the visa is for CR1, so it should be a DS-260.
The clerk at the desk said, "oh, that's right. I'll need the DS-260."
So it looks like the embassy is either mass sending the DS-160 email out or accidentally sending them out.
However, we did not need to fill out the DS-160.
Thank you once again!

Paulonto reacted to Natalie&Joe in Notice of Approval . Confused with email from USCIS ....Department of Homeland Security
Hi. Hope someone can help me with this confusion.
We applied the application form I-130 for IR-1 on Tuesday through Consulate in Guangzhou China. On Wednesday my husband (petitioner) received email titled "Notice of Approval" .
The email said:
"Please find a copy of the Approval Notice for your Form I-130 attached. The password will be sent in a separate email.
Approved I-130 petitions are forwarded to the Department of State Immigrant Visa Unit in Guangzhou. The Department of State will contact your relative directly to schedule a visa interview."
In the attachments there is a zip file containing PDF with out last name. However, the file does not open and does not ask for any passwords.
My question is : What is this email? Is it NOA 1? or NOA 2?
I (depended) also have received an email saying "The U.S. Consulate General Guangzhou has received your application information and will begin the next phase of processing your visa" and tells steps what to do :submit form DS-260, photos, and copy of passport.
I am going to follow instructions and do all those things but I am still confused where in the process I am at now.
Any help will appreciated.
Thank you

Ha, you were right! My NOA2 arrived in post today, so looks like I'm about a day behind you. Petition filed 12 Feb, approved 18 Apr. (And I thought the dates on the letter were confusing too!)
Will be watching your updates closely! 😬

Paulonto reacted to HNE in I-130 London. Delay for extra docs
I don't think they'll let you know they have received the extra documents. You could always email them and just ask for confirmation that they received the documents.
As for actual waiting time, I assume it depends on what information that asked for, why they needed it, etc. I'm pretty sure the embassy will have been closed at some point over Easter and perhaps even a few employees will have gone on holiday since it was the long 2 week break for schools so I wouldn't be surprised if it takes a little longer due to all that as well.

Paulonto reacted to Jeanne Adil in i-130 ... 1 Quick Question (Pt2, 5a: Other names)
Important to list all names, all marriages, all divorces, all children
you sign the last page saying you have answered all questions honestly
a quick check they do of SS number will show this information (and they do check it as some try to illegally file a petition using fake SS number, etc)
so best to disclose all or have petition not accepted for nondisclosure of any information
the above sounds serious as immigration takes this very serious
best wishes and good luck from all here

Paulonto reacted to JoannaV in i-130 ... 2 Quick Questions (Photos/Birth Certificate)
Follow the London checklist. :-) No beneficiary birth certificate needed, you'll provide that later at the interview stage. The passport photo page is all you need right now.

Paulonto reacted to MrHanky in i-130 ... 2 Quick Questions (Photos/Birth Certificate)
This is out of date, I would not follow this unless you want delays.
I understand the poster is trying to be helpful, but G325A has been obsolete for a while now, that's the point of the I-130A

Paulonto reacted to Haltom Family in Exact instructions for dcf
Nola, is surely right though its included in the checklist the bona fide proof of relationship dated November 17, supporting documentation is needed to provide such as:
Marriage Certificate Provide a marriage certificate issued by a public authority to show that a public record exists of the marriage between you and your spouse. The certificate must indicate that after the marriage ceremony, it was registered or recorded by the county, state, or province where the marriage took place.
And in page 3: STAPLE ALL OF YOUR DOCUMENTS FIRMLY IN THE FOLLOWING ORDER.
All in all, proof of relationship is needed as one of the supporting document.
Sylv, we are excited for your processing. God bless. Thank you Nola

Paulonto reacted to Jorge V in Debt or No Debt for DCF
No problem for the wiki! One thing to keep in mind about the London guide is that it was written a long time ago and some sections are out of date. You should use it as a general guideline but always refer to the official USCIS instructions!

Paulonto reacted to Jorge V in Debt or No Debt for DCF
According to the official I-864 instructions (https://www.uscis.gov/sites/default/files/files/form/i-864instr.pdf), retirement income is grouped with standard income, "Enter your current, individual, earned or retirement, annual income that you are using to meet the requirements of this affidavit and indicate the total in the space provided." So I would say yes.
