    We decided to wait if and when the situation will improve a little, he cannot go anywhere because of the military and I don't feel okay spending 14 days out of Schengen, my option was Croatia as I am super close since I am from Italy but now it's a mess.

    Let's just hope some good news will come soon. 🤗

    See above info of proxy marriage from the Immigration and Nationality Act.

    Oh thank you! So with proxy I am allowed to travel from a Schengen country, we just need to "consummate" the marriage once together.

    Im a mil spouse myself and would recommend you to get married somewhere else which sadly isnt currently easy. I’ve heard (!! Don’t know if it’s true) that some foreign born spouses did proxy weddings with their mil spouse even not being mil to mil, maybe an option to look into in this current time.

    He's army too, but yeah I already know they will never approve it :(

    As I see it, the only real benefit for the the K1 is if you have not spent much time together and the 90 days allows you a chance to see if marriage is right for the two of you.  Or if it's the only reasonable way to obtain a visa for the US.

     

    But if you are from the EU or another VWP country, then it's better just to visit and live with your fiance for a length of time, before deciding on marriage.

     

    Also, if you are in the EU right now, there are ways to still travel to the US.  I believe you can spend 2 weeks in Serbia or Croatia, then you are allowed to travel (as long as you do not transit through an EU country).  That will allow you to go to the US, marry, then return to wait for the CR1 approval.  And you can still visit him by doing the same thing (via Serbia/Croatia).  But I realize this takes time away from work and may be costly (2 additional weeks of travel expenses).

     

    I was actually thinking about that too, spending 14 days away and then go see him, this can be an option I guess :)

    In italy same, they told me it takes about a month to get married and that's something impossible for him. What a terrible situation, months ago I thought it would get over by summer :(

    I agree with others that during these unpredictable times, a spouse visa appears much more secure. K1s are not considered mission critical and therefore not being processed at all in many embassies. Especially in countries with currently travel bans in place. The travel bans to the US only exempt spouses, not Fiancés.

     

    The lower priority will more likely than not increase overall processing times, eliminating the only significant benefit of K1 vs. spouse visa.

     

    With USCIS processing within the US becoming more and more of a headache (have you heard of form I-944 which must be filled out if you file adjustment of status from within the US?), furloughs hanging above the heads of 70% of USCIS staff, any timeline predictions for EAD, AP, Greencard are impossible. Sitting in the US without a drivers license, ineligible to work etc etc makes any adjustment/settling down a challenge by itself.

     

    In the end it’s up to you - if all those seem acceptable for you in favor to secure a spot in line rather sooner than later, the K1 might still be your best bet.

    Spouse visa has for sure a lot more benefits than K1. I think the military won't let him go to a third country which makes it harder :(

    I was in the US with him in March, then Europe started closing borders and I had to rush back home, at least we got to meet :)

    Only thing is that my fiancé is in the military so I cannot go to the US to get married because of the travel ban (and then apply for the spousal visa) and it's even harder for him to come to Europe. It's such a mess :(

    I am currently working in Poland but planning to go back to my home country ( Italy) in a few months. For the I-129, is it okay if I put my physical address the one in Poland, where I live at the moment, as mailing address the one in Italy where I will be and as embassy Naples?

    Is it a problem if I move country after filling or just wait until I am home?

    Do I need to have a permanent residence or even temporary is fine ? Since I am EU citizen...

    I need some help, I am Italian and currently living and working in Poland (less than a year for now), am I required to present the italian and polish police check? My residence is still in Italy.

     

    And also,  for the interview in my case, will it be done in an american embassy in Italy or Poland??

  13. My fiancee decided to break up with me, all in a sudden, the day before he was normal and then surprise.

    I can't believe he came to Italy and proposed to me, celebrated with my family and then he left me. We were so close to finally be together.

  14. 5 minutes was about how long it took to get the license. Because I was a resident of the county (my then-finacee technically was not yet), we had to wait which was OK because we had planned on getting married 2 weeks later. If we had gone 1/2 hour North to a different county to get it, we could have had a 'destination' wedding on the same day! :lol:

    I know Colombia has (or maybe had?) a 10 day wait/public notice period before getting married. I remember walking by Churches there and seeing pages of notices of upcoming weddings posted outside the doors to meet the notice requirements.

    In Italy is the same, you wait 8 days (public) plus other 3 days!
