    Once an initial petition has been approved by U.S. Citizenship and Immigration Services, it is forwarded to the National Visa Center (NVC), which is an entity of the State Department. Your petition is in the process of transferring to NVC. The State Department controls visa issuance. Once with the State Department, USCIS no longer has jurisdiction or access to the petition.

    For questions regarding your petition, it is recommended that you contact the State Department regarding your concerns. You can contact the National Visa Center for more information.

    what does that mean? My file haven't been transferred? Or was it Already? And since still in process why would i contact The NVC?

    What about the State Department? Do i Have to call them?

    It basically says your petition is on its way to NVC. The State Department is the entity overseeing the NVC so no, you don't contact them, you just contact NVC for the case number. At this point all we can do is keep on calling NVC and keep waiting for them to receive the case.

  2. Maybe it's because my fiancée is from Afghanistan and yours is from Lebanon and pch1's theory is indeed correct. Just wish they could give us a specific date it's been sent or will be sent so we can stop worrying.

    Well, I don't know if this is necessarily why the delays at NVC are happening, my fiancée is from Ecuador (South America) which -I believe-, is not a high fraud country. From what I read, some countries take longer than others depending on the response time to the required background check by NVC. Still, most of us experimenting delays at the NVC stage is because they have not received our cases from USCIS, after the petitions were approved. Only if NVC receives the cases they can proceed with their part in the process. I found some NVC information online which I like to share and, even though it's about 2 years old, I feel it still applies today. The information mostly deals with spouse processes, but it also applies in general to all type of cases they process:

    What is the National Visa Center?

    The NVC opened in 1994 with the aim of easing the visa processing and administrative task of U.S. Embassies and Consulates abroad. Stated simply, it is the go-between between the USCIS in the U.S. and the U.S. diplomatic posts abroad which issue visas. Whereas USCIS and the posts perform substantive adjudications, the NVC is an administrative processing center. The NVC is involved in the collection of civil and financial documents from applicants and scheduling of immigrant visa interviews. The NVC also ships immigration case files to post.

    What Types of Cases Does the NVC process?

    The NVC processes the following petitions: I-130; I-140; I-730; I-129F; I-600; I-600A; I-800; I-360; and I-526. In FY2014, the NVC received 709,000 cases from USCIS, of which 99,000 were family-based petitions whose priority date was current. During the same period, the NVC shipped 349,000 cases to posts around the world. In FY2014, the NVC received approximately 1.4 million pieces of incoming mail, and shipped 3.3 million pieces of outgoing mail.

    Why is my Case Taking so Long at the NVC?

    During 2014, the NVC’s workload substantially increased. Whereas in recent years, the NVC received approximately 8,000 petitions/cases from USCIS per week, in 2014 that number increased to up to 25,000 per week. According to the NVC, that number has since stabilized at approximately 17,000 new cases received per week. The NVC is staffed by approximately ten (10) Department of State employees and over 560 federal contractors, who are tasked with working through the cases.

    According to Department estimates, in FY2014, NVC staff received 1.7 million written inquiries, 1.6 million telephone calls, and 98,000 written inquiries. Due to the unprecedented workload, delays from target processing timeframes are currently a fact of life. The document review phase (the time after civil/financial documents are received by the NVC and the case is cleared for interview scheduling) is currently about 55 days. Department officials confirm that additional staff is being hired, and current staff is being cross-trained to address the backlog issues. Further, a phone system upgrade, which will hopefully make it easier to speak with a representative, is scheduled to go live in February, 2015.

    Carefully Following I-864 and DS-260 Requirements is Critical

    For now, attorneys and applicants are left to carefully comply with NVC requirements and to be as patient as possible. Failure to submit proper civil documents or translations; incorrectly completing the Affidavit of Support; or failing to substantiate the Affidavit of Support with evidence of financial support are common reasons for why the NVC may request further information on a case.

  3. Farzram, I'd take the "no call USCIS" as a good thing, sounds to me like the packet is actually gone and they can't do anything else about it. Yes, get your congressman involved and hopefully their office can give you a status update from NVC. The 90 day time frame is the maximum time NVC should take in processing their part. It only involves a security check from the beneficiary's country and this sometimes takes extra time, depending on the country involved.

  4. That's good news, looks like a step in the right direction. Idk why I never get through to a tier 2 they never call me back... And the tier 1 always has problems wanting to connect me to a tier 2. I'll try doing that today and try my luck again. Hopefully your petition gets there ASAP your wait has been very long. Good luck!     Tier-2 is a USCIS supervisor, or a step up from customer service agent. After your case is out of normal processing time, (6 weeks for NVC case number, for example), you contact a Tier-2 to escalate your case and request a research. What's your NOA2 nitemjay321?

Finally got through today with a Tier-2 USCIS supervisor which took my case number, names, DOBs, etc. She took all the details and emailed CSC (where my case was approved), requesting a follow-up and the case be sent to NVC. The supervisor was nice and concerned, told me I should receive notification from CSS within 15 days via USPS. I plan to keep on checking with NVC on a daily basis though. Fingers crossed.

  7. Okay, I can ask my fiance to start a conversation with congressman right away.

    Any other recommendations please! since I don't want to sit idle and leave this on time, My fiance has spoken to 6 different Tier 2 officers so far and all of them have different sayings, which even make the case worst.

    Any idea, in case I want to restart the whole process - what needs to be done?

    There are a few things you might do to try to resolve your situation:

    1. Post your experience on VJ K-1 Visa Process & Procedures forum. You might get more responses and possibly other members' input: http://www.visajourney.com/forums/forum/80-k-1-fiancee-visa-process-procedures/

    2. Keep calling USCIS and politely request to speak with a Tier-2 supervisor again.

    3. File Form DHS-7001 with USCIS Ombudsman for case assistance: https://cisomb.dhs.gov/oca/form7001.aspx

    4. Schedule a InfoPass appointment with the local USCIS office for in-person assistance: https://my.uscis.gov/appointment

    5. Contact your Congressman for assistance by phone, email and/or snail mail.

    6. Contact an experienced immigration attorney.

    I would do all these in the above listed order, letting #6 as a last and final resort. Good luck to you, let us know how it turns out.

Hi guys wanna ask some question about the nvc. because my petition was approved 129f last may 27, 2016 and its been 8 weeks now and i still no case number i tried calling them everyday. they said is not in the system yet. ive tried to email them with my approved notice to nvc researh. still no reply.

    is there someone experiencing this kind of situation??

    Same boat here. NOA2 was May 31 and still no NVC case, they say it hasn't been received. I sent them copy of the NOA2 last Friday as requested, but no reply to that either other than the automatic "we received the email" reply. I know there a few other VJ people out here waiting for NVC case numbers also so don't feel you are alone.

    Mine expires August 6th...

    I have to take a day off work and drive 3 hours to St Louis for my INFOPASS appointment Monday.

    It should never be this difficult to know when if you file has been sent.

    Hi, did you ever made it to the InfoPass appointment? How did it go? I tried to schedule an appointment online and, after entering all the requested information, I got a message stating my case was not elegible for an appointment due to being within normal processing time. How long did you wait before scheduling your InfoPass? My case is almost 6 weeks since NOA2 and no NVC case number yet.

  10. I'm a February filer with NOA2 of May 31th. I also haven't gotten the case number and coming up on the 6 infamous weeks. So, I today called (once again) NVC as was told that they should have received the case from USCIS by now. I was then told to scan a copy of NOA2 form I-797 and email it to them @ NVC research.gov. I'll be doing that tomorrow, although I don't expect a quick response from them.

    Yesterday I contacted USCIS and requested to speak with a Tier-2 supervisor, but was told none was available at the time to take my call, so they will return my call within 3-5 business days.

    The waiting continues...

For what a local immigration lawyer explained to me, the question about knowing someone in the US mainly applies to a family member and legally living in the US, were you can benefit from them in an immigration way. The lawyer explained what the law says and it (the lie), should not constitute material misrepresentation, therefore, should not affect your petition. That being said, a second lawyer told me that a hardship waiver might be necessary in such cases. If I were you, I'll check with an immigration lawyer regarding your case specifics. Most offer a free, initial consultation. Good luck to you.

  12. If you are referring to Affidavit of Support form 1-864 required for AOS, yes you can sponsor another K-1 beneficiary, and no, you cannot withdraw the first Affidavit from your current wife. In fact, your responsibility as sponsor lasts until on of these occur; your wife becomes a U.S. citizen, has earned 40 work quarters credited toward Social Security (a work quarter is about three months, so this means about 10 years of work), permanently leaves the United States, or dies.

    Like others had said, divorcing and getting married fairly quick doesn't necessarily means a denial, but it might raise a red flag, so be prepared for this and submit plenty of evidence with your petition. If I were you, I type a letter clearly explaining the circumstances and include it with the petition. Good luck to you.

  13. yesit was A response from an inquiry that i have submit cuz my case is already over 6 weeks since i was approved.

    all what i asked for is to know if the uscis has sent my case to the NVC.

    And that was their response.

    I don't know but it sounds to me like a generic, canned response from USCIS. Pretty much they are saying keep on waiting. Is this the response you got from an INFOPASS inquiry or was this through another means?

    Wow, I feel sorry for your situation. Did you try contacting your congressman? Wonder which route's more effective and provides a quicker result...
  16. It's been 5 weeks since our case was approved but still waiting on getting the case number from NVC. I called NVC today and a very nice agent told me that "they should have gotten it by now", and to call USCIS to inquire about it. She even said that many cases are getting in from USCIS in a matter of days after approval.

    So I called USCIS and explained the agent the situation and what NVC has told me and the response was that it might take up to 90 days for NVC to receive the case and I must wait that time before this could be researched. ? I believe this is bologna, must people only wait 6 weeks to call USCIS and ask for a tier-2 agent, or schedule a local InfoPASS appointment or contact their Congressional representatives. I'm also aware the petition itself expires in 4 months, so I can't see why it might take up to 90 days for NVC to receive it.

    I'm wondering if anyone else has receive this kind of non-sense response. I even called twice and the 2 different agents told me the same script.

    I personally will wait another additional week, or 6 total, before I start calling the higher ups and start making some noise, that's simply ridiculous.

  17. I'll share with you what my experience was since I also did not have my ex-beneficiary, (then ex-wife) A- number. I tried obtaining it but to no avail, and also put "UNKNOWN" on the petition, listing the dates requested to the best of my re-collation being that petition was filed several years back. I did not get a RFE, however, I believe that by me not providing such number, my petition was delayed and its approval took longer than the average, almost 3.5 months. I'm not saying that in your case it will cause a delay simply that it might, so be aware and ready for this. Unfortunately, if the number isn't available isn't available, it is what it is.     I am freaking out... I got my K1 visa today and I looked at my passport and on my visa it says my nationality is GRBR, but I am from the Netherlands and live in London. What do I do??? What if I need to send it back and wait for it to come back and I won't get it back before August 4th?

    I agree with Georgia16, fix it ASAP. Remember your passport will be looked at several tumes by many agents, both at your departure and arrival point. You don't want to risk it and be held back home or even denied entry into USA for such technicality. Request expedite service if available. Good luck, I think you got time on your side.
  19. I'm just so confused about it. It doesn't make sense that they just don't have it yet the USCIS doesn't either (I called and asked) so I'm a little lost right now. I dont get how people with noa2 of 7th of June have their case number from the nvc but here we are, with nothing.

    Yes, you are correct, it doesn't makes sense but that's how the system works. So there is no need to panic... yet. They say it could take 4-6 weeks after NOA2 so we got to be patient. We'll get our case number, is just a matter of time.
  20. Hi guys, feel a bit stupid asking this since it seems so basic! But I have my NVC case number and my case is showing as ready, but I can't find the links to book my medical, interview and courier. This is for London embassy by the way. Any one who can help?

    Not sure how exactly London does things, but most embassies post instructions on how to schedule the medical and which doctors, their addresses, phone #, etc., right on their websites, you might have to take a look. Our consulate even posts a link to Packet 3 so you can start working on it before even scheduling the interview. Maybe someone else going through London give you a better answer but I'll take a look on the website, or email them, good luck.
