Honestly I would not worry about the whole living with her parents due to you having enough evidence of you to living together away from the in laws. If they ask them just answer truthfully and you should be fine.

I would get color copies and not black/white copies.

Thanks for your input. Are/were you in a similar situation?

I did copy it in color, but the strip on the back of the card appears black for some reason on the color copy. Anyone else have that?

  2. I have plenty of evidence for when my wife and I moved out of her parents home and lived on our own for the past year and a half e.g. lease, bank accounts, tax returns, joint assets, insurances, utilities and joint liabilities and pictures.

But I completely forgot to include evidence for when we lived with her parents for the first 6 months. We didn't pay any rent or utilities or contributed to groceries. I have a few bank statements showing joint ownership during those first few months, both drivers license with parents address (but we have since moved to another state and did not get another license for the new state) and tax transcript with the parents address. I didn't have health insurance for the first few months.

Do I need an affidavit from parents saying that we lived with them? Or will a signed letter from them be sufficient? Or should I not even worry about this?

Also, unrelated, does it matter that i photocopied the front and back of the green card each on separate pages? And the strip on the back of the card comes out on the copy as being all black, is that okay?

  3. I haven't submitted it yet so I don't know how USCIS will respond. But I'm planning on sending the transcript and a copy of the tax return I filed with HR Block. I was advised that details of the changes to the transcript have been communicated to other federal agencies. But I'm doubtful thats the case. Did you also get a transcript that didn't have your full names and address on it?

If you can't get hold of complete transcripts, I think sending them in as they are along with the corresponding W-2s might help. You can also write in your covering letter what the IRS said about them being incomplete for privacy reasons. They do want to see the transcripts to show that you filed jointly. W-2s alone don't show how you filed your taxes, although they do contain your address and if it's the same as your spouse's then that's a win!

This is what I'm thinking I'm going to have to end up doing and hope that i don't receive an RFE. I think I've got enough evidence for them to see that the transcripts are linked to my wife and I. But its whether they bother to flip through the paperwork to make those connections.

  5. br9k, I really hope it is just AIR!

According to IRS its a "new" policy only introduced two weeks ago. I have since also contacted the Taxpayer Advocate Service who are apparently independent of IRS but part of IRS (not sure how that one works!). The lady on the phone was sympathetic with my issue but ultimately she was not able to come to a resolution and told me that she will speak with her supervisor but they might have to open up a case for this. She did however, try to access the transcript and told me that she also wasn't able to get transcripts with my full address and name.

This whole thing is ridiculous. Its my own personal information but they're talking like I'm not allowed to have access to my information under the guise of protecting my privacy. It should not be this difficult. Such a simple task turned into something so complex...

  6. So I just got off the phone with IRS (after being on the phone for 1 hour and 40 minutes!) to see if getting a mailed copy of the transcript will include my address and full name details. After wasting so much time on the phone with them, they told me that a mailed copy will be the same without all the details! WTH? They also told me that there is a new procedure that if I wanted a transcript with my address and name, IRS needed to get in contact with USCIS and have USCIS tell IRS that they need that information?! I told them that USCIS will not do that for IRS and that even if they contacted USCIS, I haven't submitted my paperwork for I-751 because I need the transcript before I file the paperwork with USCIS and that IRS is holding this up for me.

I am feeling so defeated right now. What am I going to do?

  7. Actually what I should have said in the subject is that the name and address isn't missing but it is incomplete i.e. doesn't have all the letters of the name or address. On the instructions of the form 4056 to get it mailed, it states that IRS have modified transcripts so that only partial personal information is shown to protect privacy. So I wonder if this includes the name and address and whether getting it mailed won't make any difference? I don't want to have to wait for the mail if I could just send the packet in sooner.

    Echelon,

Was this for you removing conditions? Did you get yours online as well and was your name and address missing completely or like mine where not all the letters are showing? What do you mean by the W2's are more important? Is that not included with the transcript?

  8. Hi all,

My status on the USCIS website remains at Fingerprint Fee was received as of October 20 after I went for my biometrics on November 23.

I have read that the USCIS case status is not reliable so I'm trying not to read too much into it. I've also read that the customer service line is not of much use because they only advise on what notices you have already received in the mail.

However, I missed the original date of my biometrics appointment and was lucky to have been able to get the biometrics done as a walk in. So I'm worried if that may have jeopardized my application because I didn't go to the original appointment date.

Anyone able to comment on this? Should I be concerned or do anything?

  9. Just tell him it's lots easier to just go online and order the transcripts (it is, really, so much easier than copying paper). They'll get mailed to him in a couple of days. You can help him do this. :)

I wish it were that easy >< When it comes to the government and his tax information, all logic gets thrown out the window...

So I'm just going to have to stick with the 1040 forms.

Would someone be able to comment on whether I need him to sign the 1040 forms? I've seen a mixture of responses about this from old posts but it would be great to hear from someone who had successfully filed AOS with either a signed or unsigned 1040 form (and w2, 1099 etc).

  10. The tax return that they want is a copy of what was actually sent to the IRS (which would have been signed by the taxpayer who is filing their taxes) when the taxes for the previous years were filed, not a new filled-in tax form.

You can get transcripts (which I believe is preferred) online that will be mailed to you, that you can then send in with your other materials.

Don't know how to answer your other question about the bar code.

Thanks for the reply. It was filed electronically without a signature. So is he supposed to sign it and date it the original date that he submitted it online?

He has already told me that he does not want to get the transcripts. I know he's being very difficult about the whole process but as he is my soon to be father in law and I am staying under their roof I don't want to do anything to sour our relationship.

  11. Hi everyone. Hoping someone could clarify a few things?

    * Does form 1040 (tax return) need to be signed?

    * The joint sponsor entered his adjusted gross income instead of total income in section 19, should I get him to change it? I only ask because he was already annoyed that he had to provide this information in the first place. He is above the poverty line regardless if he uses adjusted or total.

    * If I just print the page (from a blank I-864 form) with the income information reentered will that stuff up the bar code at the bottom of the page?

Thanks in advance for any input!

  12. Hi all,

When filing out AOS forms (I-864, I-485) can my US citizen wife put her married last name on all the forms?

Her tax returns, W2 and of course birth certificate are all in her maiden name. In addition, we are getting married in the state of Ohio. Our marriage license and the marriage certificate do not have a space where her new married last name can be put down and we would like to submit the forms straight after we get married so she will not get a chance to change her last name on her passport etc.

I have read many posts that say the marriage license and certificate in the maiden name is acceptable in cases for the wife as a beneficiary but haven't been able to find anything if she is the petitioner.

Should I just fill out all the forms with her maiden name? Is there even any benefit in filing out the forms in her married name since she is the petitioner?

    Thanks for any advice!

  13. Our K1 visa got approved yesterday!

If anyone is interested the household registration extract (hukou) that I provided was accepted. I still have no idea what the seal of the household registration in red ink is but I suspect it might just be the stamp that shows that the document is from the department of household registration that was on mine but in blue ink.

Hope that helps someone else in the future!

  14. Hi everyone,

What is "seal of the household registration in red ink"? It was specified as one of the requirements for the birth certificate for Taiwan (https://travel.state.gov/content/visas/en/fees/reciprocity-by-country/TW.html). I haven't been able to find anything on it and I suspect its because most discussion of it would be in Chinese.

I managed to obtain a household registration extract but it appears to be missing this seal and according to my mother the government department doesn't provide that on the English one. Will the US consulate in Sydney reject it?

Really appreciate any advise because when I question the US consulate in Sydney they just give me the response to refer to that link above. I have even tried asking AIT but they just referred me back to the US consulate in Sydney.

So I am feeling trapped and not sure where to get further clarification.

  15. I don't know really, cuz i don't know all your story and information. I've lived in Australia for the past 15 years before moving here to the USA and getting married.

My birth certificate was issued from the hospital i was born in in Taipei, Taipei Women's Hospital thats what he was called 30+years ago but now it is under a different name and administration.

Happy to discuss this further through pm if you give me more information may be i can figure out why...

    Thanks, I have PM'd you.

  16. I had my visa interview today and was advised that its approved pending my submission of a household registration record from Taiwan. I asked them to clarify and they said that it needs to be a birth certificate from the government department and not the hospital. Very disappointed that we have to wait a bit longer but glad its somewhat approved.

    So some questions:

    * What exactly am I supposed to provide? Is it just the household registration record or am I supposed to get them to provide a birth certificate from the government department?

    * Is the US Consulate expecting it to be an original record from the time of my birth or a newly created document?
