  1. Hi,

    My husband and I are flying to Florida next week. In his passport is the K-1 visa with an expiration date of May 27, 2007. The I-94 expired as well earlier this week on July 3, 2007. We filed for AOS but haven't received the NOA1 as of yet. Also he hasn't received the drivers license with picture yet. Will this be a problem at the airport?? His only picture ID is the expired visa in the passport.

  2. Let me see if I have this correct now:

    If one applies for AOS and EAD at the same time - they are processed seperately.

    Most likely the EAD will come through first. For the EAD/I-765 the person will have both an interview and biometrics. Following the person will receive an employment aurthorization card. There status of the person will remain the same. But what is the status called/referred to of a K-1 person who married and filed for AOS and EAD before the 1-94 expires? How long does it usually take to get the card following the interview and biometrics? Do you need to have the card in hand in order to work?

    The AOS/I-485 will take 3 months to 2 years to process and there may be an interview. If there is one the passport will be stamped with an I-551 if approved. After the I-551 stamp is received a person has adjusted status and becomes a Lawful Permanent Resident (LPR). Following a green card will be sent in the mail but may be held up for name checks? Now yodrak said "The status may or may not have conditions attached to it, either way they are a LPR." If there are conditions on it what might that mean?

    Am I beginning to get the whole picture?

  3. I recall reading that after 90 days have past since you get your NOA1 you can get an info pass if you haven't gotten your EAD. How long after getting the EAD does a person usually get the green card? As it seems that he will need the green card to apply for the z card from the coast guard to show permanent residency. This is all assuming that AOS is taking longer then then the EAD. I know that AOS can take up to 2 years. Als

  4. Update!! Well I have great news! My husband got his interim permit extended by 1 year from today. The one that he received on Fri had temporary visitor until 7/3/07 which meant that he wouldn't of been able to take the road test on 7/26/07 that he was scheduled for. When reviewing the dmv web site last nite I realized that he had:

    foreign passport w/visa and I-94 (3 pts) also proof of DOB

    SS card (2 pts)

    marriage certificate (2pts)

    bank statement (1 pt)

    interim drivers license or computer generated learner permit (2 pts)

    So I saw this on dmv:

    Learner Permit

    - get a duplicate

    - change your information

    Do you have a NYS learner permit that is valid or expired less than two years - Yes

    Is proof of birth required - No (unless you apply for a correction to your date of birth)

    Is social security card required? No (unless you did not provide the DMV with a SSN in the past. (Read Note 2.)

    What is needed: Six points of proof of identity. To change your name, you must also provide proof of your new name (a marriage or divorce document, a court-issued name change document) or six points of proof of identity that shows your new name. Read the list of acceptable documents.

    So my thought was that I needed to show the passport/visa for picture ID but had 6 other points of which to extend the date.

    When I got to dmv the supervisor who is usually in was out today. When I spoke to the fill in supervisor I played dumb and said, I see here on the permit that my husband's permit says that it expires on 7/3/07 does that mean that he can take his driving test on the 26th? She said no he can't. I asked can you move up the driving test? Then she looked at the document more closely and said You just got this last week? I said yes, my husband is here on a k-1 and we just got married and the I-94 expires on 7/3/07 but I have the marriage certificate here (showed it to her) and he is now here legally - She asked - Are filing for adjustment? Yes. Then I preceeded to show her the passport/visa, I-94, SS# and bank statement. She took the marriage certificate and other documents and walked away and came back with a xerox of the marriage certificate and a piece of paper that she was reading off of that had info to do with the K-1. Then she is filling out paperwork and asks us to do the same. At this point I do not know how she is assisting us but I see that it is in a positive direction. So when she is done I ask - and she says that she extended the permit from one year from today. Oh great I say but inside I am shouting joy because based on other treads here at visa journey I don't know if I got lucky or if she did things according to NY dmv law.

    So it appeared as though she changed things based upon the above. Change to permit, proof of DOB not needed as I had the interim permit, picture ID - for us was the passport/visa that hasn't expired yet (so if anyone out there already has a non drivers license ID or a picture ID learners permit that is even better as it does show a visa about to expire) and then 6 other points and remember that the interim permit that we got on Fri was good for 2 pts.

  5. My husband needed to get the required "6 points" of proof of identity in NY before going to DMV and taking the written test for his driver's permit. This included his passport with visa and I-94, marriage certificate and SS#. He did that on Fri passed and received his interim learner's permit good only til July 3, 2007 - the day his I-94 expires. So it is good for only 9 more days. Yesterday he took the required 5 hour class and we scheduled his road test but the soonest isn't until July 20th. So I imagine that he will be unable to take it. In the mail tomorrow I am sending out AOS, EAD and AP for the K-1. Yesterday we opened up a joint bank acct. His health insurance card should be arriving in the mail any day now. I say this at the "6 points" can also be met with the marriage certificate, SS#, bank statement and health insurance card. Has anyone lost their permit/license to drive in NY when the I-94 expired? When were you able to reapply? Did they accept 6 points that didn't include the visa/I-94? I am unsure what to do next but know that I have only 6 business days to settle things. Anyone with any experience regarding this - it would be a big help.

  6. In the FAQ's 6.2 it says that for AOS for a K-1 Visa Holder they need to submit a copy of the NOA2 "Approval" for I-129F - So what does it look like? Is it the I-797 NOA Case Type I-129F Approval Notice from 7/7/2006 to 11/07/2006? We never got a letter that the petition was approved for the interview at the Embassy in Guyana? and this letter was before approval of the petition - So I'm confused.

  7. I'm on Long Island in NY - I called to a civil surgeon's office yesterday - so the lady first said that a full medical exam needed to be done. I said no only a transfer of the vaccinations that a medical was done prior to his coming to the US. I faxed her the DS form which was dated 8/31/06. She called me back saying that they would transfer the info for $85 and suggested doing a full medical as the one done in Guyana would expire in one year and that they would do it for $185 rather then the ususual $200. I said that we are marrying in a few days and will have health insurance and if the medical needed to be done I would use the insurance. She said you can't use insurance for a medical - is this TRUE??? Is the medical good through 8/31/07 provided that the paperwork is sent out prior to that date? I will be sending out AOS, EAD and AP in 2-3 weeks - two months before the the one year mark for the medical.
