  1. Thanks for your reply.

If ever they ask what my husband does for a living, should I just mention the old one and not say about the new one? Will they not know about the new one?

And if ever let's say I told them about the new one and they asked me to send in a new i-864 and i already have it with me plus all the evidence of income, will it still delay the visa even if those docs are already available at the time of the interview?

  2. Hi, all.

When we submitted our AOS docs to NVC, my husband used his household members' income to help meet the income requirement. I understand that during the interview, I should bring the AOS (form i-864, form i-864As, evidence of income).

Now just recently my husband got a new work and his income there is enough to cover our household income (no need for household member's help).

    - Should my husband fill out a new form i-864 declaring his new work?

    - Will nvc still require us to use the houshold members' incomes since initially, their forms (i-864A) were already included in the file?

    - Will they remove the houshold members' support since my husband's income is already enough?

    - or will they leave the houshold members' support in the records even if my husband can already support us alone?

    Appreciate all your help.

  3. Okay so lets say my husband's income is not meeting the minimum requirement, he is going to ask his mom to be his joint sponsor. Mom will file i-864 just like my husband.

Now, Mom is adding the income of the his husband (my husband's dad) to meet the minimum requirement. Dad will then become a household member of Mom. Dad will file i-864A.

Now in the i-864 of Mom, she will sponsor me and my son. I am the principal beneficiary and my son is my accompanying beneficiary. So Mom's household size will become 4 (me, my son, Mom & Dad - is that right?)

Now because my husband's income is not enough, is he asking his Mom to meet the household income? or is he just asking for help to meet the minimum requirement?

In the i-864 of my husband, what household size will he put? Does he need to put in 3 (himself, me

And son)? His income as of now cannot support a household of 3, not even 2.

And the Mom would be supporting a household of 4 (me, son, Mom, Dad) or should it be 5 (including my husband)

I am really confused. Pls enlighten me. Thank you!!

  4. Hello, all

It is okay to use your household members' income to help with the minimum income requirment, right?

My husband is using his mom, dad and sister's income to help with the minimum requirement (as household members) as they are living in one residence.

My question is what document should we use to prove relationship? my husband can use

His birth certificate to prove relationship with his mom and dad, how about his sister?

    Thanks

  5. Hi, all

Assuming that all AOS and IV docs are perfectly filled out, how long do you think the NVC will respond with a Case Complete and how long does it take for them to send an Interview Letter? (Again assuming that priority date is already current?)

Thanks. Appreciate all ur help. Especially wanting to hear from filers from the Philippines. :)

  6. Hi, all

I am so happy I saw this post and congrats to all who got visa approved

I just have a question. My husband and i got married on a civil wedding and we were only with my brother and sister in the civil wedding ceremony. My husband's family members are all living in the states. My mom and dad were not able to come with us because they are taking care of our son. I just gave birth to my son then. My son was 1 month old then. Do you think the interviewer will question us and feel suspicious that we were only with my sister and brother during the wedding and that none of my husband's relatives were there?

We had this wedding when my husband came

Home for a 2month vacation because i am going to give birth to our son.

And the process we went through in getting married was really done quickly because we were having a hard time finding a pastor to wed us because most pastors were already fully booked that time and we're told that it takes weeks to schedule. So in short, we really had no specific date in mind for the wedding. We just had to take whatever date we were given because we only had a few weeks left before my husband went back to the states.

Sorry for the long post. I am just concerned about being questioned about our civil wedding

  8. Thank you so much for your reply.

In the i-864 form, there is a part to put the tax income amount, that is for the petitioner/sponsor only, right?

And do i also need to submit copies of the irs tax transcripts of each of the household members helping to meet the income?

Also, is the irs tax transcripts enough or do we still need to give copies of the w2 forms (along with the letter of employment and pay stubs)?

And also, do they need the orginal copies of the tax transcripts or just photocopies?

Thanks thanks thanks a lot!!! Appreciate all your help

  9. Hi,

I have some questions about completing the AOS requirement.

My husband recently lost his job that should have made him meet the poverty guidelines minimum requirement. Now, he has a new job but his income is not enough to meet the minimum requirement, so we are using his household member's incomes (parent and sisters living with him) to be able to meet the minimum requirement.

His household member's tax information (when summed up with my husband's tax info) still doesnt meet the minimum requirement because these are their old jobs and there were months when his mom and dad were unemployed, however, their current income (as stated in their letter of employment and pay stubs from their current job) meets the minimum requirement when i computed it. But i know nvc makes computation and does not just look at the total annual current income to say that it's met the requirement. I think they still put deductions and all because of tax deductions.

    1. What does nvc look at to say that we've met the poverty guidelines?

    2. If the tax returns contains tax info about the old jobs, will they still use it as basis for the minimum requirement, Or are they going to look at the current income to check if we're meeting the minimum requirement?

    3. Their tax return form says form 1040, where do i look to get the amount that i need to put in form i-864?

    4. There is a line that says "total income"

and a line that says "adjusted gross income". Which of the two should i put?

    Thank you very much!!!!

  10. I see. Thanks. But my husband's mom was unemployed before so it's showing only little in her tax forms.

    1. If we already have the pay stubs, what will i put in the current annual income?

    2. How should i compute the current annual income using the pay stubs?

    Also,

Hi, i have a question about sponsoring in the AOS.

    1. If you are the petitioner, are u automatically the sponsor?

    2. If you are going to use your mom's income to help u meet the income requirement, is ur mom considered a joint sponsor or no? I know that the mom has to fill out form i-864a or is it a separate i-864? (the mom lives in the same address as the petitioner)

  11. Thanks for your reply.

Also, i saw in the nvc website this:

"If you completed Form I-864, I-864A, or I-864EZ and the income reported on this form or your tax return reflects income below the poverty guidelines for the year the form was submitted, submit evidence of your income. This can include the following documents:"

So does this mean that if the income reported on the tax return reflects income ABOVE the poverty guidelines, then there is no need to submit evidence of income?

  12. Hello,

I have 2 hypothetical scenarios here that i just want to get an opinion on.

    1. What if it happens that after we have already submitted the AOS financial docs to NVC (these docs are showing that we have met the minimum household requirement), my husband then all of a sudden get laid off at work, thus making him unemployed...

    A. Should that concern us?

    B. What should we do since its already submitted to NVC?

    2. Or what if before we were able to submit the AOS financial docs to NVC, my husband got laid off from work, thus making him unemployed. But he already have the IRS tax transcript copies and it's showing his annual income from his last job. (This annual income is meeting the minimum income requirement).

    A. Should we still use that?

    B. Should we still get a sponsor even if it shows in the IRS tax transcript that he's meeting the minimum requirement?

    C. or should we get a sponsor since he then became unemployed?

Thank you so much for all ur responses. I hope u can answer all my questions.
