  1. I assume your fiance entered on a k1 visa?

    If so, look in the guides section for Adjusting Status for K1 visa holders. That should give you a very good idea of next steps.

    so im filing my I-864 and I am going to use a joint sponsor. do they fill out a separate I-864 or is it the I-864A? im confused.

    also you dont have to include assets right? if your salary alone is over the 125% of poverty guideline you just have to show that right?

    Yes, they have to fill out a separate I-864. It says that you don't have to list assets if your salary is over 125% but my sponsor listed his. Make sure it's notarized and make sure he has 3 income tax years proofs.

  3. MY WIFE AND HER SON's interview went fast. the interviewer, a woman was nice and did not ask any personal questions. she looked at the file and needed a few documents. we gave her the vac supplement and a few pictures, and a couple of pay stubs.

    she stamped the passports with a stamp good for a year and she we would receive the geen card in 7 to 10 days.

    the passport stamp had all the right information---mywife is so happy to get to visit mexico. she has been driving me crazy to cross the border for some good food.

  4. I'm just wondering if anyone else has been through this situation. I am the USC, my husband Canadian. Thanks to the Misinformation Line, he was out of status for about 1 year before we filed the AOS package. I'm starting to really worry about this b/c of our interview coming up.

    Anyone else get out of status, but get their green card??? I did talk to an immigration lawyer and she said it was no big deal, but I wanna hear from somebody that went through it.

    I know someone who was in the US illegaly for 10 years!

    When he got married everything was forgiven.

    The only bad thing about it is

    that he cannot leave the country before getting the green card

    whereas other can apply for the Advance Parole and travel while the application is pending.

  5. Just got an email from USCIS-CSSO stating "On March 11, 2006, after approving your application, we ordered you a new card. Your card will be mailed to you as soon as it is ready."

    They actually did schedule an interview which was supposed to take place on February 28th, but they then cancelled it "due to unforseen circumstances". To speed up the process I mailed them my Vaccination Supplement (the only thing missing from my AOS application) and I guess that did the trick!

    Too bad I *just* applied for EAD renewal (to expire in a couple of weeks) and of course the 180$ they charged me is unrefundable!!!!

    But at least the paperwork nightmare is over (for at least two years, that is)..... or perhaps I should wait with that thought till I actually *receive* the card!

    I don't want to guess wrongly but I have received the same message and it was about my EAD card...

    My EAD has just beed approved so we're expecting the interview date

    for May/June. We're thinking about moving.

    Can we not tell about the address change until our interview?

    Can we say that I will join my husband a month or so later

    and that's why I'm staying at our old address?

    We just don't want the case to take more time because of the change of address...

    He had to sign on the Affidavit that he'll notify

    about the address change within 10 days though...

    We do have a sponsor, who signed the same thing and he's not moving.

  7. I started the same topic yesterday night, but everything disappeared this morning :unsure: So here's my story again...

    I received RFE a while ago for a medical examination. The RFE wording wasn't clear and I didn't understand why would I be asked to do the medical again since I had one done already less than a year ago by that time. So I thought it's asking for a vaccination supplement. My husband called their help line to make sure and the lady on the phone told him that we understood the RFE correctly and all it asks for is the vaccinations supplement. So we sent that. Now I received a letter saying that my AOS is denied since we didn't send in all the requested documents - the medical examination.

    So what am I doing next? Please help me :( I was given 30 days to appeal on that decision, but no instructions on how to do so. I have no idea how much that would be effective and what are my other options, if I have any at all... :(

    It's so late but I can't go to bed before responding.

    First of all please ignore all those fouls, who were writing about deportation.

    Nonsense.

    I know someone, who married a man and he can't prove he is an American citizen.

    He's in his 50s and doesn't have a passport or a birth cert,

    So the case has been going on for 7 years.

    Especially if you appeal you have all the time in the world.

    just do the full medical exam and appeal with it.

    I am sure everything will be back on track.

    The only bad thing about it is the fact that it delayed everything.

    Just be patient and good luck!

    And it's not like I refused to do the medical, it's their help line that told me I don't need to! If I would know that's what they want from me I would give it to them right away.

    Unfortunately, calling the help line doesn't work as an excuse to avoid re-doing the medical which is clearly

    what the RFE was about. I have no idea why they asked you to re-do the medical, but I'm sure they had

    their reasons, and acting in defiance of their request was not a smart thing to do.

    If I were you, I'd hire a lawyer NOW. It's a very serious matter -- the appeal is pretty much your last chance

    to stay in the country -- if you screw it up like you did the medical, you'd have to LEAVE.

    this person : "you'd have to leave" and capitalizing the leave word???

    Do you know any examples of people who appealed?

    I hope so because your words "if you screw it up..."

    are pretty strong.

    It's not that bad when you appeal, everything

    just gets delayed that's it

    so please be human and do not scare anyone.

    I want to know if anyone can help me in reporting a USCIS misconduct and irregularity.

    I was advised by several ppl, not to take such n such step. they suggest to elicit sympathy from USCIS and don't make ur case bad etc etc.

    However, untill this time, in working hard with them and doing anything they ask us to do.

    But i didn't see any sympathy, but totally irregular responses so far, n now a threat to deny the cae?

    so let see what u guys have an opinion and i will like to see if some one has an experience in doing it.

    Let me make it clear, i m not expecting from CIS ombudsman to approve my case, but to ask for an independent review.

  9. This month we will be are applying for Advance Parole along with the AOS. We are asking for the AP so that my wife can resume classes the next semester this May. Any idea how long until we can expect an approval? Is resuming classes a good enough reason for an approval? What would happen if she was to leave before an approval was received?

    Do not leave before the approval is sent. I know someone whose AP wasn't approved.

    Well expect 3 months from the date they received (worst case scenario)

    I got mine after 1 month and 3.5 weeks.

    Any proof is a good one, I had my friend's wedding and simply

    showing Europe to my husband.

    From what I've read, NYC, since Ewen and I will likely be in the same position, is that doing ALL of the following will generally effect the change of address with USCIS if you have to move before AOS is complete:

    1.) File AR-11 with USCIS (for the alien).

    2.) File I-865 (for the USC spouse as primary sponsor).

    3.) Send a letter to your old DO advising them of the change (with copies of the I-865 and AR-11).

    4.) Follow up with the Misinformation Line about 2 weeks after you send both documents. If they haven't changed your address, make them do it then.

    5.) Follow up again with the Misinformation Line again a week or two later to make sure they have your address right.

    Of course, it's a bit of a crapshoot because USCIS claims that things get "lost in the mail" even when people HAVEN'T moved house. ;)
