  1. Hello everyone, my colleague migrated to the US through EB3 petitioned by the hospital. She's been planning to not finish her contract (pay the breach fee) with our hospital to move to a different state where her fiance is from, and they're planning to get married soon.

     

    Her concern is whether this breach of contract will affect her future citizenship application and may be cause for denial? We tried to look it up online but cant find any specific information about this type of situation.

  2. Thank you for the replies everyone. I migrated to the United States as a nurse, January 2017 and married my US citizen boyfriend of 4 years in February 2017. Had to delay the wedding just to avoid any complications with paperworks in my EB3. So we got married a month after I got to the US.

     

    From what I gather based on the responses, I qualify to start applying 3 years from date I obtained my green card.

    Thank you! So in this case, because of marriage to a US citizen the applicant wont have to wait 5 years to start process?

    Yes B2, valid for 10 years. Been to the US on that same visa at least 5 times over the years with no problem even after I-140 was filed. I have a house and mortgage under my name here in the Philippines, family owned land and business that isnt under my name YET, and no direct relatives in the US. I was just wondering if the case is different now that the I-140 has been approved. Thanks for the reply.

  5. Hi. I would just like to ask, will there be a red flag raised if I enter the US on a B2 with an ongoing EB3 petition?

     

    I have been to the US multiple times and never overstayed my visa. Just last year my I-140 for EB3 was approved and now still waiting on Priority Date of Jan 2017 to be current so I can further continue the process. 

     

    This summer, I plan to visit the US for 3 months. I am definitely going back home because the consular processing will be done in my home country (Philippines).

     

    Will there be red flags raised? The last thing I want to happen is be denied entry. How do I avoid this if I get questioned? Do CBPs at the airport have access to records of visa applications?

    edit: thts not to say a lawyer wouldnt be useful for some more unusual or messy cases like with prior arrests or divorce stuff. this is serious stuff and if it would make you feel more comfortable yes a lawyer can help. but keep in mind they are no guarantee either so please get familiar with the process and paperwork on your own as well

    Hi. Thanks for the response, so far our case is simple, no fellony no divorce no kids. But my concern is I have an ongoing employment based immigrant visa petition and I dont know how that will affect my case.

     

  7. Watching the show and I somehow feel bad for Karine..poor girl. Paul is neurotic. 

     

    And Abby, she clearly kept both Sean and Chris to see which of them will bring her over to the US. Apparently, she loves Chris and chose him. I cant believe Sean cried, I mean she isn't that beautiful, they barely know eachother! Ridiculous.

     

    And Courtney, she wants bf/gf status but the Spanish guy cant even put a clear lable on their relationship! And thats after flying halfway around the world to go see him.

     

    Is this show for real?! Lol

  9. Lol Abby's exbf is an old American, now shes with another older American guy, clearly she's looking for an easy passport to the US. She used to work in the Dominican Republic where she met Chris, and I read somewhere that many young girla from Haiti are involved in sex trade in Dominican Republic. Lol obviously Chris and Abby are still in it! Haha

    Timeline can be differ based on which field office you are gonna have interviews, 
    but generally, NYC and NJ takes longest time (Around one year) while offices in SoCAL like LA and Orange country takes even 3-4 months. 
    (oh there is St. Paul, MN, which has been notoriously slow and back-logged since 2013, which I dont know why)

     

    Other major cities like San Francisco, Seattle, Chicago, Houston, DC takes between 6 months to 10 months, assuming there is no RFE
    So I would say that it is reasonable to expect average 8 months ish taking for AOS, in general. 

    My case was at Chicago, which took me 8 months, with RFIE. Later, I learned it would take around 6 months for cases without RFE

    Your field office is the local one to you, so if you Google "USCIS field office near me" you should get a result and that is most likely where your case is at.

    Hi. Yes I do understand its all different, I guess Im just curious about the usual timeline so I can somehow gauge how long it usually takes. I also want to know how the field office or service center is being chosen, also because the timeline is different for each.

    I have been scouring the site about AOS timelines but only seem to find old ones. I just want to ask how long the current AOS process is until your greencard. 

    I understand there's no exact timeline, but I just want to know what the average is and if it differs per service center. Also, how do you know which service center your applications goes to?

     

    Also, did you need a lawyer to process for an AOS?

    Don't know what to say about that. My fiance has never spent a peso on our relationship. I guess I am just old fashioned like that.

    I think he's just in a comfort zone. Time for you to turn up the heat.If you are ready to get married and settle down tell him. Then tell him if he's not ready maybe you just have different goals in life. If he loves you it's time to prove it. Has he ever been to the Philippines?

    He has been to the Philippines, we met overseas so when we had to start doing long distance it was hard having to transition from seeing eachother everyday to every 6 months. He does cover most of the cost, but since I also have a decent pay as a RN i try to pull my weight on things.

     

    You're  right its sad being in my position lol.  I am ready to get married, he says he is too. When? Maybe when pigs fly. I dont know. He told me to get a job in the states, so I did and now processing my immigrant visa.

     

    He is 8 years older than me im in my 30s now, so i dont think he's that young anymore. Right now im here in the states again and he does take care of me, but my little eggs are getting close to their expiration date, I might never have little mini-me's running around.

    In my case I have not even officially proposed to the woman I will marry in about a month. I have been there to the Philippines 4 times to visit her but circumstances kept us apart for three years now. We never stopped talking about our plans and had gone back and forth in spouse or fiance visa and decided to get married there and then file for spouse.We have planned our entire wedding already, yet I still have not proposed because I feel that needs to be done in person. So in 3 weeks when I first see her at NAIA I will be proposing to her and putting a ring on her finger :D.

     

    But for your question don't put the cart in front of the horse. Focus on the relationship (if that is your main goal) and the details (such as immigration visa) will work themselves out in time.

     

    Also don't be set on a fiance visa. Spouse visa's are better in many ways, the only negative is that it takes a little bit longer.

    Of course the relationship is my main goal (i dont know if its the same with him). Been together for about 4 years and counting..engaged with a an engagement ring for almost a year. When we started LDR, I had to come visit him in the US every 6 months which burns a hole in both our pockets. Thats just about it. Hence my curiosity.

     

    Maybe he's relying on my lengthy, tedious, work-based immigrant visa which could take longer than the spouse visa lol

     

    @Umka36 lucky you, my fiance maybe still enjoys being away from me.  

  17. To all those with EB3 registered nurses for the US, at what stage of the immigration process is the Visa Screen Certificate required? Do you submit it with the other documents to NVC? Or do you just bring it with you during the interview? 

     

    Also how long did it take you to receive the said certificate from CGFNS?
