  1. After his embassy interview, he got the visa delivered to him the following week. There's a very fast turnaround. Your fiancee needs to schedule an appointment with a doctor in either Marseille or Paris (depending on whichever city they're closest to). Once the embassy gets the K1 packet from the NVC, they will send your fiancee a packet 3 which will tell her the way to make the appointment with the doctor. She will also need to get a casier judiciaire even if she has no criminal history and some other documents--it's all listed in that packet. The medical typically costs 200 or so euros.

  2. Hello!

    My fiancé recently got improved for his K1 Visa! We are planning his flight sometime in April, as it expires in June. After the AOS is processed and approved, will he be able to travel back to England to work a few months then come back to live with me?

    What can we and cannot do? How long does the process take?

    Please note that the timeframe of coming to the U.S. is dependent on when the medical expires and not when the K1 visa expires. It's very confusing since I've seen it on countless places on VJ and the internet that you must travel here within 6 months of your K1 visa being issued, but we were informed that it was actually 6 months from the date of the medical exam.

    I second the above poster. He should not go back to the UK without filing for AP, which is usually done at the same time as you file for EAD and AOS. Check processing times on VJ for more specific information--it all depends on where your local immigration office is and how long they take.

  3. My husband was from France as well. It only took a month for them to approve our I-129F packet from the day I sent it (we got lucky with getting the California service center). It took about another month for them to send it to the embassy in Paris, and then the timing is up to your fiancee from that point. The sooner your fiancee does the medical, the sooner he will have an interview and get the actual visa.

  4. Im finalizing my AOS packet and I need to organize the payments for the process.

    I have noted that it is $360 for the 131 Advance Parole filing fee, $465 for the 765 EAD work permit filing fee, and $1070 for the I485 Adjustment of Status.

    Do I need 3 separate money orders for each filing fee? Do I need to pay all three or are any included in the filing fee for the I485?

    As well- I had my medical done a week before my interview, do I still need to complete form I693 and visit a doctor locally or can I include a copy of the vaccine records and sign off I was given at my K1 interview?

    You should check your DS3025 to make sure you have ALL the vaccines required for AOS. If you do, then you can just include that copy and skip the civil surgeon visit.

  5. I think mine must have got lost. Still nothing and they received them on the 5th. Should I refile? My K1 expires 11th of March so need it in before then.

    It doesn't matter when your K1 expires. Your K1 technically expired the minute you passed customs, and your I-94 is now the document that has a 3 month expiration date, but that date is the time you need to be married by, and NOT the time you need to file AOS.

    On another note, I'll be filing AOS/EAD/AP this Friday!

    Please advise if the redundant documentation is really necessary, passport biographical pages, K1 visa copies..etc

    G-325(Biographical Information) How many copies do I need? I have seen people including up to 4 original copies?

    Don't have DS-3025 Vaccination Documentation Worksheet only the I-693, I have seen both listed on some posts, Is this a must?

    Do I need copy of pay stubs? if so how many?

    Two of the six passport photos suffered a minor accident, they have a dimple from a pen falling on them in the back, do I need to get new photos?

    No paperclips or staples are used, except for stapling plastic bag containing passport photos to a white sheet of paper.

    You do not need I-94's for the I765 OR the i-131. The I-131 doesn't explicitly state this, but it is not a required piece of evidence.

  7. An I-864A is optional. It is not a requirement from everyone that happens to be married and files jointly.

    Item Number 7. This question gives you the option of including certain other non-dependent relatives who are living

    in your residence as part of your household size. Such relatives may include your mother, father, sister, brother or adult

    children, if they are living in your residence. However, the only reason to include these relatives in your household size

    is if you need to include their income when you calculate your household income for purposes of meeting the income

    requirement for this affidavit. To be considered, any relative included in this category must sign and submit Form I-864A,

    Contract Between Sponsor and Household Member.

    And Page 8 tells you what to include for your taxes, if you file jointly but are meeting the income requirement on your own >

    If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every

    Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS

    transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.

    solely in I-94 record name, which should match up with visa name.

    That I-94 record name will match up what's in the SAVE database, supposedly.

    Alternatively, get into a CBP deferred inspection office, talk face to face with a shift supervisor, and get the I-94 record fixed there.

    Unfortunately, the I-94 name does not match up with what's on the visa, as his middle name was cut off in the I-94. After reading this thread: http://www.visajourney.com/forums/topic/583564-ssn-middle-name-confusion/, I feel better about waiting.

  9. Thanks francais_usa. He did not receive a copy of the DS-3025. When did your husband receive it? Was it in the mail? I am wondering if it is just in USCIS's records since he turned it in at customs.

    Did he have his medical exam done in Paris and if so, was it Dr. Slatterly (sp?)? He should contact the office where he received his medical exam, and they should have a copy on file that they can e-mail. If not, it will create a lot of problems if you can't remember what vaccinations were done, as you wouldn't know whether or not to get more done from a civil surgeon. USCIS will have the original that was included in that packet--the copy is for your personal record.

    I just wanted to start a topic for those who are facing a similar issue. My fiance came to the U.S. on January 31st, and we went to the SSA immediately after he arrived (February 3rd) to apply for a SSN. On his SS application, we listed his entire name as it's displayed on his passport, however there were some discrepancies between his full name on his passport, the name on his K1 visa, and the name on his I-94 Arrival/Departure record. Basically, his name is a-b,c,d,e,f (a-b = hyphenated first name, c-e=3 middle names, f=last name). On his K1 visa, his name shows up as a-b,c,d,f. On his passport, it's a-b,c,d,e,f. On his i-94, it's a-b, c (only 4 characters from c), f.

    When we went into the SSA, I used his full name shown on his passport to apply, but this didn't match up with the I-94 or his visa. Thus, our SS application was sent to DHS for additional verification. Originally, the agent told us it would only take a couple days for them to send back an electronic confirmation to the SSA, and after that, they would send the card. He gave us a letter which stated it may take up to 4 weeks, but he assured us it would be 2 weeks maximum. We have been checking on the status of the card since then by calling both our local SSA office and USCIS. Unfortunately, a USCIS supervisor told us that they had no information on the SSN even though the application was with them, and that there was no way for me to check the status. Every time I called my SS office, they said that DHS had everything and they couldn't give me any more information.

    Today marks 2 weeks since our original application, so my fiance and I went back to the SSA (because we weren't able to get any answers on the phone), and another agent told us there was nothing they could do because the application was still with DHS, and all we could do was wait for them to get it back. She suggested we call the SSA every week and that I should receive a letter within the next two weeks (making it 4 weeks since my initial application). We are anxiously waiting for the card, but meanwhile, I just wanted to share our experience with everyone--perhaps others have faced something similar?

  11. For a self employed person the income used is line 22 of the most recent tax year's form 1040. He must submit a copy of his tax transcript or entire tax return including all schedules, 1099's, etc. It seems that you did not send the complete tax return package. If he files a joint tax return then his spouse should also complete a form I-864a.

    If dad can't produce the required documents then find a joint sponsor who can.

    If your (USC spouse/petitioner) current annualized income is enough then a joint sponsor should not be needed.

    Most of the above is correct except for the I-864A. An I-864A is only needed if your dad wants to include his wife's financial information, but if he is qualifying based on his income alone and not his spouse combined, it is not needed at all.
