  1. I see. It would be better to do everything we would be doing as if we had the visa on hand then. I've read some threads and it is clear, but one thing is unclear is the kind of proof the officer from the consular might define as proof of domicile. Some people have shown leases, job offers, and proof of a sale of their houses. I am wondering what would constitute proof for us, and that will show that we are actually moving. Which by the way, this is to prove that correct, that we our intent is to move to the US?

    And then I am worried that if they ask me, so does your spouse lives with you or in California? (at his sister's address) I feel like I will be telling a lie. Or can I say the true, that we don't have a place to live yet but we are using his sister's address? Is the domicile address the one where we intent to move to?.... I do remember when we moved to Canada, we didn't know anyone and they asked us for an address too, so we gave the address of a co-worker of my spouse, I am wondering if that is the same case for the US.

    We have a few things that shows ties to the US, and one important one is that my spouse is still working in the same job for 15 years in Detroit, voter registration, bank accounts, po box, etc. We could list our house for sell right now, and I could move into an apartment and my spouse could move ahead of time to California, but it doesn't seem natural or it seems like we are trying to prove something that we are actually doing anyways? Would having him move there first, would help?

    I apologize for the long response, but I having a hard time trying to understand how to prove that we would like to just move back, maybe not to Detroit, but to California.

  2. Have you checked out the domicile thread in the Canada forum? You need a place to move to. He should use his current address as he hasn't moved yet, but domicile will be an issue for you. Montréal is very strict on it. Before you complete the DS-260 you should figure out where you will be moving to after the visa is granted.

    Hi there! I wasn't aware of the thread! Thanks for letting me know though.

    We have looked into the visa journey wiki page, and that was a good help too in answering a few questions, but we were confused as we don't have a physical address in California yet. Although he has kept all of his financial, voting registration, and a mailing address mostly in Detroit, as that's where we used to live and where he currently works... But we don't know the neighbourhood where we will settling in Los Angeles yet. We know for certain is in Los Angeles, as where that is where his family is and where his job transfer will be. Other than that, we have looked a rentals and neighbourhoods online but nothing concrete as far singing a lease.

    So in other words, can his domicile be his sister's house, address?

    We are about fill the DS260 form, and we are confused about part the address for my spouse (petitioner, US citizen). We currently live together and we put our current address in our i-130 form initially here in Canada. We are not sure what address to use for either forms, DS260 or i-864. Can he use his sister's address in California in the meantime? California is we where we are moving to, and where he can get transfer from his job, but we don't have a permanent address there yet. Thanks in advance!

  4. Okay, guys I am back. Ready to continue with our process!!.. We decided to continue the process by ourselves, and without the lawyer like you suggested!... So, now that we have the receipt and ID numbers from NVC, I am confused as far as choosing an agent first? Do we call NVC and tell them that we don't have a lawyer anymore, and then pay the fees? or pay the fees first and then call NVC? When do we choose the agent? Thanks in advance!!

  5. Thank you guys. We have been thinking and we want to just file our case by ourselves. BUT, there are too many buts. One, is that I had an order of deportation back in 2005, and a few weeks before the date I was supposed to present myself to the INS building downtown, I asked the INS officer over the phone, if I could leave in my own terms. Her words, I still remember them : "that's not a decision you can make, that is a judge's decision" ....still though, she faxed me a voluntary departure form to take back with me to my home country, and she requested from me in the conversation over the phone, to fax her back: a copy of my passport and copies of my airplane tickets..... which I did. So in March 7th, I left.

    So we still wonder, whether a lawyer would help us or not!. My question is if, I still have an order of deportation pending? Since was the immigration officer giving me the voluntary departure and not the judge. How will this affect our I-130 application. My 10 year bar has just passed last week based on my overstay of my tourist visa.

    I guess our lawyer won't answer any more questions until we sign the second step or second agreement :(

  6. Hello guys, as you may remember I said I was going to call the NVC at 12 weeks time. So we just did. We were on hold for about 30 minutes and a lady answered the call. She was actually very straight forward, and nice. We requested the case number and Identification Number, and we got it. But the most discouraging and infuriating thing is to have found out that it was assigned on February 11!!!! and they emailed it to our lawyer a month ago today! And When we wrote to our lawyer on the same exact date on Feb 11, for an update on our case, he finally replied to our email, after we were waiting for 8 weeks for his replied. He said with a very generic email that our case has not been assigned number yet, etc. I can not believe this. Here I am almost going crazy wondering about when our case would move forward, and to find out today that it has been on hold because of the lack of care of this lawyer.

    What should we do guys? I am really worried we might need a waiver at the interview, but we have received mixed opinions from various lawyers that we may not. Should we proceed in our own? I want to write an email to our lawyer and tell him how incompetent he is. The lady on the phone said to go ahead and pay the fees. Should we?

    Congrats to everybody who is getting some sort of answer. :)

    I have a question. My husband(American citizen) is with me right now, in Turkey. We just got our noa1 approval. It took 11 months and all this time we were back and forth in Turkey and in Brazil. (He is also brazilian).Now we are waiting the NVC package to arrive. I know he has to go back and enter US before my interview. But when is that exactly? Everything is so unsure. We don't know what to do. :( would it be a problem if he stays with me here ? We are doing our taxes together and this is from the money I made working in Turkey and the money he made working in Brazil.

    I would appreciate a lot if anybody can give me any suggestions. :(

    I am not sure how much of a help I can be! But I thought I just say, that we started paying taxes as married just last year, although we have been together for almost 15 years. And as long as you can keep track of all of your expenses it shouldn't be a problem. Do you have a tax ID yourself? I applied for one, even though I am not living in the Estates yet. We are still waiting to hear from NVC, so stay positive and everything will be fine! I am sure others here can answer more than I can.

    Your lawyer should be receiving (if they haven't already) an email with the info and forward it to you. But it won't delay your case to be proactive since your lawyer isn't being responsive. Also, does your case really require a lawyer? Most of this stuff you can do yourself through VJ.

    I was wondering about that, thanks for clarifying! We also hired a lawyer because my situation could required a waiver, although we are still unsure whether we will or not, but to be safe. Tomorrow we hit the 11th week, so if we don't hear anything by next Thursday, I will be calling them! :mellow:

  9. Thank you guys, I thought it was a long time myself. I've been reading other threads and I was thinking that I could wait until 12 weeks have passed. The other thing is that we hired a lawyer, and if we were to contact NVC in our own, that would create some conflict. Isn't our lawyer supposed to received the case number, or would it be us? I would be terrified if our case got delayed even more if I call to get the receipt number. Our lawyer isn't very communicative I have to say, and it takes months to reply to our questions. I guess that's why I came here, to easy our worry! (F)
