NLR: I just got an email from NVC!!! And it says:
Dear Sir/Madam:
The National Visa Centre (NVC) received your inquiry regarding the immigration visa petition: MTL00000001 file by: My spouse on behalf of Me.
This case is now enrolled in the Electronic Processing Program.
The additional email address submitted with the enrolment email were added to our records.
Please not that all forms and documents that we requested and require in the future must be scanned copies of the originals. The applicant must present all original forms and documents to the consular officer at their visa interview. Failure to present the required originals at the visa interview will result in a denial or delay in obtaining a visa for the sponsored applicant.
As this case is processing electronically, all forms and documents most be sent via email as scanned attachments to NVC....gov. Sending physical documents to the NVC will delay the processing of your case.
Case Number: MTL00000001
Petitioner's Name: Spouse
Principal Applicant's name: Me
Preference Catergory: IR1
Your Priority Date: 05March2014
Foreign State Changeability : The Country I was born!
Invoice ID Number: 11100000
U.S. Consulate General
1155 Rue St. Alexandre
Montreal, QC
Name
NVC
This email is sensitive .......

I am wondering two things NLR, one, they used the Foreign State Chargeability as the country I was born (Honduras) but the biometric page I submitted was from my Canadian Passport, as my Honduras passport is expired. I am wondering, whether I need a new Honduras passport? My Canadian passport is expiring in Summer 2016.
Then I google what the Foreign State Chargeability is, and I found this on the USCI website:
The independent country to which an immigrant entering under the preference system is accredited. No more than 7 percent of the family-sponsored and employment-based visas may be issued to natives of any one independent country in a fiscal year. No one dependency of any independent country may receive more than 2 percent of the family-sponsored and employment-based visas issued. Since these limits are based on visa issuance rather than entries into the United States, and immigrant visas are valid for 6 months, there is not total correspondence between these two occurrences. Chargeability is usually determined by country of birth. Exceptions are made to prevent the separation of family members when the limitation for the country of birth has been met.
Since I am a naturalized Canadian, would my visa be delayed because I was born in Honduras?

I sent all in one email. I checked after, and it says the email was 14.5 Megabytes in total, but yes each attachment was way under 5MB...
-
There wouldn't be a way to find out if the email went through, is there? I mean, it would be nice to at least know the email is there. Like maybe, a receipt email, saying that they got it. Or maybe a sign.. I keep checking the Visa Log in website, but still says N/A for both sections AOS and Civil Documents..

I don't think the scan date is important, unless there is a reason I should know! But yes I rather wait (although the waiting part it hurts my guts).
-
Thank you, it means a lot. Specially going through the process by ourselves is more difficult to figure out. Now that the AOS and Civil Docs are sent (by the way, we chose to emailed them at last minute) I've seen people say to constantly call NVC to see if they have them, I am not sure whether we wait the 45-60 days before calling...Let me know!
-
yeah, I was just wondering if we should send the DS-261 ourselves, with my spouse as the agent, since we don't have the lawyer anymore. Although we did sent the email they suggested we should send, updating with the information already... so like you said. Just making sure we don't forget anything, thank you NLR.
-
I am not sure, but I think it worked for the best for us. In a different topic, when we called the NVC a little while ago, we told them we have fired our lawyer, and they said to send an email to NVC stating that, and also saying who the new agent will be, in our case my spouse the petitioner. Is that all there is to do? Is not like we had to send the form DS-261?

I find this thread very helpful.
Duvalin, we're going through the same situation. Putting house on sale next month, will move to a rental until the interview.
Duvalin why did your I130 approval take so long? 8 months? Did they RFE you?
Based on what i'm seeing on the timelines, it seems ours shouldn't take more than 2 months, but I guess USCIS is unpredictable.
Hi there, I am not sure why ours took that long. Our i-130 didn't have anything in particular. But based on what I read approvals for i-130 fluctuate, but I am not sure why they do.

Hello there, this is amazing. I had not idea you get to choose the date for the interview. With all my readings, and i must say, I might be wrong, but isn't the consulate who tells when is the interview is after they review the documents? Anyways I wish you for rather fast appoiment for your interview!!
-
I just noticed that in the NVC website the review time changed to 45 days! Before it said 60 days... Anyways, if that's the case maybe emailing is better then since now is equal? One other thing , do I enclosed the welcome letter NVC sent? At the time, we had a lawyer, but we fired him. So I am wondering if I send the original welcome NVC letter, the letter has the lawyer information, and I think it may create confusion. Do I need to include it or just the receipts that we paid both fees is fine?
-
Ok, thanks!! one little thing before I send them away, do photocopies have to be certified?
-
Thank you again for clarifying all!.. Today I got the RCMP police reports in the mail! so I am only waiting for translations from the multicultural office. I am going to mail them, via FEDEX or does it have to be regular mail? as well, we got the photos done today, my spouse came for the second truck load of stuff and while he was here, we went and got the photos done. I am wondering what information to write in the back of the photos, name, and case # would be enough? and if we both need to send two pictures each? Please let me know. Thank you!!

Sorry again, for some reason I have all of these questions all of the sudden?... I got thinking, when I submit the docs to NVC, this week, do I have to send proof of his new residency address, to make sure they know that he already has moved there? In the DS260 and affidavit of support we wrote down the new address in the US which is where he just moved today.
I am also concerned that the last 3 year 1044 tax forms shows that he was living in Canada. Now that he has moved, would they think is ok? Would writing a letter saying that he lived in Canada for the last several years, but now has moved to the US to establish domicile etc, is that necessary? He kept everything back in the US, bank accounts, etc in a PO box, should he change all of his address to the new house? Again so many questions for one night? thank you NLR.
-
Also, NLR: when we called a few weeks ago, they asked us for our email address, and when we paid the fees online we entered our email address, does this means that we have already chosen the email way of communications with them, I am just a little confused. And, should I go to the Police Station instead and get the normal police records? Thanks.
-
Mailing it would be faster? wow, didn't know that, thanks! And I don't have any crime records, I just asked the local office, its called the Commissioners, and they told me that if I went to the Police Station or the RCMP they would refer me to them for finger prints. So I was a little confused, when they said that.. I hope is ok.

That's good to know! Thanks! We have been packing all weekend and been busy taking care of that. He crossed the border today, and he is unpacking almost everything in the new house. One or two more trips to go... It's so odd, the story repeats again. He is texting me pics of where stuff should go in the new house.. Similar thing happened 10 years ago..
Tomorrow we take the pics for the visa, which we will be taking ourselves. then, I am still waiting for my fingerprints results from the RCMP and translations. After all in hand, I will scan it all and send it via email, which I wonder since my case starts with MTL, it says I get to choose email or mail? Is there somewhere where I get to choose or automatically is chosen once I email everything? Thanks again for this help! Through this process!
-
Oh, I see. We will make sure to ask our tax account to make sure we don't run into anything regarding the sell. Thanks for clarifying!
I have a very different question in regards to the translation of my support documents (birth certificate, police reports) if you don't mind..... I took the documents to a local multicultural council where they offer the translation services. They say they print an affidavit along with the translated documents stating that it's a true translation. And a logo / seal of their organization. I wonder if this would be good enough? Because they asked if it need it to be a certified translation they would have to send it out and it will take much longer.
-
Ok we will find out. What do you mean a tax issue?

Our area is pretty fast, houses last barely a week or two. The house next door sold in one day! But is early Spring and that's probably why. How would it be in the Summer months, maybe the same. We are not sure whether putting our house for sale is relinquishing residence abroad or if it is necessary for the interview at all, what do you think?. Should we just wait until after the visa approval to list since he has already move to Michigan? or should we definitely list it before?
-
Hi there, thanks again for the guidance and help! It really means a lot. My spouse looked for houses for the last week and half, and just found one a few days ago. He signed the lease yesterday and took position of the house. He is moving to the U.S. on Sunday.
Now I think what is left is to list our house here in Canada, but we are not sure when should we listed. We were talking last night about it and maybe it would be a good idea a month before the interview, or so. I am really wishing that this part doesn't take too long, after we submit the ds260 and supporting documents, is there an estimate with Montreal? And is there anymore type of proof we should think of to take with me to the consulate so there is not questions at all about domicile? I was thinking he could keep records of the import forms he gets at the border when he crosses on Sunday...
I have to say, this is so stressful! ?

Hi NLR, Happy Easter! I just thought I update the tread and say that I filled the application this weekend. And also we found out that a co-worker from my spouse, has an empty second floor at her house that we thinking this may be a good option for us, if we don't find an apartment before. In the application though, they asked for my spouses address, and we put down the mailing address for now, which is a po box in Detroit, and his current address, the one of our house here in Canada. I am just wondering if that will be clear to them, that we are together right now, but he will move to Detroit and I will followed after my visa gets granted.
Also, for my address in Detroit, I am wondering if I can use my spouses mailing address for mailing (po box) my residency card? or can this be change later on, let say we decided to move into a different apartment in the mean time?
-
I see, it almost seems like we are trying to trick them to think that we just move to Detroit to prove domicile right before the interview, no? I just can't wrap my mind about, why would we be applying for a green card if we were not moving to USA??? Do people apply just to have a green card? I don't get that part.
And your reasoning for my spouse being there in Detroit makes total sense, but you say be careful on taxes and selling our house here in Canada, what do you mean? If you refereing if we have been paying taxes, we have, for both countries! and we started to pay taxes as a married couple just last year (taxes 2013) because we weren't allowed by the goverment before. And about the selling our house, I think we could put it in the market like you said before, and hopefully sells just in time, for when we have to move. Or should we wait until we moved to Detroit?
My spouse will talk to his boss today about the transfer and see if it can happen sooner, but will see, we have been trying for the transfer for a while but I guess it hasn't worked for us just yet. Its complicated I guess, you can't just say "hey I am moving, see you"
can't thank you enough!
-
Yeah I sympathize with you, and sorry to hear that you two have had to be separated! We had to deal with separation ourselves too and it wasn't fun, it was a while ago for two years.
I have to agree with you with the idea of moving back to Detroit and waiting there while we can transfer / move to California, but then I thought, wouldn't the officer in Montreal think: " wait, you are reuniting with your spouse in Detroit, just in the other side of the river???" I wondering if the fact that we live in a Canadian Border town with the US, would in fact that be a factor for them to think that we are not being reunited really? He commutes to work everyday from our house, so he actually expend most of the day at work in Detroit. I'd like to hear what you think about that! Thx!!
June Interviews for Canucks - 2015
in Canada
Posted
Hello guys, just curious and mostly hopeful. We sent our AOS and civil docs on the last week of April and received two emails from NVC: 1. Enrolment for online processing method welcome email, and 2. Saying that it will take 60 days for review our docs. One email following the other on May 1!
I called NVC, and the lovely lady said quote: oh by the way, it will take 30 days to review your case, not 60 days like it says in your notice.. I was over the moon, although I couldn't express my feelings for some reason.
So my question is, would it be possible for us to get an interview for June? Or how long does it takes for interview date after they review documents?
Thank you guys.
