  1. Having land and two us citzens doesn't suffice a bonafide proof of relationship. Show proof of regular money transfers, old and new pictures you guys took together, and if you make regular trips home you can attached border passings or airtickets. Also, for African Countries were traditional wedding is recognised, show pictures of traditional wedding activities that went on even in your absence, but in the presence of your family. These evidences will never be disputed by any CO

Of course I sent all those things and more. Those are basic evidence that every marriage people send. Your statement really makes no sense. What else makes a marriage more real other than having children? Having children with the one to whom you are married pretty much means you are serious. I sent more than 300 pics and 1,000 pages of Facebook, tango, and whatssapp chats. Plus so many more evidence. In fact, I sent too many stuff.

  2. Petition will be returned and petitioner will receive a NOID/NOIR letter and then you have a second chance to submit more evidence.

If USCIS finds that your new evidence is sufficient they will send it again to the consulate where the CO will either approve the visa or refuse it

again. Most likely they will approve it at that time. Post again when you receive the NOID/NOIR letter. Sometimes the petitioner does not get a letter

and USCIS sends the petition to the consulate without it with recommendation to approve. Good luck.

Thank you. How long does it take to get the NOID letter? And I've also heard that they send it to uscis so it can expire, how true is this?

  3. It says her documents lacked specific evidence to make a final conclusion and was told to bring the requested documents on jun 22. I have some questions.

We have two children together who were born in Ghana and both of them have received their birth abroad and are American citizen and have American passport. She presented them with these evidence. But They Are requesting for more photos, communication history, chat record, emails, and phone call records. Each one of our child required an interview before they were granted natural born American citizens so I don't know why they are giving her a hard time now. Can they deny my wife who has two American citizen children a visa? If so, on what basis?

They also said I need to do another i864, so I'm using a joint sponsor who's makes well more than enough. But what happens if they are still not satisfied with my i864?

She said that the officer who interviewed her was so rude and looked unhappy. Her initials are KM. Is it common for the accra embassy to request for more evidence? I've been reading a lot of interview experience on this forum and it seems like most people get the 221g on their first interview.

I need someone who is a Little knowledgeable to answer these questions because I am a little concerned. Thank you.

  4. I haven't worked for the past 3 tax years because i have been a full time student. i live on the Veterans Affairs (VA) GI-BILL housing allowance and the VA disability benefits from injuries during irag deployment. I easily meet the 125% mark and i have sent my gibill payment letter and disability payment letter along with an explanation on why i haven't filled taxes and the irs publications supporting it. I have been approved by the NVC and my wife will be going for her interview in ghana in less than a month. I'm worried that the interviewer may request for a co sponsor due to the fact that i have not worked, even though i meet the 125% line. my questions are :

will the visa officer request for a co sponsor just because i do not work even though i meet the requirements?

Should I be worried about this Prospect?

    Thank you.

  5. my brother and I got case complete this March 12 and we already hav our interview date ..that is in May..hpe u get urs soon

That's nice. When did you get your interview date?

It looks like Ghanaians who got case complete in March are still in a queue waiting for the interview date..You are not alone...I am also a victim. No one knows why. But hold on, you are almost there there will be light at the end of the tunnel.

Thanks but i figured i should have gotten the email by now. Because about a week again they said they were scheduling interviews for may.

  6. They may not know this necessarily. The reason is because everyone has a different tax situation. You can have income that is taxable or nontaxable or both, but because they are another federal agency, it's not really their job to know what income is taxable and what isn't.

That is why they ask for the explanation and proof. You are already one step ahead of what I was going to say because you already know what publication is it that your exemption falls under.

So what you do is write the letter explaining that: "Per the instructions of the I-864 I am writing this explanation for why I haven't filed taxes for the 3 previous tax years (2013, 2012, and 2011). As you can see, my only source of income is such and such and it is nontaxable under US tax law. In IRS publication 575 you can find that the benefits that I receive are fully nontaxable. Additionally, I am including a copy of the part of the publication that proves this exemption. As such, both this letter and the proof of exemption should explain that I am fully exempt from filing a federal tax return because of the kind of income I receive."

You would include the front cover and the relevant page(s). You must explain clearly in the letter that this is and was your only source of income for the last 3 tax years and that you are fully exempt from filing tax returns because the income is fully nontaxable.

Read the instructions for the I-864 on page 6 and you will see this info there. I know that you don't want a delay, but I guarantee that you will delay your case if you don't send the above explanation and proof of exemption.

Again, I cannot stress enough that you have to be very clear in the letter about your income and that you are fully exempt because sometimes people still receive a checklist because they fail to properly explain what the exemption is and how they qualify for it.

In this case it's pretty simple because it is your only income and it is only from the VA, but you have to make it clear. Trust me, you cannot assume that these people know what they are doing half the time.

Thanks a bunch. I called them this morning and they said that i would get a check list if i don't send them a letter explaining why my income are none taxable. I'll Will Make Sure to strees That Those Have Been My Only source of income since 2011. Thanks a lot for the information.
