    Anwser to Q1.
    I had a friend who boyfriend came over here on a tourist visa. They ended up getting married and he end up staying. Because if he was to have went back to his country he would have got stuck over there. So he just stayed here and she filed her I-130 and the AOS at the same time and he was able to get his social security card, green card, and a travel permit.
    Q2.
    I have no idea on this question....Sorry.

    It is not when she filed her spousal visa, but when she got remarried. If she got remarried while still legally married to her first husband, that is bigamy. 
    OP, why don't you just ask your friend to come in here and tell her story?

    Exactly what I was thinking when I read this earlier on my phone and I couldn't respond earlier. So what the OP needs to do is to go ahead and get actually married again because the first one did not count at all unfortunately. The OP is stuck in a catch 22 so to speak so they just need to get married again and file for the CR1.

    The issue is not whether the decree was in the package when she filed.  The issue is whether the woman was "free to marry" when she married the Nigerian.  Divorce is controlled by State Law.  USCIS knows that.  If they ruled she was not free to marry, then they will not recognize the marriage.  They will need to legally marry, then start a spouse visa case.
     
    I know this sounds a bit crazy, but we often see cases where a couple is "too married for a fiance visa and not married enough for a spouse visa".  This is one of those cases.
     
    How to marry in Nigeria when you are already married under Nigeria law, is another matter, about which they will need to inquire in Nigeria.  It could be a "Catch 22".  Google it.

    YES!!! I honestly feel that her lawyer at the time screwed her and didnt do thier job correctly.

    no, married is married no matter where. They got very very bad advice in 2015.

    She could not have legally being married in 2013, because as she later found out she was not officially divorced at the time of the second marriage.  I suggest she just 'get married" and because that first marriage is null and void....is not recognized.  
    GET married, apply, and send an explanation  at some stage in the process , and prepare to address any other question they may have.  If everything is above board then it just delay not the end.   Good luck to your friend.
     
    A lawyer may just make it smoother too.

    Hey Everyone
    It has been a while.. Gosh.. Well hubby has been here since February 3rd. We moved to Kentucky. He just started working. My son finally got to meet and spend time with his dad. The fight is not yet over as I had to refile for my Step-daughter (didn't know I had to do them separately) so we are in the USCIS process... uuughhh. Hubby's SSC and GC came in within a month. things are going better.. thanks so much for your help everyone. this group kept me sane.... much love to you all.. and to everyone welcome to the USA, and Hang in there Mrs. Brown I am praying for you and you will get it dear...

    Been in Michigan since September, working in my field since November and am enjoying life. The winter wasn't too bad but I am still glad warmer days are here! I coach soccer after work every day and I am really enjoying that experience and the kids are all great!

    Aaron are u sure? I'm so scared and don't want to mess up again. They didn't ask for drug tests or anything because his test result was negative. They jus said when the ban expires....email them for another interview and schedule the medical.

    Oh wow ? yes I would be ranting about my money too. Cause they added 12 extra or 10 extra days on to your stress and process lol. I wish you and Yoel gud luck on you'll process. I'll be checking in on the thread every once in awhile to help if I can.

    Welcome to the Nebraska filers, you just filed and have quite a bit of time ahead of you. But don't get discouraged in the process control it at all times lol.
    But I found a real good forum that was just for my month that I filed in. An we became a family group that helped each other out along the way in the process. But I went watched alot of other ppls timelines that was close to mine (Country,dates,service centers, state I lived in). Just to see how they processing was going.
    After a few months I can go to the timeline section in the menu tab and see what dates the service center is working on. I wouldn't do it now cause it's to early and yall start getting nervous I promise lol. So Gud luck

    Once your I -130 was approved it canceled out the I-129f. Now you have to wait for your case to get sent to the NVC. they say it takes Anywhere from 21 to 30 days for them to receive your case and assign you a case number.
    But congratulations on your approval.

    Did you have to have a certain amount of money in your account. In order to aa apply for the B1 visa. Are does it not matter if he do or don't.
