Ive posted about this issue before. Most family courts will NOT change a minors last name to give the minor the 'new' last name of the mothers new husband (or vice versa but its typically mother with new husband rather then father with new wife taking wifes name as family name)

The reason for this is courts consider it a 'benefit' (everyone sharing a family name) with out any of the responsibility that would come if there was an adoption. Now everyone has the right to apply for a name change for whatever reason they want BUT the court does not have to approve it. And again like I said courts rarely change a minors name under these circumstances. Its usually only when there is some kind of extraordinary circumstances.

So my thoughts to you is to go down to the local court that would be doing the name change (or call but in person is usually better if possible to do such). And ask them specifically if you pay to file this what are the odds its going to be approved? You may get a generic response because as I said you are allowed to file- they dont want to be portrayed as discouraging someone from filing- so you may have to chat a bit with them 'off the record' about how often in general that court does name changes like this before sinking the money in fees; and then probably whats worse then that would be the anticipation of thinking you can do this/telling the kid/going to the hearing and then being told no!  So please check with the local court for info.

yeah they know already that we are planning to do the adoption coz we have some friends in our courthouse here but oh my gosh it just soo expensive some state allow diy adoption but not in our state . The attorney told us you just better to do the name change and save that money for adoption on her college fund. if any one wanted to file stepparent adoption in the future theres an fb group for that just look for it. Thanks to everyone.

Name change for a child has to be done in court.

It is not the same as a spouse assuming their spouses name. It doesn't change their name on their BC. But for a child that is not an option. The parent must petition the court as it is a full legal name change.

If ppl get divorce a spouse can go back to their maiden name as it was just an assume name. (still a legal name but not the same as petitioning the courts).

yeah thats what my attorney said to file in court cheaper than adoption..

  3. hi there, anyone successful doing name change for a minor under k2 visa? My daughter shes 11yrs old we wanted to file for adoption but there is  one lawyer suggested to us do the name change first if that isthe main reason of our adoption which is yes. He told us to file adoption when shes already 18 which is way more cheaper and doesnt need any consent just hers. Adoption here in our state cost 3500 even the fathers name not on the bc and include alot of paper works.. im in the process of naturalization.

Hi everyone! Early Feb 2017 filer and lurker here... I got my green card production notice on July 7 and notice of approval on July 9. I had filed with CSC and got the infamous "Case Transferred to Local Office" notice back in February 2018. We were not asked to appear for an interview.

I have been overseas for about 6 weeks, and I had gotten a travel stamp in my passport at my local service center, as a precaution. At that appointment I was told the case was still within the normal processing window and as such there was nothing to do but sit and wait.

I wish everyone patience and the best of luck! Hope you all get notices soon!

hi may i know what is your series? mine is wac17144 i got the same notice as yours in feb26 2018..

  7. Wish you have check your status first before ticking you are divorce. Now you need to explain this to a consul and you need to provide a certificate that you are single and free to marry. Me and my daighter got here in the US March so we just waited to next school class opening. We took her vaccine record to our public health in our county once the school started to ask about it. By the way my daughter got positive skin test in mycountry so when we got here the public health kept sending us medicine for tb i think for 6 months even her xray was cleared.

I would probably try to consult with an immigration attorney with years of experience to see all all the options on the table. Then, like the officer suggested,  I would get ready to fly there and prepare a CR1

Haha i saw ur reactions to mycomment, everytime i remembered those days i kept laughing too.. I put all my powers to that interview just glad my daughter found a friend inthe embassy and they just keep running inside the embassy while everyone was nervous.

  9. Im just reading thefirst part of your story. Im guessing already, this must be philippines. Im k1 k2 too, got approver after my interview. I dont think they can be judgemental there. It just maybe some of the questions to

your fiancee didnt meet the answers  they  needed. The questions were always  tricky.

Some are simple some are not. My hhusband   visited us many times before we filed the petition and due to my annulment. I brought like a bag of evidence of our relationship and the guard kept laughing at me and even asked me if i forgot some more evidence in our house i said yeah i forgot those stuffed toys my fiance gave me... Weve been patience to our k1k2 journey but everything worth it. Goodluck to you and to your fiancee.

I am wondering the same thing. Even though I got those updates saying it was received at the local office, our case was never actually transferred and is still in CSC. It seems like the people whose cases were transferred have gotten approved, but not anyone still at CSC. The dates I see are November & December maybe  1 or 2  January.

We gona get our approval in mid june til month of july.... Its coming...
