  1. When did you finished your ds261 and paid your AOS fee? you need to wait for NVC to review your ds261 before they could send you your IV fee invoice. better to call NVC to let them know that you're done with ds261..

    D261 was completed 2 wks ago and paid AOS fee last week..

    Thanks everyone.. I should probably call nvc tomorrow.. I thought both will be available at the same time.. I am planning to swnd civil docs and financial evidence at the same time to the nvc

  2. Agreed Mom has to submit a I-864 as the petitioner even though she is not working. It seems daughter and mother are household members so she will had to complete a I-864a only allowing use of her income to sponsor. if not a household member daughter will only need to complete a I-864 as a joint sponsor.

    Mom and USC daughter are in the same household. So Mom needs to fill up I-864 and USC daughter needs to fill up I-864A? right?

    the mom as the petitioner, MUST fill out the i864 even if she makes $0 income and attach a letter explaining why isn't she required to submit taxes

    her daughter can fill the i864A or another i864 as the joint sponsor

  3. here's the situation:

    Mom is LPR for a year already, no job just staying at home with grandkids. She petitioned her minor daughter and now it is approved. Mom is living with her USC daughter and plans that USC daughter sponsors her sibling as mom doesn't have a job. So who will fill up the form I-864? Should mom fill up the form or the USC that will sponsor the beneficiary?

  4. im really freaking out now!!:( im not even sure if my fiance can have his passport by the of the month!!we have the our case number but we cnt do anything yet bcus of the delayed!!:( they said 10 working days !doubt it!!:( what else can i do??can he apply to another location?or can he go to manila and process a new passport?

    Let your fiance call the dfa branch where he applied for passport,call them constantly to follow up.

  5. I agree on all of the above.. The sad truth! What can we do? Nothing! That's why I am not looking at my tax deductions, it makes me upset. Government services are soooo unreliable.

  6. this is sad though, people pay exact amount for the service, and they can't give you exactly what you need n timely manner. money can have their machine fixed and or build new facility, hire new people etc. everything is delayed in the Philippines, i was hoping DFA will be an exemption. Driver's license card is delayed for up to a year and others are years, sss card can be obtain after 3 months same as new philpost id and the list goes on...

    When i did mine was 7th of aug. And got 7th of sept. But yesterday i check all the branches again Still available dates are 24th of september already but i go back again to Aseana then i saw 27th of Aug. So i just click it immediately.

    My appointment is Aug. 7th now. Got reschedule.Maybe you can check and see maybe you got an earlier date.

    i will check but the thing is, we already booked airline and hotel for him and both can't be reschedule because both were on sale..

  8. Just mailed off my I-134 Affidavit of Support and a new Letter of intent to my Fiance in the Philippines. I used LBC Express to send it, much cheaper than Fedex. $15.95 to send a 1.6 LBS packet of documents. I was just going to send the signed forms and have her print out the rest but it was only $5 more to send the whole packet. FedEx wanted my first born and half my paycheck. :ranting: LBC Express has about 60 USA locations I think, I had one about 30 minutes away so I was lucky. I scan and upload all my documents to a PDF file to Google Drive for my fiance to share. Now the waiting to get the MNL#... Good luck everyone.

    that's a good idea but I am probably 5 hrs from LBC branch... Fed EX cost a lot of money..

We're including her employment letter since her salary last year is low and would not reach the income requirement in the poverty guidelines which is also reflected in the ITR and W2 if I'm not mistaken, do correct me if I'm wrong. This your though, she is already earning more than the income requirement and the only way to prove it is using the employment letter and the paystubs.

    She did not file income tax return 2 years ago since her net income was very low (around 300$) since she was only per diem that time. We'll probably just include a letter of explanation for that. With that in mind, do we leave the fields blank in the I-864EZ part 5, numbers 6.b and 6.c? This is the part where total income as reported by federal income tax returns for the 3 most recent years should be placed. We can only fill up the most recent year and the income she got last year is less than the income requirement so should we also include that and also provide an explanation for it?

    You may include all the paystubs from the job she has now since she started this year and as you said she is already above the poverty line.

    You don't have to explain that.

    please check the instruction on how to fill up the form because i am not sure, I don't know if you have to put N/A or leave it blank when it is not applicable to you.

    If her income doesn't suffice what they need, you and your wife may need to have a co-sponsor.

  10. Topic line was used only to grab your attention thank you :) my bf is perm resident and I would like to move to be with him. We live in Canada together but he works in USA. My question is should we have an migration lawyer handle this or is it easy enough for me to do myself. How long will it take generally to be able to move there. I visit him there on a regular basis.. should I assume it will be more then a year? Any advice is appreciated. I dont mind spending money on lawyer. Thank you

    Also- am I able to stay in the US as a canadian while I wait for visa to be processed? This is the most important question..

    only US citizen can petition foreign fiance/fiancee

    Permanent resident can only petition spouse and children..

    My wife started working per diem Aug 2013 and that's what we indicated in the I-130. Right now we're gathering docs for AOS and that includes the employment letter. Her employer indicated there she started May 2014 since that's when she got transferred to the department where she worked more hours (like 3-5x a week for 8hours). Would that be a problem in NVC? Do we have to put an explanation in the AOS package?

    In the i-864EZ form, part 5 to be specific, there are fields there for the 3 most recent income tax returns, does that mean it is required for the petitioner to be working for 3 years? Do we just leave the other fields blank if she only worked for a year? If we leave it blank, do we have to provide an explanation for that as well?

    It is not really necessary to include employment letter with your AOS, You just need to put your ITR, W2 and paystubs i think 3 months worth.. If you will include it and date is different with what you put on the papers you may have issues with it in the future. If it is possible to have another letter from her employer that states she already worked per diem since aug 2013, it would be great.

    Do you mean your wife did not file income tax return few years back? if so, you may include letter of explanation stating she was unemployed between those date that is why she did not file itr. It is better to be overly prepared.
