  1. I am new to this forum, I've been asking questions and getting some anwers...thank you so much! I am also browsing through many other threats to see what information I can use and I have come across to many , way too many sarcastic replays. Why? are they necessary? why moderatos allow that? who gives power to who here? isn't this place to ask valid questions without being made fun of? is this a safe place to get some real help to go thru such hassle process? please please do not make offensive remarks to others, they don't help. If you don't have the answer to the questions just don't post anything. Thank you

  2. If you received ANY public assistance, you need to say so. ALWAYS be honest!

The question isn't asking if you received assistance that is considered a public charge, it is just asking if you have received any assistance. They will already know whether the assistance you received is acceptable or not (meaning whether or not its considered a public charge).

Thank you Zedayn I will comply answering the truth

  3. I will answer YES and I will write a letter giving information about it. I will contact the agency who proved the benefit back then and will comply. I want to do things the right way, I have nothing to hide and like everyone here I do not want to make mistakes. This is why I am here asking questions. Thank you to whome took the time to reply and help.

  4. Why do some lawyers give such inept and flat out bad advice!

Do list your self-employment and it's even better that you actually were declaring the income! Being honest is the only way to go.

I know!!! when I told my husband about it he nodded his head and he told me to keep asking questions because none of that made sense. So I asked another attorney in the website and guess what??? he advised differently on each question than the first I asked! more accondingly what other memember here have been advising

  5. so maybe this website is only milking $ out of people without caring to be professionals?!! I just signed up and I am on a week free trial and I think I should cancell before they start charging me the montly fee.

I had even mentioned in my questions that I understand I need to answer with the truth and that is my soley intention, his responses are " in my 12+ years of experience in immigration I advise the same to my clients and never had a problem"

Now my husband and I had paid $250 and $300 to two different Immigration Attorneys as a first consultation to start the process and after explaining my situation -without going into details like this when they arise at the time to fill up the forms- BOTH! a agreed that my case is so simple ant we should be good filling ourselves, or hiring them. That was from two different attorneys and we def appreciate their professionalism to talk to us with the truth. So we opted to save $3,000 and file on our own and here we are facing different questions on some of the forms and of course we don't want to screw up.

Thanks for responding Harpa Timasah I do appreciate it

  6. You mean this thread here? You had an answer in just over an hour.

Thanks Teddy, no that is not the thread. Is this one, so now I am breaking it down in a question per thread and now I am getting help. I understand people don't have much time to read long posts so I try to keep each questions to the point but giving as much info as possible

  7. in the form I-485 AOS Part 3 C) #2 Have you received public assistance in the United States from any source, US government, or any State, county, city, or are you likely to receive public assistance in the future? *I DID RECEIVE WIC when my son was a toddler now he is 10 yrs old, I do not remember the exact dates but I could come up with an estimate period of time, do I need to write a separate letter explaining this situations? how critical is this information? This is the only question of this part that the answer is YES.

Please advise what is the way to go in this question. The Immigration Attorney at www.justask.com adivised to answer NO, but again he advised to not report my job history including the current one and I am not sure he is giving me the right advise.

    Thank you

According to USCIS receiving WIC is not considered "Public Charge" : Quoting from this link

    "

    Q. What publicly funded benefits may not be considered for public charge purposes?

    A. Non-cash benefits (other than institutionalization for long-term care) are generally not taken into account for purposes of a public charge determination.

Special-purpose cash assistance is also generally not taken into account for purposes of public charge determination.

Non-cash or special-purpose cash benefits are generally supplemental in nature and do not make a person primarily dependent on the government for subsistence. Therefore, past, current, or future receipt of these benefits do not impact a public charge determination. Non-cash or special purpose cash benefits that are not considered for public charge purposes include:

    • Medicaid and other health insurance and health services (including public assistance for immunizations and for testing and treatment of symptoms of communicable diseases; use of health clinics, short-term rehabilitation services, and emergency medical services) other than support for long-term institutional care
    • Children's Health Insurance Program (CHIP)
    • Nutrition programs, including Food Stamps, the Special Supplemental Nutrition Program for Women, Infants and Children (WIC), the National School Lunch and School Breakfast Program, and other supplementary and emergency food assistance programs
    • Housing benefits
    • Child care services
    • Energy assistance, such as the Low Income Home Energy Assistance Program (LIHEAP)
    • Emergency disaster relief
    • Foster care and adoption assistance
    • Educational assistance (such as attending public school), including benefits under the Head Start Act and aid for elementary, secondary, or higher education
    • Job training programs
    • In-kind, community-based programs, services, or assistance (such as soup kitchens, crisis counseling and intervention, and short-term shelter)
  8. I have l-94 issued on POE in el Paso TX with stamp with date and time as well as in my passport. Visa was F1 and expiration date on I-94 is D/S. Then my ex husband I went back to Mexico for few days but flew back to US specifically to Houston where we were living. It's been more than 10 years and I do not recall details of that entry but I used my F1 visa to enter ( I also probably showed I-120 forms as well) but I do not have any stamp on my passport that confirms that last entry nor they gave me another I-94 -which I do not know if it was necessary since I had a valid one and we went to Mexico for few days only-

Does anyone know if I-94 are issued on PO in airports? Should I have gotten at least a stamp on my passport when I entry that last time?

    Thank you :help:

  9. Thanks! I appreciate Angel's response to one of my questions I figure post independent from the original post where I asked several questions, and no I have not gotten any answer on that one. But I figure if I ask one by one in different post they might be noticed rather that having them all in one single post, I guess is too much to read for ther memebers and rather scroll down ..LOL

    Thanks again!

  10. Thank you for your replies. I've never claimed to be USC and never used anyone else's SSN, I have my own which is valid as well as a DL. In my SSC there is a annotation saying that I am not allowed to work without INS authorization.

Years ago applied for a work permit while I had the F1 visa due economical hardship, the counserlo at school helped me with the process. I had just gotten divorced and I not longer had a sponsor which was my ex husband. It was a very difficult time emotionally and financially. I was denied and I have the letter from INS ( INS back then)

In one of the forms to apply for the green card I am asked if had applied for work permit in the past, so I should answer YES in this part and send a copy of the dennial letter I received?

    Thanks again.

  11. I have been out of status for 7 years and getting ready to send forms for AOS after I got married 5 months ago. I have been working independently all these years and my current job is a contractor for the City and I had paid taxes every year. Now that I am married my husband and I filed taxes together including my income of course. I ask to an immigration Attorney online from justanswer.com and he advised me to leave the spaces blank and not volunteer any information saying that they won't deny me for leaving them blank of for working when I am not allowed yet I have not being employed by anyone but work independently - but paying taxes-.

My husband wasn't too sure about doing this and asked me to keep inquiring about it. What are your toughts?

    Thanks in advance

G-325A Biographic Information - Applicants last address outside the US of more than 1 year. Should I answer with the address I lived all my life until I moved to US or the address that my ex husband and I declared when we applied to HB1 and H-4 visas which is his mother's address?

    Applicant's employment last five years

Since I had F1 visa and not authorized to work, then I went out of status, I had to make ends meet and I opened a home day care for 3 years then closed it. Then for about 4 years I cleaned houses, sold stuff online, gigs here and there and shared expenses with room mate. Last year I nailed a part time job as a contractor for the City of Houston as a registrar and is my current job. How would list this employments will affect or could affect the process of getting a green card?

I-485 AOS Part 1 ) Information about you : current USCIS status: since my F1 is expired should I answer OVERSTAY?

if so, what to answer on EXPIRES ON (mm/dd/yyyy) D/S as the F1 I-94 shows?

( ) An immigrant petition giving me and immediate available immigrant visa number that has been approved ( attach copy of approval notice, or relative,..etc) IS THE MARRIAGE CERTIFICATE THE PROOF OF RELATIVE I need to send with this form?

    Part 3 -A )Processing Information

---current ocupation. I have a part time job as a contractor for the city as a registrar...should I mention this even when I am not authorize to accept a job in US under the visa I was under last?
