  1. Overstaying is not illegal. Entering the US without inspection is illegal because you will not be allowed to adjust status in the USA. Since she is in a genuine relationship, she can get married and adjust her status ASAP. You can also travel using your passport domestically because TSA don't look at visa. They only verify information looking at the biographical page of your passport.

  2. http://www.uscis.gov/i-864p. Follow this link to know the poverty guidelines. Since both of you aren't working then your wife Dad can serve as a joint sponsor. He must meet the poverty guideline tho. He will need to give you his recent federal tax return to be photocopy and sent along with the I-864. You also need a letter from his employer stating that he work with them along with at least two months recent pay stubs. If I am missing anything then some can include it.

    My wife w-2 show that she makes above the poverty guideline. I submitted my I-864 with recent tax return and w-2. I also, included letter from her employer to her last year indicating wages increase. I never included letter from employer stating current employment and never included recent pay stubs as well. Now, she has left the job and trying to find another one soon because of her boss. My question is, is there a possibility that I will get an RFE even though her w-2 show sufficient income? If I get an RFE how can I respond to it? Should I start looking for a possible joint sponsor just in case things go the other way?

  4. Technically it's not required. W-2 and recent tax return documents should be enough to proof your income. If they need additional proof they will request it. You can only prove income if you believe by submitting those document will help you maintain sufficient income. Such such documents include child support, alimony, letter from employer and pay stubs
