  1. You can file a 1040x (an amendment) and bring a photocopy of what you send to IRS along to the interview. All they really care about is the numbers so as long as the income number is the same on the 1040x as what you submitted to NVC then you will be fine.

    On your 1040x all you need to change is the status. The easiest and quickest is to use Married Filing Seperately and put NRA (non-resident alien) in the SSN box. You could do this today if you wanted to. Just make a copy and bring along to interview.

    As I said they are only interested in the figures, so make sure these are the same.

    I'm also sure that they will be flexible with photocopies instead of transcripts in the months of April and May because some wont file 2013 until the last day (April 15th) and transcripts are not available until the return has been reviewed by IRS.

    thank you for the infos. I know we will get as much $$$ if we file MFJ but I guess we don't have a choice but to go with MFS. what's the difference between the 2 in terms of money thing??? anyways thank you again and you're a big help. God bless :)

  2. The moment you get your refund or payment is processed the transcript should be available online to print.

    As Saylin says in her NVC guide :

    "As the petitioner, what filing status do I use for my tax returns?

    You have three options: married filing separately (MFS), married filing jointly (MFJ), or head of household (HOH).

    For HOH, there's some criteria you need to meet to be able to use this. Please see the IRS website for more information.

    For most people though, it's either between MFS or MFJ. Before I continue, I will say this once and only once:

    YOU CANNOT FILE SINGLE. If you are married, you are married. Doesn't matter where in the universe your spouse is,

    YOU ARE STILL MARRIED. You will be lying to the IRS if you file as single, and if caught, could cause serious issues.

    If you have already filed taxes, either this year or last, and were married, yet filed as single, amend your tax return ASAP.

    If at the time of the interview, there are tax return transcripts in the case file showing the petitioner filed as single, this can

    be a HUGE red flag. The CO will have to wonder why the petitioner filed as single when they're trying to get a spousal visa.

    In their eyes, your relationship can be seen as a fraud and could be reason for denial."

    thanks again Changnoi. really don't have a plan to file single :) just wanting to compare how much would I get to file MFS, MFJ or single :) plus the requirements and the processing times. thanks for the help :thumbs:

  3. I applied for an ITIN. Took less than a week to gather docs and send it to the husband in the US. We got our check 3 weeks later.

    Easiest way would be to file separate tho you won't get as much $$$

    really so you did file separate. did you try to call ssa to ask if you're eligible for ss#? my husband called IRS and advised him to have me call social security and personally ask if im eligible for one. anyways so if ever we wont have our transcript in time for interview if ever, do you think the consulate will not accept an extension letter and W2?by the way thank you for your response?? :) can I just ask too what are the documents that is needed for an ITIN?

  4. Paper file 2013 right away. You don't need ITIN#.

    You can't file singe. For status use MFS.

    Write NRA where SSN# goes on return (Non Resident Alien)

    Include this 2013 Federal Tax Return return with your W-2s and all schedules

    in your AOS package.

    By the time you have interview transcripts should be available online

    to print out and take to interview if needed.

    thanks for your response Changnoi. we already sent our AOS packet and we even had a minor mistake with it but we don't have any problem with the financial part of the form and we sent the checklist march 20 so I guess they already accepted our AOS packet. anyways so if my husband is going to file MFS how long will it take for the transcript to be available?. see we're just waiting for our case complete this week or next week and hoping for last week of May interview or early June. will it be already available by that time??? and lastly will it end up having my husband owing a lot for his taxes compare to him filing single??? sorry for having a lot of questions and so thankful for your response.   6. By the way, for my 2013 tax return, I did file as single and not married even though I got married last June 2013. I know there's an issue about filing married either jointly(w/ ITIN) or separately(and put NRA on ss no box) and that were not supposed to file single. Trust me, I told my tax preparer about it.But she insist no, I should just file single now and then amend my tax soon as my husband get here and get his ss and were not gonna have a problem at the interview. And yes, she is right, during the interview, they didnt say anything bout my filing status. I guess they only look for my income and thats it. My husband's visa was approved. So I plan to amend my tax soon as my husband get here and when he received his ss.

    files 3 petition (spouse & minor) filled out i864w (tax exemption) for 2 minors & i864 for wife.

    part 3 / #1 "yes" #2 checked the box and wrote names of children in 2.a and 3.a #7 wrote "3"

    does this mean he need to redo part 3 and 5??

    correct version should be

    we did the same mistake too that's why we had a checklist because we checked that part 3 no. 2 and include my stepson's name in it. dumb that I didn't read the instruction carefully but anyways we already sent the aos checklist last week. your right with your correct version, just wanna ask if your 2 minors are your stepchildren or not. coz if it is then you're right with your correct version of part 5 no. 8 coz they'll not be counted as your dependents but if they are your kids then you need to add them up to your household size. hope this will help you

  10. The total on 5-1 is from line (7 of part 3) It is the total number of immigrants your husband is sponsoring. You and 3 Children =4

    5-4 would be blank as it is only used for persons not sponsored in this affidavit. 5-8 is correct with a total of 5 for household size.

    remember you shouldn't include any relative on part 3 of the form that is on separate visa petition. so if your husband is petitioning you and your children it should just be you on part 3 no. 1 and don't check the box part 3 no. 2 plsu don't put your children's name on part 3. that brings the part 3 line 7 of a total of 1 household and that's only you. remember to do the same thing too to every forms for your children. and if its a stepchildren of the petitioner, NVC look at it as they're not yet dependents of the petitioner.

  12. When getting documents from NSO, you should always request the CDLI copy if there are amendments on your documents (i.e., name, birthdate or any change in your BC; annulment on your MC, etc.). A CDLI copy shows these amendments on the space at the right side margin of the document. I know that NSO always give the CDLI copy unless you specifically requested the un-amended original copy (not the other way around as the USCIS stated in your letter). The USCIS and NVC require the CDLI copy showing any amendment. If there are no amendment on your document, there is no need for a CDLI copy. Hope this helps.

  13. guys (Philippine applicants) did you do his request from NSO about CDLI????

    Applicants should request certificates that are issued with a "CDLI endorsement" (Court Documents and Legal Instruments). This endorsement shows any amendments to the original document from marriages, annulments, name changes etc. Unless a CDLI copy is requested, the requester will receive the unamended or original copy of the document.guys form the Philippines did you do this request for your birth and marriage certificate, etc.
