I just received my AP/EAD so I don't care toooo much about the greencard. It would just be nice to know some estimates. The K1 already made me go crazy, waiting for EAD was nerve wracking cause we need a second income..i really want this wait to be over..until it's time for ROC...URGH!!!I couldn't agree more!! The processing times on the USCIS website are zero help.. My local office (Philly) hasn't updated their timeline in months. I figured I'd be waiting FOREVER to be scheduled. This whole process def tests your patience, that's for sure! lol
-
It took 8 days for the status to change from "Testing & Interview" to "Interview Scheduled". Processing times are really all over the place though. Could be a couple weeks, could me a couple months. Hopefully it's quick for you!
Thanks for your reply..I figured that it just means waiting until something happens..you never know when. All the waiting wouldn't bother me so much if we'd get some estimates how long stuff takes..
This way it's just unpredictable :/
I never got any emails or texts btw..I could only see changes when I checked the online status..
-
Haha I guess that means waiting again..just curious how long it took for the ones that already had their interviews..They are looking for a date for your interview could be days until they say something again weeks...
Congratulations btw on the latest approvals

My status for the I485 just jumped to "ready to be scheduled for interview".. What does that mean?
How fast after this status change did you guys get the actual interview appointment notice?
-
Hi all!
It has been a busy few weeks since getting my visa....now i am starting to get the adjustment of status package ready to mail off.....could someone confirm the amount we need to pay? and if a regular cheque is ok?
Thanks in advance
Xo
I believe its $1070.00 for AOS. But read on the instructions to make really sure!!
And I believe my husband just used a regular check..good luck on your AOS journey...its nervewracking but we will all make it!

It comes 2-day priority mail. We went to the post office today and requested to have it pulled so he could pick it up in the morning. Instead of having it go out with the truck. If you're going out of town that long, have your mail held. Then pick it all up at once.
oh thats a real good tip thank you so much..I´m going to the post office tomorrow and have this arranged..thank you tina!!

I agree!! I keep telling him, "I'm so glad you're here."
His card was approved on the 7th, went into production on the 10th, and we were notified that it was mailed yesterday. According to the USPS tracking, it'll be delivered tomorrow.
hey could you maybe, or anyone else here, let me know how they sent the card?if they just dump it in the mail box or if its certified mail or something??
we´re leaving town for 10 days and I dont want the card to be sent back to USCIS..

We put in an expedite request back in mid-September. He should have his card in hand tomorrow. Guess who didn't get my vote when they were running for re-election? hah Happily, Johan's job offer didn't really have an expiration date. The guy he works for has a small company, and he has been great with accommodating the wait. Now the wait is over, hooray!
yes main thing about this is: the wait is over!!I´m so so thankful that I can start working and support my hubby. It wasnt easy to live from only one very small income till now. But my husband has been very great about this. Glad that I can help out now too.
Did Johan receive his card yet?Just wondering how long that takes

Congrats!!! Our congressperson did nothing for us.
I guess it depends on your congressman wether they help or not. did you tell them that your job offer will expire?
I have the feeling that it went fast with mine, because my job offer letter stated that its only valid for a week and then they´ll hire someone else!?
maybe I was just lucky.

I have an update. Thank god. I sent in the paperwork for the new co sponsor on September 9 and it was delivered at the 11th. Meanwhile I contactet my congresswoman for expedite and her office worked hard on it!
I had an job offer pending but only until this week. So this morning the congresswomans office sent me an email that my AP/EAD were approved today!
I'm SO relieved and happy about this..
I can only recommend contacting congressmen or women! It was a big help.. -

Hey Guys I need some help..Below is what my RFE says I am a bit confused and need some clarification as to what it is that they want. There are 2 boxes that are checked ill type out exactly what each box says. I'll represent each box with a bullet point. The stuff in yellow is what they highlighted in my RFE. I dont understand what they want from part 1 but I understand part 2 completely. Can anyone shed some light? Cause i dont know if they want both part 1 and part 2 or just the joint sponsor. I dont want to have to make an INFOPASS appointment because im gathering documents as I am typing this to get it sent off.
- Submit all supporting tax documentation (W-2s, 1099s, Form 2555, and all supporting tax schedules) submitted to the Internal Revenue Service for the most recent tax year.
The petitioner/sponsor must submit all supporting tax documents for the most recent tax year.
- Based on the documents submitted with Form I-864, Affidavit of Support, for the petitioner/sponsor, the income did not meet 125%(100% if military) of the poverty guideline for the petitioner/sponsor's household size.
Submit evidence of assest that meet the standards listed below or obtain a joint sponsor.
if your sponsor is self-employed be very careful calculating his gross income..my co-sponsor is self emplyed and makes 60.000$ a year but I had to obtain a new sponsor because they sent me this:
"gross income on joint sponsors schedule C portion of the 1040 is not the income figure used to calculate total income for a joint sponsor. total expenses are deducted from gross income and the net profit amount is carried to line 12 on the 1040.line 12 is then included with other income on the upper portion of the 1040 and all are totaled into line 22.the line 22 total income from tzhe 1040 is the income used to determine wether a joint sponsor has sufficient income. your jpoint sponsors income per his 1040 is $10.319"
so apparently they substract expenses from the yearly income and so he made only 10.000$. I got two RFE´s because of that. and the first sounded exactly like yours.first I thought they were only missing more supporting docs so I sent them, but that wasnt the case.
so probably you are really not meeting the poverty guidelines..try to find a co-sponsor and dont waste time like me..
good luck!
-
Yea I figured this too and sent it all off now.. Hope it'll be alright now..I would advise you to get the employment letter, don't risk anymore rfes
What a stressful process..
-
What?!? How do they know what his expenses are?? That doesn't seem logical. I thought they just went by income and number of dependents.
I really dont understand it either. my former co-sponsor is self-employed and single and makes 65.000 a year.
heres what they wrote in the letter:
"gross income on joint sponsors schedule C portion of the 1040 is not the income figure used to calculate total income for a joint sponsor. total expenses are deducted from gross income and the net profit amount is carried to line 12 on the 1040.line 12 is then included with other income on the upper portion of the 1040 and all are totaled into line 22.the line 22 total income from tzhe 1040 is the income used to determine wether a joint sponsor has sufficient income. your jpoint sponsors income per his 1040 is $10319"
I really tried to find those numbers on is 1040 but couldnt find it..the number 10319 is nowhere to be found..
I really dont get it..but apparently theres nothing I can do.. glad my mom in law helps me out. she´s not self-employed so I´m hoping her income is enough..since I dont understand how they calculate this.
but tina..congratulations on johans EAD!!!saw you updated ypur timeline..so happy for you!!!!
-
Thank you!! I'll ask her.Im not sure that you TOTALLY need it, but I recommend. In my opinion, the letter is a evidence from employer that they hired her and will keep her working for them in the future a.k.a maintance her ability of support the intending immigrant (YOU)
-
Haha awesome thanks and do you know about the employment letter? Do I totally need this? Then its more simple now, look for the line "Adjusted Gross Income"
-
No she is employed..anyone an idea for employed persons? Is she self-employed and have Schedule C in her tax document. If yes, try to look at line31 in SchedC
Thank you

So I received my RFE letter today and it seems like even though my co sponsor makes 65.000$ a year his actual gross income is only 10.000$ because his expenses are so high? Holy smokes I didn't know that's how they calculate this..urgh.
So I had to obtain a new co sponsor. Luckily my mom in law helps out. I can't find the spot on the 1040 that tells me the actual gross income..can someone help me on this?
Also I do have her tax returns 2013, w2's and paystubs over the past 6 months but no employment letter.. Is that ok or will I totally need an employment letter??
Thank you for your answers..
-
Proof of US citizenship ( naturalization/birth certificate, US passport ), employment letter, pay stubs for the past 6 months, Tax transcripts or proof of filed taxes for the past 3 years. ( I used transcripts ) .. That's all I submitted for my joint sponsor and I received no RFEs so far. BTW taxes for the most recent Tax year are
MUY importante !

It moves so quick yay

Technically a K-1 can work until their I-94 expires, which is 90 days after entering the US. After that point, you can't legally work without either your EAD or your GC, regardless of what e-verify might report and even if you already have your SSN.
When your I-94 expires, you are technically "Out of status" and begin accruing overstay. However, if you have filed for AOS, then your overstay is waived but you are still out of status and can't work or anything.
Working for "cash only" jobs or any other kind of job is a violation of immigration laws if you don't have your EAD or GC (regardless if you pay the proper taxes on the cash income). While you may not have any issues with this or may never get into any kind of trouble because of those, please don't promote the idea to everyone that it is ok to do so!
I totally agree. we all need our EAD. and we all have to wait! dont promote illegal ideas and dont even speak it out loud in public that you do this..its not beneficial for yourself!
-
I was guessing she's the K1 and her husband USC that's about to lose his job. That's why she needs her EAD to compensate for that!?Im not sure if I'm correct... But I guess she's telling us that her husband is already working...am I right?
-
You can call the hotline of USCIS and request it on the phone. You have to tell them it's causing financial hardship on you and will most likely have to send a letter of your job offer to proof that you have a job waiting for you.can anyone tell me how to request expidition of my EAD ? my husband is about to lose his job :-(
anyone?
Without an job offer the will probably deny the expedite

Quick question about the drivers license: I went to DMV with my EAD, they ran their safety checks but said that they came back unclear. They couldn't answer me why that is.
So they gave me a number that I can call after 10 days to see what's going on. Until then I can't have my drivers license.
Does that sound familiar to anyone here?
Could that be cause my EAD is so new and I'm not in their system yet?
Went to SSA today to change status and to married name and that was no problem..maybe that should have been done before I went to the DMV?
