When they endorse those visa they are stating they are going to be living in the US. If they want to stay in Canada they need a reentry permit. This will let them be back in Canada for a few years. As without it they cannot and should not be gone for more then 6 months. 

    Also, ot of curiosity, what happens if they decide to give up their US residency after endorsing the visa and want to reclaim Canadian residency? How long would the reclaiming period require for them to be considered primary residents of Canada again? Thank you!

    I'm basically forcing them.. I'm an only child and I'd like to have them close to me as they're sick and old. That was the whole intent of going through this long process - in case it became too difficult for them to continue to live in Canada alone, so they could just come and stay with me and eventually become citizens here.

    Thank you for explaining! I need to sit down with them. If they want to stay in Canada and need a re-entry permit - as in, a re-entry permit to enter Canada or a re-entry permit to enter US? May I ask for some direction to learn about re-entry permit? My mom is definitely not ready to wrap it all up in Canada yet..

    OHIP is a pain to get straight answer from some members will say they called and they were told that they don't lose it right away. Sadly this is not true and many have ended up with a bill years later. Too many times the person answering the questions is just in a call center reading a screen and they see examples of students, and snow birds and give out that answer. But the things is students and snowbirds do not ever claim to be a US resident, ppl entering on a IR/CR/K visas do  take up permanent residency in the US. They are not tourists and the health care stops at the border once that stamp is in there passports. When your parents do their exit taxes the date they originally crossed/visa endorsed is the date they will use.  If they use the health care after that date someone will eventually put two and two together. What Province are your parents leaving? That is the site you need to really look into as it could be like BC and give them a month. Also if they are selling a house. It is better to do so before they leave. Selling it after they are no longer residents opens a bunch of other tax stuff they can avoid. I'm not sure what all it entails but I was advise to sell before the move and many on here have wished they did so too. Something about paying more taxes maybe because it is no longer the primary residence. 

    Thank you for sharing, I appreciate it. My parents are actually in Ontario. They're not selling their house and keeping everything, they're simply not ready to move yet and their visa expires in June. We wanted to have their visa validated, so that they could go back and come back in 6 months to a year when they're ready. They want to keep Ontario as their primary residence. Should I be looking into snowbird laws in this case? Any point of direction to learn on snowbird regulations?

    Yes .. if they cant manage these consequences then they need to not come until they have finalized things in Canada  but before the visas expire

    They're from Ontario. It says they can be outside of Canada for 7 months. They're only planning to come over for a few weeks, and go back. They will be keeping Ontario as their primary residency and continue to live in Canada and keep their jobs there at least for next few years. They are not ready to give up their home/lives in Canads yet and their visa expires in June. We just wanted to make sure their visa is validated, then they can go back and come back once ready.

    Thank you. Would you mind sharing  point of contact or link regarding this? I wasn't aware of this at all and now I'm concerned and thinking perhaps they should cancel their visit for now.

    Since they don't have a home address in US yet, I.e. haven't gotten a place, would my address be considered their US address, and therefore the GC be sent to my home address?

    They were not asked or told anything about how to or where to make the $220 GC payment during the interview in MTL so I'm kind of lost. Any information will be helpful!

They will present their passports at rntry and the CBP Officer  will access their files electronically and they will enter the US. They are LPR as soon as they enter. The visa page will be stamped and this becomes their temporary GC until the plastic cards are received ( weeks to months).  They can reenter the US, get their SSN, drivers licence, bank accounts, health insurance etc using the stamped visa 

     

    As they are now LPR, my understanding is that they are no longer residents of Canada for health insurance purposes. I hope you are aware of how to get them coverage here.. and the challenges associated with that 


    Would you mind sharing a little more on how and where can we make the payment of $220 for the GC? My dad said they never asked or said anything about it at their interview in Montreal.
     

    Since they're visiting this time, going back in 2 months, only coming with the intent to visit me, and have their residence still in Canada, wouldn't they still be eligible for Health Insurance in Canada as they're still Canadian residents? I thought Health Insurance is revoked if one is out of residency in Canada for over 3 months? I appreciate you sharing the details.

  9. Good afternoon all,

     

    I am a naturalized US citizen. My parents are Canadian citizens, recently granted the family visa to move to the US as permanent residents. They received their visas on their Canadian passport in Montreal earlier this year and the visa expires in June. My parents' first trip since being granted the visa to US will be in April. They are not "moving" this visit, simply coming over for 2 months to stay with me and then go back to their Canadian residence for a couple more months to prepare for the move. 

     

    I am kind of confused in regards to what happens next - I have reached out many times to NVC to get clarification but haven't received any. When they fly in from Montreal to US in April, would they just show the visa to the customs officer and that's it? Are they going to be questioned/interviewed at that point at the airport? My parents are sick and elderly so I want to have them aware and prepared for as much as possible and know what to expect. At what point would they receive their PR cards? As I was the petitioner in their application, is it going to be mailed to my home address for them? Or would it be mailed to their Canadian listed address?

     

    Once they have arrived to the US, they plan to stay for about 2 months with me and then go back to Canada. and then come back again in a couple of months. I am just not sure what the process will be like from here on to obtain the actual PR card and what would be the next steps in terms of getting their Social Security and everything set up. I will really appreciate some guidance in this.

    regardless, it bans CANADIANS who are involved. If its not in your name, I wouldnt worry about it. Also, you say you are already a permanent resident, so doubly no need to worry about it.

     

     

    We are married. I am a permanent resident but conditional though.. I was under the impression they can take that away anytime they want.

    I moved to US from Canada with K1 visa and am currently living here with my husband as a conditional permanent resident. We have been married 3 years and I have applied to get the conditions removed. I'm currently waiting on the next step as due to backlog my current residency has been extended twice.

     

    Now to the main concerns - we have been a bit confused about how investment in the cannabis industry might impact on immigration status for a while. Recently I came across news suggesting Canadians who work or invest in the industry will be barred from the U.S.

    My husband (US citizen) had stock investment and we have shown all that in the financial documents that we submitted. While I have made no investment in the industry, in Canada or US, do you think we should be worried about this? It's very confusing and vague in regards to effective when was this an issue or effective when is it going to be an issue. Do you think this is why my case isn't moving? If it turns out to be so.. what kind of legal steps do we need to take or should we look into?

  12. 18 and 34 months??? Omg that's crazy!!!! Now I'm nervous that a letter is all I have got to hold on to till I hear from them...

     

    So if I travel to Canada (home) in July and then Scotland in September, am I good to reenter with the letter or should I get the stamp before leaving. My letter is supposedly valid till 2019.

     

    My god how backed up are they! Thank you guys. I was starting to panic...

    Applied to have the condition removed on the December 5th, got Biometrics done and have received a letter stating that it's been extended for a year as they go through my case.. Is that normal? My PR card expires on March 5th. So I need to book an appointment at the Field Office to get I-551 Stamp? Is it normal that it's taking so long? I'm supposed to go to Scotland in September and now I'm worrier that I won't hear back from them before that. Can you guys tell me what is the purpose of the I-551 Stamp? Is that a must? Am I in trouble that I already haven't got it done and my card expires on the 5th? Would getting this stamp allow me to reenter US when I return from Scotland?

    Also I have looked into infopass appointment and they have no appointment available... What should I do? Can I just walk in to get it stamped on my passport? I'm in Houston. I'm kind of worried that it's taking so long.. Does it mean there is something wrong with my case?

  14. So this is going to be long and confusing perhaps. Please bear with me.

    I came to the US from Canada with K1 visa in 2015, got married and now I'm a conditional permanent resident. As far as I know I could apply for citizenship sometime in 2019, not that I'm sure I'll do it. I might just remain a PR as long as I'm here. My question is regarding my parents.

    I'm an only child of my parents and we don't have a lot of family members. Both my parents live in Canada and me moving out to a different country has been really hard on them. Not only because we're very close but also because when it comes to certain things they totally depended on me. I.e. updating their phone, making sure official documents are up to date and such. I don't ever plan to live under the same roof as them because I think we're all gonna need some privacy. But I wonder if we should live close to each other. My question is, as they get older, do you think where do you think I should arrange for them to live here, keeping social and economic factors in mind. My dad still works, my mom has always been a homemaker. My dad will retire in the next 5-7 years I assume. Do you think I should sponsor them and bring them here in the US or is it better that they remain in Canada. I can't help but wonder if it's gonna be too difficult for them to adjust in US in their age. That being said I'm also wondering about how the whole medicare and social security thing works around here. I don't know much about it so I'm clueless. I know Canada is not too bad when it comes to elderly care.

    Any input would be appreciated. I feel guilty for leaving them like that but sooner or later I had to leave..so that I can grow and they can have a life of their own. My parents are very cool people and they'd never wanna be a burden on me. That being said I also wanna make sure they're in a province/state where they'll be taken care of for the most part if I'm not around. Is it normal and possible to work full time and keep things checked up with your parents being so far away? Anyone got any suggestion for me? Thank you so much!

    Came from Canada to Us with K1. Got married in June and applied for AOS. Received work permit in September. Received interview waiver letter in October and it says it will take up to 6 months for them to determine on AOS due to high volume of applications. I'm hoping my permanent residency will be approved. My question is what are the chances that I'll receive the 10 year card instead of conditional 2 year since we got the interview waiver.

    In case I do get the 2 year card, when can I apply for the 10 year card. After how long of obtaining the 10 year card I can apply for citizenship.

    Also, in case I get the 10 year card when can I apply for citizenship. Here's were it gets a bit complicated.. I'm having an extremely difficult time finding employment in the current place we're living. If I were to find employment in a different city and my spouse remained here..would that be an issue when it's time to apply for 10 year card/citizenship? Not divorced, not separated, just trying to have a job. What if we traveled to see each other every other week.. would that make a difference?

    Also I have already visited Canada twice since getting married using advance parole. 8 days for the first time, 15 days for the second. Would this be an issue when it comes down to the number of days I've been outside of the the US? I do plan to visit Canada again in March..my parents are old and lonely. Would that look bad?

  16. Thanks everyone. Just out of curiosity.. My passport is Canadian so I don't need a visa to enter US anyway, do I have to show my AP/EAD card or just showing my passport is good enough?

    Also, when I visit Canada on the customs form do I write resident or visitor? Same for return customs form...what do I do? I'm just confused as I'm technically just visiting Canada and currently reside in USA however since my AOS hasn't been approved yet, aren't I still a visitor in USA and a resident of Canada?

    Just received my EAD and AP approval (woohoo)! Is it normal to have the same card for AP and EAD. And at this point, am I allowed to travel home? When I enter back to US is that the only card/document I'd have to show? I'm a little worried what if they don't let me in! Does that happen a lot if you're traveling with AP? My AP and EAD both are valid till September 2016. I wanna go home visit my parents in Canada just for 2 weeks before I jump into the job hunting business. Is that a bad idea?

    And on a completely offtopic (non-immigration), is September/October considered to be hiring season in the US? My husband says if I go home now chances are I won't get a job till January/February because after mid-October the hiring industry slows down till the end of holiday season. How accurate is this?

    it's been about 3 months we got married and I applied for AOS through K1, work permit and travel document. So far only received a letter for biometric/finger prints and that was done 2 months ago. Any idea how long would it take? Also, is their any way I can check the current status of my application? I'm getting sad and restless.. I really wanna visit my family and start working. Sitting home is driving me crazy..

    Also, at this point my K1 90 day visa has expired too. Not having any notification from USCIS am I considered to be 'illegal'?

    Leaving for Houston with my K1 visa in a week! Excited, sad, nervous, happy. Just wondering if you had any last minute tips or advice for me.

    I don't know what to expect at the POE. Can someone tell me what exactly happens at the POE, how long does it take to get the whole process done. My flight is at 7 am so I guess I should be there very early in the morning.

    I'm panicking a little and can't tell if I'm missing any items that I'm required to bring with me, other than my passport and the package that came with the passport. When I fill out the customs form do I check resident or visitor.. can't believe it's time to move!

    Got my K1 visa, getting married in a month!!!! Moving from Ontario, Canada to Houston, Texas. I just had a few questions regarding what happens after that.

    1) When would I be able to visit Canada again. Any idea how long I might have to wait? Does it take too long to get the process of the next step started after getting married?

    2) My Canadian health card expires in 5 months (I'll be gone by then, but I do plant to visit Canada occasionally and stay here at least 3/4 months a year as my parents are sick ). How can I get it renewed, or should I get it renewed.

    3) My passport will expire in 2016. I plan to keep my Canadian passport. Can I renew my passport when I'm visiting Canada or do I have to get it done while in the US from the Canadian embassy.

    4) Would I be able to drive in Canada while visiting with my Texas diver's license?

    5) And on a completely unrelated note, when I'm going through my port of entrance from Canada, can I put all my jewelries in the carry on? It's a lot of jewelry as I'm an earrings freak. It's just they are extremely heavy and fragile and I wanted to make sure they aren't thrown around like regular baggage. Do you think I'll get in trouble as I go through security with them?
