    that's a tough one.

    my non-legal suggestions

    1) if he is a US citizen then there should be some documentation from the US side that they accepted his date and place of birth from 1st documentation when he first arrived onto US soil during the initial processing in GUAM (probably); ie, granted special status (automatic back then by President Ford and Congress), He can use these official documents (US passport & naturalization certificate) along with a notarized letter explaining the situation.

    2) if he is going back to Vietnam, they may still have record at the hospital where is was born - these are usually not destroyed... if he knows anyone there, he can ask them first to go and see if the records still exist and perhaps get a copy for him.

    last year, i started going down that path of getting officially married in VN, with getting local & state signatures and approval from VN embassy in the US. and even started the forms in Vn with mental health checks..so after about $700-800 USD.... then, after speaking to my immigration lawyer friend here in the US. I stopped all of that and went with this K1 VISA route. less paperwork and stress, so far. and i do believe it is faster and cost less as well.

    After 1 year of getting to know each other & visited 2x (very short visits compare to yours), we got engaged in VN - with all the traditional VN 'dam hoi' fanfares - it was great!!

    currently, in the process for K1 - fiancee VISA (I-129F) now, see my timeline - she just got her letter yesterday to officially apply for US K1 VISA !!

    hoping for a late Summer arrival to the US :-)

    will get married here once she arrives (and of course within 90 days) then submit change of status to permanent resident

    then will head back to VN within 2 years to have a VN wedding there.

    These are my suggestions - mere suggestions:

    IMO, I would suggest to slow down just a tad... you are going 60mph in a 30mph zone. Trust me, I know.

    since it looks like it can take 8 - 12 months to get a K1 VISA once you start

    since you are a Math and Economic guy, map out the next 12 months...starting now

    look, review, print = all the available resources on here and on official US VISA websites

    since you already got engaged, then you can begin the process with I-129F (K1 VISA)

    - Work - SAVE $ - put it in the bank = since you will need to show this later

    - Save everything from the very begining!!!

    1) communications: tele call records emails, text & chat history (download now & save it for later)

    2) Pictures

    3) receipts: airplane, hotels, food, gifts, engagement ring

    4) as far as "evidence of support", the poverty level = ANNUAL salary, not what you made up to now from your new job.

    if you don't have adequate evidence of financial support, you ask someone to be a sponsor, in addition to you, like one of your relatives; like, "a co-signer when you buy a car or house"

  4. So my fiancee got the letter yesterday!!!

    STEP #1

    completed the DS-160 e-form/submitted, printed confirmation

    to send (confirmation, copy of passport, 2 VISA photos) to USC-HCMC

    STEP #2:

    completed account & printed receipt, paid 5,1600,00 VND at post office.

    now, waiting for post office payment to go thru system at HSBC into USC-HCMC account; so she can set the interview date.

    STEP #3:

    mostly done already

    STEP #4: health check & vaccination: will await for STEP #2 to confirm a date for interview - looks like July 25th....will see

  5. Yes, his visa valid till 2019. He doesn't mind to paid $55 for extension fee + penalty.

    There is no reason for him to paid for $75 renewal visa, since he is holding a 5 years of visa exemption in VN. Also, his US passport validate for 2024.

  6. As you know there are a lot of ambiguity when it comes to fees in Vietnam or at any consulate/embassy. never see clear & concise information & fee schedule.


    but with 5 years VISA EXEMPTION, there is a process & procedure for extension before the 90 days - see below - you pay a small fee like $30 USD, I read this one VJ forum a couple of weeks ago (have to find the topic on VJ somewhere); i think since your friend went past the 90- days, the $55 USD fee sounds like the $30 fee + penalty.


    the $75 renewal fee - is his VISA EXEMPTION still valid; ie, expiration date... if still valid then he should not have to pay......sounds like a scam to me.

    Now for payment, make an account

    2 questions:

    1) does the payment have to be at this very specific HSBC bank

    HSBC Metropolitan 235 Dong Khoi Street, District 1, Ho Chi Minh City, Vietnam

    or any HSBC bank, since I would make the assumption that all HSBC bank are connected and the payment goes to the specific US consulate account.

    can I pay at HSBC bank in the US?

    can she pay at HSBC bank in Hue?

    if no,

    2) can my cousin make the payment with copy of 'payment slip' at the HSBC Metropolitan 235 Dong Khoi Street, District 1, Ho Chi Minh City, Vietnam

    => trying to save an extra flight to Saigon just to make a payment - i guess she can go make the payment and get medical check/vaccine as well.

    Registration Requirements:

    • Appointment letter
    • 2 passport photos with a plain white background
    • Passport or ID (for adult) and passport with photos of accompanied children (for children) for person-identity check
    • Immunization sheet from International Health Quarantine Center in HCMC
    • Fees (effective from 01 December 2013): ≥ 15 y.o.: 140USD; < 15 y.o.: 110USD

    - from this list on their website, you should bring the immunization sheet from IHQC, so perhaps get the needed shots first is fine like Pete had mentioned

    + "Bring the interview paper that has the interview date, DS-160, passport, and also the Package 3 letter where it has the HCM number for the shots and medical. Make sure you have a copy of each." from Pete

  9. I do not think the wait time is solely dependent on submitting everything that is required. That does not explain why over the last month we have seen filers from Oct/Nov/Dec being approved without an RFE. Those filers were well over the ~55 day average and appear to have submitted all required documentation (due to lack of RFE). And I anticipate seeing a significant amount of our fellow TSC January filers be approved in the next two months without RFEs.

    Your approval timeline (~55 days) appears to an exception to the rule for TSC...if you look at the the recent TSC approvals reported here on VJ.

    The average days to approval of 55 days is based on VJ data - and you can see the wide variability as well. the data can be look by each country's timeline. I have seen some are approved within 60 days, others in months. Mine was just under 90 days.

  10. In this one you have to choose non-immigrant as you are applying for non-immagriant visa

    As for the one to check your case status I have no clue why we have to choose for immigrant visa.

    I advise you should pay as HSBC I know many people who paid there fee at the post office got their receipt number after 5 days not 2 days . And now the first available appointment for k1 visa is June 20 as yesterday was June 11. It goes fast .

    i am trying to understand the process before I get the actual NOA2 letter and NVC number.

    i finally figured it out.... there are so many nuances to each website

    i wished USCIS and NVC centralize their efforts and that goes for the various VISA types and individual consulate centers around the world - "centralize"

    Is this fee = $240 = to pay for the "Immigration Visa (IV) application processing Fee" ??

    if so, they have an on-line payment system that I can pay directly from my bank account

    You will need the following information from the fee letter that you received from the NVC:

    • Case Number
    • Invoice Identification Number
    • Affidavit of Support Fee payments will appear as NVC AOS FEE.
    • Immigrant Visa Fee payments will appear as NVC IV FEE.
  12. Hi Guys! Been lurking around here for a while - I got our NOA1 on Jan 14, however USCIS has the following on their site:

    On January 16, 2014, your Alien Registration Number was changed relating to your I129F, PETITION FOR FIANCE(E)

    Does anyone know what is means??

    I believe that is normal format - now that your applicant (fiancee) has an "Alien Registration Number", every applicant (fiancee) gets this number.

    i got this as well - just didnt put it in my sig

    I think of it as a "non-US citizen or foreigner's ID number" = aka "Alien ID number". This number will stay with your applicant (fiancee) until she/he becomes a naturalized US citizen.

  13. hi, after NOA2, you should wait around 10-15 days and call for the NVC to get your case number.

    • When you get your case number. you can check your case status here :https://ceac.state.gov/CEACStatTracker/Status.aspx?eQs=o/iS8zDpeAKjMWCuebHqOw==
    • Remember to choose immigrant visa not non-immigrant visa.
    • After that, you should tell you fiance to fill DS160 online and print out your confirmation number.
    • Meanwhile, you should make an account in this website http://www.ustraveldocs.com/ in order to schedule your interview
    • Go to HSBC or any post office to pay your fee 240$. Then wait couple of days go back to the website and schedule your interview
    • Go to the vaccination and medical exam.
    • Pass the interview :)
