    How do you "interpret" an agency anyway ? You mean interpret the priorities of an agency i suppose

    NO - we actually entered actual receipt numbers - which is a very tedious task considering there are a lot of them that are being processed - and tried to find patterns of "batch processing". What I was trying to communicate was the fact that they are randomly processing batches here and there and they are leaving out/missing out receipt numbers indiscriminately. These are people's lives that are being played with here.
    To label the USCIS "Insufferably incompetent" is only because your patience is thin.
    To get ahead of the disneyland line, because you got a Philippines expedite and got to get ahead of that disneyland line because of the your expedite -- and to mock others who are frustrated because that very process for the rest of us is messed up -- is extremely arrogant.
    Who are you to tell us how to react to institutional incompetence. If it weren't for people who made some noise last time around because of this bureaucratic apathy, we would have been waiting even longer. They had to put out a press release and our reaction forced them to reduce the waiting time by 1-2 months. You don't have to be a rocket scientist to get a government agency to enforce the mandate it's supposed to enforce WITHOUT DELAY.
    Shouldn't be that hard to do seeing as they are handing out work permits to lawbreakers of all nationalities quite efficiently and expediently !!!

    If they are still having the same problems now that they were having 5 years ago, that shows that no action on their part has fixed the underlying problem or system that is in place. I don't think sitting back and having patience is going to have ANY positive effect. I don't want people who file 5 years from now to be dealing with the same exact problems that we've had because every one needs to have patience, and accept that there's no transparency or answers from this government agency.
    My assumptions are not just based on Visajourney's information. In fact, the vast majority of my theories are based on the past behavior of the USCIS, and their very own information. I have read the FOIA documents that were released. I have read the Ombudsman reports and the USCIS's response to them. I've read lawsuit documents. I've read statistics. I've read up on everything I can get my hands on. If I'm wrong, then I want to know about it so I don't hold the wrong people accountable. Visajourney may be a small sampling, but it, and the other immigration sites out there seem to indicate the same things, which are eventually also corroborated with the data that the USCIS puts out.
    I hate to tell you, but I'm just as important as the next person. The people who are still waiting are just as important as I am. This isn't some stupid ride at Disneyworld. These are people's husbands, wives, children, and parents. These people and their relationships are not insignificant and should not be compared to some stupid ride at an amusement park.
    And if I'm too busy to come on visajourney once my husband is here, there are plenty of friends on here that I plan on keeping in contact with. And I plan on continuing to work towards helping to fix the immigration system's problems, because it's important. My husband *also* thinks it's important. My whole family and extended circle of friends thinks it's important. You don't think it's important, so don't work towards it. Just telling people to wait and suck it up is not helpful to anyone.
    They already are getting that answer on a regular basis from the USCIS.

    If everyone would just wait be patient and accept whatever gets trown at them,i`m sure the waiting time would be even longer, the louder people get the stronger the chance is they get heard...Of course someone will whine after months of waiting with 0 information about their cases ! please dont tell me waiting 8 + month just for NoA2 is sufferable ... you read all of this 5 years ego ? well maybe people should stick together and try changing a system that is out of order!

    I know its random because I actually bothered to look through the receipt numbers (in batches) and empirical evidence proves that they leave out receipt numbers willy nilly and move onto transferring batches that are not consecutive. I am a computer scientist by profession and I consider myself sane enough (whatever sane means right now) to identify nonsensical patterns of processing.
    Also CSC, NSC and TSC dont have anything to do with decision making about who gets transferred.
    They are recipients of the transfer. What does the fact that they exist have anything to do with the transfer ?
    NBC is where they are transferring and they are doing it like they're on crack cocaine.
    What does the number of cR1/IR1 applicants have anything to do with the order in which they are processed ??
    What does RFEs etc have to do with processing first-in first-out ?
    Why not process them in a certain order ? They're mixing up PDs to the point where people with PDs from later in the month are being processed than those with PDs from earlier dates for no damn reason.

    I have no idea if you're being scammed. If I had to give you advice, I would say that, if you're in doubt, protect yourself. I also know nothing about PMS. And, as a guy, I hope to keep it that way.
    I have problems when people try to stereotype millions of people, especially in a derogatory manner. Here are some examples:
    Yes, my wife and I have arguments. But the fact that she has some of the traits listed above in now way means she wants out of the relationship.
    The point is - you, I, all of us on here - we didn't marry a stereotype. We didn't marry a series of traits that belong to all people from a certain country. We married a person. An individual who has their own personality. She is not defined by what some stranger on the internet says Filipinas are like.
    You know your wife better than any of us. I hope things work out for you.

    That is definitely adequate. Of course USCIS is the final judge, but you're already giving way more evidence than the vast majority of people. Great job, and congratulations!

    I went to US on a tourist visa and live there with my fiancé for 6 months and feel that it's really hard for me to leave. I do not want to take my chances so I left and we file K1 visa. I have no intent of marriage when I enter on B2 but we did decided we want to get married later on when I live there for 6 months. Still, I do not like to screw up my passport for good. Taking the safe route it is! That's just me.

    Yes, you could most definitely get in trouble. It's illegal and considered immigration fraud to enter the US on a tourist visa with the intent of marrying a US citizen and adjusting status.

    Just FYI....I see a lot of references in the forum as to referring to expidited AP as emergency AP and vice versa. Just to clarify that they are not one and the same.
    Expidited AP is a request to speed up your I-131 sent with your I-485, your AP can be issued within a week or two. You can mail a request to expidite with the actual filing of your I-485. No additional fees will apply.
    Emergency AP is an emergency seperate appointment at a field office or sometimes done over the phone and can happen as fast as same day. It usually will require a payment of a seperate I-131 fee, and your original AP will continue to be processed with your I-485.

    Thank you very much for that post, I had all of those thoughts flowing in my head, but it helps to see them in writing. I'll probably be rereading your post a few times.
    -We tried contacting the consulate, but they were closed...we will try again today...(by phone). We emailed them as well. The only other way we'll be able to reach them is after she flies back to Canada, which will render option 2 impossible (marriage+aos..)
    -we do have all the documents on hand, she organized all her documents for the interview in a big binder and brought it with her..
    -there are quite a few reputable places here in California that issue same-day marriage certificates, so that would be okay
    -The only issue is the infopass appointment, there doesn't seem to be any infopass appointments available any time soon..
    Also, the risk of have our papers delayed as you mentioned once they reach the Chicago Lockbox is quite possible.
    The only reason I'm leaning towards this more than the consulate solution is the fact that obtaining an AP before she leaves is safer than having her leave then find out if the consulate will/will not give her a K1...we will contact them today (if they're open) or tomorrow and hopefully they will give us some good news.

    USCIS is correct. Since you did not get married he has no status to protect with an advanced parole. This is why, among other things, it is necessary to get married ASAP, even if it is just civil ceremony (followed later by a big ceremony) AND file for AOS.
    Once you have filed for AOS and have the receipt (NOA1) you could have gone to the local office and obtained an emergency AP. Absent the marriage and filingof AOS you will have to repeat the K-1 process.
    Good news. It is being handled much more quickly now.
    We obtained a emergency AP for one of our sons so he could return to Russia for school, BUT we filed his AOS immediately on his arrival (k-2 to follow)
    No Senator or Congressman can help you. There is nothing to help. The K-1 grants NO immigration status, it is a single entry visa and unless followed by a marriage and filing of adjustment, it is nothing but a glorified tourist visa.
    You will NOT be denied because he went back. Not an issue. You WILL have to request a waiver since it will be your 2nd petition within a two year period...even though it is for the same person. Simply write a letter explaining the situation and end it with "I respectuflly request a waiver of the IMBRA limitations on approved petitions within a two year period" It will be approved. Be sure to check the waiver request box on the I-129f and attach the letter.
    For other K-1 applicants. DO NOT delay your wedding. There is no reason you cannot get married within ONE WEEK of the beneficiary's arrival and get the AOS ball rolling. Waiting only delays their benefits and privileges. Do a civil wedding then plan something bigger if you like

    I was reissued the K1 visa before.
    I have to resubmit all the forms and documents based on the K1 visa checklist again => I-134 Affidavit of Support, New Police Record and New Medical Report. Then schedule new interview date with US Embassy and pay the K1 visa fee again.
    I would suggest you email the US Embassy immediately.

    You should be contacting the US Embassy in Ukraine immediately. Ask about the option of Reissuance of K-1 Visa if your fiance could return before 90 days from the date of the original admission into
    the United States in K status.
    9 FAM 41.81 N6.3 Reissuance of K-1 Visa
    (TL:VISA-2; 08-30-1987)
    If a K-1 visa, valid for a single entry and a 6-month period, has already been
    used for admission into the United States and the alien fiancé(e) has
    returned abroad prior to the marriage, the consular officer may issue a new
    K visa, provided that the period of validity does not exceed the 90th day
    after the date of initial admission of the alien on the original K visa and
    provided also that the petitioner and beneficiary still intend and are free to
    marry. The alien’s return to the United States and marriage to the petitioner
    must take place within 90 days from the date of the original admission into
    the United States in K status.
