  1. Thought I'd update this thread for the benefit of anyone else who might find themselves in a similar position and searching for info.

    I just received an email from the Sydney consulate stating that they wish to proceed with my visa application and asking me to post in my passport. It's my understanding that this is for issuance of my visa, so it looks as though I should be successful without waiver or further messing around.

    I can thoroughly recommend Lizz Cannon; she provided me with an initial consult and explanation of my options and what her arguments/approach would be (in general terms). I then contracted her to put together the formal request to reconsider my denial and supporting documents and deal with USCIS on my behalf and she was a pleasure to deal with throughout the process.

  2. What do you mean by a minor record? do you mean it was not serious or do you mean she was a minor at the time? If she was a minor at the time then she wouldn't need a waiver at all.

    A K-1 visa is technically a non-immigrant visa so a 601 waiver (which is only for immigrant visas) is incorrect. The standard for a non-immigrant visa is not extreme hardship but it's different (recency, rehabilitation, etc). And a marijuana conviction is extremely serious and the chances of getting a waiver are very low and not worth the effort. You're better off getting married and applying for a CR-1 visa waiver which then means you can do a 601 waiver and the standard is extreme hardship.

    I'm going to guess your attorney is located in the U.S. and doesn't have much experience with visas. I suggest you consult an attorney that has experience with visas and has experience with waivers. The attorney should ideally be preparing you for the waiver a year in advance to increase your chances of getting the waiver.

    . As far as I know, K1 visa holders can file I 601 waiver. Just look at the waiver sheet itself: it says that K1 visa holders can file it due to extreme hardship. And there are members in visajourney who have filed it
  3. A K1 fiancee visa. My fiancee was found inadmissible at her interview so we needed 601.

    It was a lot of work but we had no problem with USCIS.

    We were really happy when we got it approved after "only" 3.5 months.

    We were then really frustrated with the amount of time and prodding it took to get the embassy to review everything again and issue the visa....9 more weeks after 601 approval seemed like forever and hopeless occasionally.

    I am lucky though I was able to spend almost half my time with her over the year we waited, other half of the time I went back to CA and ran my business. 14 transpacific roundtrips in 14 months.

    She has been here now since August 21 and wedding is this Friday Oct 31!

    Wedding 14.5 months after K1 first submitted....

  4. This is going to be my last day all alone...

    We were stuck in AP for 33 days due to a silly mistake my fiance made, and after he sent in the required document the consulate sent him a new 221G requesting something else, talk about torture! My fiance got his visa in hand this past Monday. I'm going to drive to Toronto to pick him up tomorrow and we'll head back together on Sunday. After 9 years it's finally happening, finally!!

    How many filers on this thread are still waiting for their visa? Is it a good guess that all of us will have our visas this year?

    . Our interview is on Nov 3rd. Praying everyday for approval???
  5. Guys I am confused with the following message. I checked our case and it says it's "in transit", does that mean it's in its way to the consulate. That's only logical, but help me confirm. Second it says the interview date has been scheduled by the NVC, what does that mean. I thought we fill out the ds260 and then schedule the interview?. If they did, we have no notification of what date etc? Please advise guys. Thanks

    Yes it means its on its way to the Embassy. Once it reaches the Embassy, it will say Ready.
