  1. Hi everyone, I was wondering if anyone could help me.

    I am a little bit confused about the AOS. I currently reside in Australia with my husband (I am the USC). I am employed here but I also have accepted a job offer in the USA and my income will be above the poverty level. I do not start that job until July 28th but I do have an employment contract listing my income.

    Because we are submitting our AOS in the next week or so, I have asked my Mom to be a joint sponsor for me. But in the section of the AOS where it asks my employment, should I put my current job, or my job in the USA?

    And, is this the correct way of going about it? I can't use myself as a sponsor as I would have no pay stubs for my USA job yet because I have not started. Is this correct? There is a section in the AOS Instructions that state, "You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income". Could I do this?

    Hey, I think using a joint sponsor is the way to go considering you'll be leaving your current job so your current income and proof of won't count. Definitely use your employment offer as evidence of reestablishing domicile there in the U.S. though. Good luck!

  2. Finally an update =)!! First of all, congratulations to STACEY&MISHO and Mahvika on your case completes!!

    After a draining 13 months we received our case complete on 4/18!! We are so thrilled! It's one giant step closer.

    So happy to have found VJ while trying to find others like me waiting forever for NOA2. Thank you to everyone and wishing that each of you receives your CC in no time at all!

  3. Yea, there is steam coming out of my ears right now !!!

    Talked to a nice guy at the NVC. He said, it is possible that they could checklsit for the signature BUT he has never seen a checklist for that reason. ( a glimmer of hope) He said that sometimes if there is a correction needed on the AOS, they will just update it at the interview. So I am hoping it is only the dumb signature on the AOS. I hope they corrected the adjusted gross income and replaced it with the total income. Seems to me the lawyer is mad that I am reading up on the process. I was right on the income number. Don't you just love how they try to blame me for their mistake....??? really??. is that what $3300. buys these days???

    LoveMyTico, I sent my lawyer my I-864 and then realized I put the wrong income so I sent him a corrected copy. He mailed the first one to the NVC. Yep. Unbelievable!

    Someone on this forum did receive a checklist for a missing signature from their lawyer. However many times it seems they overlook these things by accident or just ask to bring a corrected one to the interview.

    This process is just too much!!!

  4. Hi Saylin & all, I received a dreaded checklist for my I-864 and my dads I-864 (Joint Sponsor). Both seem wrong to me and I'm hoping someone can give me their input.

    My dad's checklist says that they received my mom's I-864a but that he has to list her name under household members on his I-864. I checked and her name is there.

    My I-864 says that item 13.a.1 doesn't match my tax return. I used tax transcripts and I put the number listed for "Total Income" which just so happens to be the same number listed for "Adjusted Total Income". Was I supposed to use the number listed for "Wages, Salaries, Tips, Etc and not the total income?

  5. Just done talking with NVC representative. she was very nice lady telling me....." I know this is what you want to hear this time - your CASE is COMPLETE as of today. But, there's still minor mistake in the 1-864 and you can just take it with you during your interview. Wait for the email for further instructions and you will receive soon your interview schedule."

  6. I might need to be more assertive...

    I called USCIS this morning to ascertain when (and if!) my case left TSC for NVC. The person on the phone was nice as pie, but she said they wouldn't be able to tell me when or if it was shipped to NVC. She could tell me I was approved (which, of course, I already knew), but as far as shipping out, there was no info.

    Is this a case where I should have asked to speak to a Tier 2? My case status has not changed since 1/31, when my petition was approved.

    Hi, please see my signature and you will see how long it took Texas to mail out my petition. It will hopefully not take as long for you but Texas is the slowest with mailing them out. You will receive an email when they ship it out. Once you receive that email it should arrive at the NVC about a week later.

  7. Hi all!

    We have encountered two questions on part 6 of the I-864, dealing with line/questions 13-14:

    1) 1. If we are going to submit the last 3 years of tax returns (IRS form 1040), do we check #13 or 14, or both? 13 says "ONLY the last year's tax return" and 14 is optional for the last 2 and 3 years tax returns.

    2) 2. We have claimed the Foreign Income Exclusion for each of those three years. The instructions to the I-864 say to put the adjusted gross income in lines 13a-13c. Due to the Foreign Income Exclusion, our adjusted gross income is $0.00. THat SURELY won't look good, right? My husband has been living with me outside of the States since we got married and all his income is foreign earned income. We do have my mother in law as my joint co sponsor. But 0?? Really??

    or do we put in the amount we earned that we reported on our IRS form 2555 (Foreign Earned Income form) as foreign earned income?

    Anyone knows? Thank you in advance!

    Hi, I just called the NVC and asked about this, First of all he said for part 6 #5 to put 0 unless you have a job lined up already in the U.S. He said this question is reflecting the upcoming year. Regarding Part 6 # 13a, 13b, and 13c you should put the exact number written on line 22 of the tax return. So if it's 0 than put it. He said that it doesn't matter if it's 0 as long as you have a Joint Sponsor. Good luck!!

  8. Said another way.....

    If you go to the USCIS website and download the newest I-864 and the instructions, they are confusing when it comes to part 5 and 6.

    The form instructions state to put the current individual annual income from line 5 in line 6c (under Person 1), but on the I-864 itself,

    it then says to add lines 5, 6c etc etc and place total on line 10... you wouldn't count the sponsors income twice so it doesn't make sense.

    What's the correct thing to do and why are the instructions contradicting?

    True, it's definitely confusing. I put N/A on 6c in order to not calculate my income twice. I think it may have been used in the previous I-864 version. If anyone else has input please add, thanks.
