  1. Congratulations to all the folks who've recently had case completes.

    It has been a very long process for us (and many others), as we lodged our application in April 2013 and still do not have a CC. The USCIS became heavily burdened at that time because Obama called on the agency to adjudicate a new immigration benefit called Deferred Action for Childhood Arrivals (DACA). Thus putting all of the I-130's to the back of the line. The young adults (DACA) did not need to to be processed with this urgency, - as they are all living, working and schooling in the US presently. Unfortunatley, this decision caused families and loved ones who were (and still are) processfing I-130's to be apart for inhumane, excessive periods of time. Another ill-advised government decision was to centralize i-130 processing and stop Embassies and Consulates abroad from accepting filings. And then adding insult to injury...pushing all said applications to the NBC. Most of us on this forum experienced being transferred out of the NBC to one the processing centers. Thus causing monumental delays.

    These governmental agencies, that are paid for by us, were created to make the lives of ordinary American citizens a little bit better. The current system is archaic, cumbersome and wasteful. And of course, - lacking decent, helpful customer support. Hopefully there will be change soon.

    Thankfully, there is Visajourney...And many members on this site, who are willing to take the time and help others out through this process. Saylin's wiki and this forum have been a great help.

    And so we continue to wait, going on 16 months. Hopefully, we get our CC soon too.

    I understand you completely, our priority date is February 25, 2013...

  2. I called again today, our AOS has been approved and i should bring the missing document on my interview, what exactly will be mentioned in the interview mail. NVC doesn't need anything else for AOS... Huh... DS 260 has been reviewed and accepted, BUT IV package has not been reviewed yet, to wait for the info in the next two weeks or longer... It's been 4 weeks till now... I hope they will review the package sooner... hope... hope...

    I had it luck till now all the NVC representatives was super cool and nice :)

  3. Hi! Sorry I'm not sure if this question was asked and answered before but does NVC wait for the checklist response before they look into the IV supporting documents?

    For example, AOS and IV packet were sent and received on different days. A checklist was received for AOS before the IV packet was reviewed. Will they go ahead and review the IV packet even if the response for checklist is not yet received? Or they will wait for the response before they review the IV packet?

    Same here, we received check list about birth/marriage certificate, police/court record, and when I called yesterday the representative told me that my IV package has not been reviewed yet, and to not send anything still and to wait for the e-mail. I don't know maybe they reviewed response on AOS check list so they ask for my documents before they even new that the package is in the building.

  4. Question guys... so i received the official check list today and on the last page (checklist) it says I need to resubmit i864ez and that's it. However on page 2 and 3, it talks about sending in marriage certificate, birth certificate and PCC. When i called last night, Gus told me that i need to send in Birth/marriage certificate and i864ez. I just talked to another agent after seeing the checklist and she told me that my IV document hasnt been reviewed yet and that all i need to send right now is the i864ez. Any ideas about the requests in page 2 and 3 vs the last checklist page?

    yes, the same one without financial support. i have doubt that they didn't rewieved yet the for package, but i can't get them on the phone yet

  5. I've seen a few like this, I would call and make sure that it isn't a real checklist, even though it's asking for specifics. If I were you, I would call to see if they even started reviewing your IV package. If they have and the checklist is real, the customer rep will tell you if it's unsatisfactory for their liking, or if they lost it. I hope it's a false alarm for you :).

    Yesterday we got check list... I'll call today, but just wonder is there anybody with the same experience, because from everything listed it's looks like they miss almost everything from my IV package. I sent everything originals with apostille with translations...

    We have reviewed the documents which you submitted in support of an application for an immigrant
    visa. Please review the information listed under each applicant's name and provide any documents
    which are indicated as missing or need additional information. You must submit the required
    information. Failure to provide the requested information will delay your immigrant visa interview.
    Please read the enclosed information to determine where to send all required copies of missing
    documents. If you have any questions regarding this letter, please call the National Visa Center at (603)
    334-0700 between the hours of 7:30am and midnight ET.
    Please include a copy of this letter with your correspondence and write your case number clearly (exactly
    as it appears below) on the upper right-hand corner of all documents.
    From the date you mail or transmit the requested information, please allow 20 business days for NVC to
    review this documentation/your mail. When we complete our review, the NVC will notify
    you/petitioner/beneficiary/attorney with information regarding the next processing step.
    If a period of one year passes without contacting the NVC (by e-mail, telephone, or mail), all
    submitted fees and documents will expire. Upon expiration, the fees and documents would need to
    be resubmitted in order to continue the immigration process.
    CORRESPONDENCE INSTRUCTIONS:_________________________________
    When responding to the National Visa Center, please include the bar code sheet that came with this
    letter. Failure to include the bar code sheet may cause a delay in the processing of your case. The bar
    code sheet should be placed on top of all documents being submitted for this case and mailed to the
    address provided.
    ______3 - BIRTH CERTIFICATE:_______________________________________
    Please submit this applicant's original, or a certified copy of the original document listed above. Each
    applicant must obtain an original birth certificate issued by the official custodian of birth records in the
    country of birth, showing the date and place of birth, and the parentage of the alien, based upon the
    original registration of birth.
    Documents must be from the appropriate issuing government authority. Failure to provide the
    correct document will delay your case and may result in re-scheduling of your interview or refusal
    of a visa.
    The certificate must contain the following information:
     Person's date of birth
     Person's place of birth
     Names of both parents, and
     Annotation by the appropriate authority indicating that it is an extract from the official records
    If the certificate is a certified copy of the original, it must come from the issuing government authority
    and it must contain annotation by the issuing authority indicating that it is an extract from the official
    records.
    In addition to sending the original documents or certified copies of the documents to the NVC, a
    photocopy of the original documents must be submitted.
    Unobtainable birth certificates
    If the applicant's birth record is unobtainable, please obtain a certified statement from the appropriate
    government authority stating the reason that the applicant's birth record is not available. The applicant
    must submit secondary evidence with the certified statement. For example:
     A baptismal certificate that contains the date and place of birth, as well as both parents names

    Suitability of documentation for immigration purposes

    jurisdiction over the person's place of residence. The certificate can usually be obtained in two to four days and there is a 50
    denar fee. Macedonian citizens not physically present in Macedonia may apply for the police certificate through Macedonian
    diplomatic or consular representatives abroad. Police certificates are not available for foreigners who live or who have lived
    in Macedonia.
    ______MACEDONIA COURT CERTIFICATE:_________________________________
    Available: The court certificate (sudsko uverenie) is issued by the Basic Court (Osnoven sud) of the
    district in which the applicant currently resides (or last resided) and indicates whether the person has
    been convicted and/or sentenced in a court or if a verdict was rendered against the person for any crime
    which carries a potential sentence of a monetary fine or imprisonment of up to three years. The
    certificate may be obtained in about two days and there is a fee of 400 denars. Macedonian citizens not
    physically present in Macedonia may apply for the police certificate through Macedonian diplomatic or
    consular representatives abroad.
  7. My case is being delayed.... because of DS 261 resubmitting.. :o:crying::crying::crying::crying::crying::crying::crying: ..

    Please get me out from this worry

    From my signature you can see that we were waiting 27 business days for IV bill... I accidentally resubmit the form, I called to many times, one of the representatives check with supervisor and after 2 days we received the bill. She asked me than did i changed something and why is resubmitted, they can see it's resubmitted. Don't worry, just call, explain and ask, it's not a big deal, but delay... yes maybe is because of that.

  8. We have a similar situation. I read that as you don't need a certificate from a country you're not a citizen of unless you lived there for 12 months or more.

    Thank you, I understand it like that. Because i didn't even been there continuous 7 months, but there was no option to explain that on DS260 so i put from... to... it was 10 years ago during my master studies. I live on my current address since i was 14, i went for study and returned.

  9. I need information if someone face similar situation...

    Do I need police certificate for live abroad 7 months for study? it was not consecutively stay, but I didn't have option to explain that on DS 260 form because it's from... to... I lived before on my current address, and I returned and still live on same address. From NVC web-site you need it if lived in a different country for more than 12 months? M I correct?

    An applicant must obtain a police certificate from the local police authority:

    IF you…

    AND…

    - have been living in your country of nationality at their current residence for more than 6 months

    you are 16 years old or older

    - lived in a different part of your country of nationality for more than 6 months

    you were 16 years or older at that time

    - lived in a different country for more than 12 months

    you were 16 years or older at that time

  10. I filed my taxes on April 14th, and was able to get my tax transcript today, May 15th. I filed MFS, and it was a paper filing - not an electronic one. According to the IRS site, I should not have expected my transcript until June 15th, but I guess I got lucky.

    My AOS was submitted on April 9th, and was scanned in on April 15th, but passed with flying colors (no 2013 tax info requested). But I have the 2013 transcript up my sleeve if and when we ever get a case complete and an interview!!!

    Lucky you! We're still waiting, but my husband respond on the second check list again with W7 and 1040a, but this time he also include my ITIN number, first time was not ready yet. Hopefully they'll have understanding and accept it. I sent my IV package over yesterday.

  11. No you do not.

    1) if it is just the uncle, aunt and you as the beneficiary with no children or dependents, then yes, $30000 for 3 people is enough.

    2) same amount of time as it takes to originally process the AOS, up to 30 business days.

    You don't need a lawyer but you will need convincing evidence that your marriage is not for fraud since you have a history of trying to get to the USA. Two of those were because of wanting to visit your fiance and wife obviously, but it's something to be cautious of.

    Thanx, also I decided not to call NVC for my small mistakes on DS260, I'll correct them on the interview, I saw on some treats that's what people received as an answer when called NVC for same reason.

  12. I've heard that you can call in and ask them to "unlock" it so you can correct something. Worth a shot!

    I'm thinking I'll send in copies of both passports, since I filled in the i130 with the old one... just for continuity.

    Do you need a police clearance for the other country? If you were there more than 6mo, I think you're supposed to have one.

    I'd start calling around Wednesday of next week - as others have said, it seems to be taking pretty much exactly a month after receipt.

    Also, I'm pretty thrilled to report that I got to fill in a form today! Choice of agent form was available and I appointed myself and sent that sucker off! Whee! :D

    It was 2004, I have foreigners permit of stay that we received in police. Is that enough? I don't know how will i obtain new one!!!

  13. IMO, read Saylin's WIKI and only send what is required. You are already approved. NVC doesn't approve anything, they only process the Visa paperwork. You can take your extras to the interview and if they ask, you will be ready

    hahaha, I read it, I'm obtaining new ones, I'll send them next week, that's one of representatives advise me. Some are valid 6 months, some only 3, so after submitting DS260, I went to obtain new, but it's fast here, and translators will change only dates. ;)

    yesterday while i was filling DS260, i was wondering, I'm master of science, so i was rechecking the dates and streets from high school, that was centuries ago hahahaha, so everything crosed my mind like this permit of stay LOL

  14. We didn't include 10 years of employment. We only used his emplyment from 2009 to present. Our DS260 was accepted and I was told by NVC to provide the employment history during the interview. Don't worry !!

    They are more worried about the crazy ridiculous questions they ask !!

    yes :))) i want to ask another thing, i used to study abroad, and i have foreigner permit for that period should i send it with my civil documents? also the visa, on the old passport i thougt it's smart idea to send them. what you guys think?
