yes Terry you are spot on, there so many people on these forums who are bitter about it for some reason.. I didn't even know about the adjustment of status option until well after I filed my i130 (ten months after) and was visiting my husband in the US when I made an info pass appt and found out from the immigration officer about it. She actually said I should have done it all along to make my process easier. When i came on here and innocently asked about it, i was attacked it was the first time I had found the forum so I was shocked. A few people reached out privately and told me not to listen to them and go ahead with it. By the way You can actually file the AOS without an approved i130 NOA, i did with just the pending NOA and it worked for me. I filed in Nov and got my greencard two days ago.

Hi everyone,
I'm very new to this forum but have looked at it in the past to get some ideas as to what could be holding up this whole process. I married an American in Feb this year, that same month we file our i-130, once we received our noa we file for the i-129f to speed up everything and get to NY quicker. We were both living in Dubai at the time of our application and I'm from Australia, we filed it though in the US. Thinking that I would be legalised to move to the Us by July we packed up and moved to NY, where I am currently on a tourist visa which my 90 days runs out end of Nov and then I'm off to Australia to wait it out.
Its been a long process and we have not heard about either application. I think my priority date is Feb 27th as thats my receipt date on my noa. For the K3 i 129f our receipt date is March 25 2013. Thats the one that has left me dumbfounded as I have not heard a peep about it since the noa back in march this year. When ringing the call centre (which i would rather pull out my teeth then deal with those useless conversations that give me no answers) they can provide no info on the k3. The last time I rang we were able to speak to a tier 2 I think it's called rep about the greencard in which she said that its an 8 month wait to hear something and we are in our 7 month. However counting from Feb we are clearly in the 8 month mark.
Now the update, a letter arrived yesterday saying our case has been transferred to nebraska, finally something to say that something is actually happening. However from what I gathered this might not be a good thing also. in fact I can't work it out, I noticed people who got transfers a coupke months back were approved within a month some even a week. But now I am reading that people are being told its a 16 month wait!?
The thing is, is that we also have applied for our k3 way back in march and even that is not helping anything so I dont know what to think. Also is there a difference between a citizen and a PR apply for their spouse? Mine is a citizen.
Anyway any info you could share would be greatly appreciated.

Sorry to hear how stressful your interview was I hope it works out for the best and I'm sure it will. I have to say I agree with Harper and Aussie as I had my interview today and read up a lot on interviewing yesterday. I think the whole point is to piss you off and rile you. I read somewhere a great piece of advice that says 'prepare as if you are going to court to fight a case and prepare to be cross examined'. I think we can all agree after watching movies that cross examination is hard and rude. Your IO sounds like a douche but bc of high fraud and obviously your husband being egyptian maybe he has to be that way. I also rad yesterday to not take any of it personal as it is their job to be tough. SO don't take to heart its obvious that your in a bonafide marriage and I am sure that loads of cases were so much worse then yours and probably even fraudulent and still got thru. I'm Australian and my hub is USC and we were hoping for an approval today and didn't get it and even though we laughed with our IO it was still tough and we are disappointed that we have to wait, so if they were tough on us they will definitely be tough on you but I think it had to to be that way so stay positive as It prob went the way its supposed to. I hope I make sense. Write back and lets us know the outcome!

I lived in Dubai and filed from there with my husband, when are you wanting to move to the US? is there are time farm or are you just going to do it eventually one day. If you want to file from there, I sent everything off there is no DCF (direct consular filing) from dubai or abu dhabi so you have to send it to the lockbox directed at overseas applicants. You can send an international money order from your bank in dubai, just request one and they will be able to do this.
For evidence of bona fide marriage I had exactly the same problem as our apartment and everything there was under his name. We have affidavits from friends who have known us for years who wrote statements about our relationship, how long they have known us, and how they know that we are a couple. it seems to be enough for now, once you get to the interview one day then you can have other documents and photos to show.
by the way when we did it, we got my husbands brother to mail the package and do a US money order, but you can do an international money or, or deman draft check. You can also call uscis and they will explain this.

The problem is US immigration Law. It's vague, its weird, it doesn't make sense and lets face it whether you knew about AOS or not (which I did not) how do you prove it. If it's such a problem then AOS just shouldn't exist…but it does so really I don't think its such an issue. I am going ahead with it and finally have everything together to file. I could not be happier with our decision and wish I knew a little earlier about it, before my VWP ran out a week ago and also I could have been working to help support the household with my husband. Its been a really tough year. But whatever I know now, and am thankful for the good advice I have received on here and the people who reached out through personal messages telling me not to worry about the negativity coming towards my post. Will let you all know how it goes.
Thanks I'm going to file all my papers tomorrow!

Yes thanks, we have definitely covered this well and truly, and when i entered my intent was always to return because I didn't know any better, i also knew I was going to return this is something that came up yesterday as an option for us.. If you read the whole thread we have well and truly covered where we stand.

ARGH!!!! Thanks everyone you really have cleared up a lot for me and I really appreciate it. Harpa you are amazing with your knowledge and I appreciate the help! I have called up to make an appointment tomorrow or friday for a medical and if I can get my birth certificate sorted I might even make the 2 week mark anyway.

Yep thanks, I think thats why we were even told about it by this Lady in the first place. I mean the form doesn't exist for no reason, if it wasn't an option there would not be a form to begin with. I can't imagine US immigration making a form for a situation they 'frown upon'…. Obviously its not an option for everyone and for us it is which is why we were told about it in reference to 'OUR' specific case. In fact if people are going to comment what I'm doing is fraud and what have you then they shouldn't bother as of this morning I will not pay attention to those comments.

It seems I have tapped into a touchy subject when really I had no idea what this whole AOS thing meant or was even possible but as a few now on this forum and others who have reached out to me personally have said it IS possible and an option especially as it was presented as one to us by USCIS themselves in a personal one on one interview. I don't think the papers would exist nor would a second person in the NY field office give me the package so freely if it was an issue for our particular situation.
I do agree that USCIS well over the phone mainly are ridiculous with the info they give or don't give but I was at this interview with my husband in person and the person I dealt knew what she was talking and did not suggest it until my husband asked whether I could be interviewed in the US as opposed to sydney. I can understand why people are disgruntled about it as it might not be an option for them and knowing its an option for others is frustrating as this whole process is a nightmare. I'm not sure what we will do at this stage, as I'm still waiting for an approval and by the time that comes it might even be the same length of time to finish the process out in NVC and Sydney as it is to Adjust our status here, its not instantaneous. So we will have a look into it and see what suits us best and what is the cheapest option considering airfares and all that.

Your wife needs to contact a tier 2 by calling the USCIS. The USCIS will not talk to the beneficiary. If they cannot help her she can contact her congressman's liaison to find out what's going on with your case.

you must keep this in mind: every case is treated differently. where as you may see some people who applied after you and they are already approved and then you have someone like me who applied in july 2012 and don't have any noa2 yet...but my case did get transferred in June I did get a notice in the mail....
