  1. just attempted a walkin today. major fail. they asked us why can't we make the date I said we are going out of town during that time.. we are not actually. he told us to come back with our itinerary as proof.. what should we do? ;----;

    what should we tell them? we want to do our biometric asap

    i did the same as you and I really was going to nyc during the period of fingerprints so i told them that its holiday season and Im travelling to another state. Thankfully they didnt ask for evidence (what evidence ca i give them anyway except my words). I felt like a high school student being blamed by the teacher. The bimetrics woman gave me a lesson lol but then she accepted to do for me. I was extremely nice and I showed her a cute sad puppy face. It works with some offices and not others. Just be patient and go on your appointment day. :) Good luck

  2. You cant work before EAD. No good employer will hire you without EAD anyway unless they will give you less than the minimum wage and no benefits whatsoever. Good luck explaining that to USCIS. Please tell your fiancee to read USCIS website before giving you an advice that can result in your deportation.

  3. I got an RFE for a birth certificate and a tax return for the last financial year. I gave the lawyer an original copy to send, maybe I gave them a photocopy with the I-485 originally...

    Is it still possible to get another RFE for a joint-sponsor? We are above the minimum this year, but my husband didn't work last year, and so his income is $400 shy of the poverty guideline for the most recent tax return.

    Does anyone know if the EAD and AP continue to be processed while an RFE response is under consideration?

    I didnt know you should send an original birth certificate.

    If he does not have a tax return for the last year, its good to explain in a letter as to why he didnt.

    You shouldnt need a joint- sponsor but honestly i dont know. I have seen people complaining about uscis sending them random Rfes.

  4. 1) Interview is usually (if no RFE and no problems) 5 months from the day of filling. I have seen applications get accepted within 4 months and some 3 months. I hope we will be from the lucky ones.

    2) EAD takes 90 days then again I have seen EAD's coming 2 months only after filling and (2-3) weeks from biometrics appointment .

    3) Im not sure about the earlier interview thing but I would say "call them" and they might do it quicker. I have seen people calling to expedite EAD (maybe the same thing with interview??? I dunno)

    4) Unfortunately, YES. You can even get an RFE on the date of the interview.

  5. When they send you the interview notice, its usually a month or so before the interview date. That means even if he receives the letter while you are not home, I think you will have time to return back before the interview. I don't recommend rescheduling because*sometimes* it takes several months before you will be able to have a new interview. Better be safe than sorry. If the wedding is not so important then drop the idea of leaving. You are almost done and an interview letter will arrive soon.

  6. YOu need to call couple surgeons to see their price (big difference from one to another) and I think a scanned copy of your vaccinations is enough. Mine was sent by email and the doctor accepted that with no problem . I had to do 2 vaccines only.

    For the co mingling of finances and stuff, everything counts. Have him add your name in any of his bills, have joint Macy ,target,walmart card. From now on you should try to gather evidence. Receipts of wedding rings, restaurants , honeymoon and trips. also, he can add you to car insurance and life insurance. you will still have time to gather all of this for the interview but its a good idea to have solid primary evidence.

  7. After your marriage, you need to go back to the philippines. It is also a must to leave within the expected date of leaving US. You are to be petitioned on a spousal visa when you get back to the philippines. You cant stay in the US because you just married your Fiance in the US.

    Please make sure what you write is accurate and true. As long as she came here with no intent to adjust status and stay in the USA then she can adjust her status without leaving the US. its a short cut and we have many successful stories on VJ.

  8. You can get a social security number when you receive your EAD which is usually 3 months after applying for AOS.

    There is a table somewhere that shows poverty guidelines for a household of 3 people (you, your husband and his son). You can decide after that if you need a sponsor or if his salary is enough on its own.

    You need a lot of proof (not just a lease). A lease is very important and if you will live with his parents then a statement from them saying you guys live with them will do the job. You will need evidence of co mingling of finances( joint bank account,car insurance,health insurance, credit cards, bills with both your names or to the same house where you both live). The more evidence you send, the merrier. Also pictures from the wedding and different occasions.

    If you move during your AOS process then no problem at all. All you have to do is file for change of address and call USCIS to tell them your new address. This is a very important step. CALL uscis as soon as you change your address.

  9. Worst case scenario is if they lose your file. You can ask for refund from USPS. I send mine with UPS with a normal mail (no priority and no express) and it arrived in 4 days. After one week of sending I recieved a message from USCIS that they received my package and 3 days later I got the NOA. Your package shouldnt take more than 3 days to arrive and maybe one week for USCIS to send u notification. I would only worry if I dont receive anything within 2 weeks.

    belinda63 : Yes he started getting unemployment but also he gets social security benefits (he used to get that while he was at college) and even when he graduated and got a job, they kept sending money to his bank account until now. During all this time, he contacted them and he didnt want to have to pay back 3000$ so he wanted them to stop but in vain. The problem is that even if he still can get Social security is that we did not mention that in his annual salary on the affidavit (thinking he will need to return all the money he got and that social security is doing it by mistake). I will call USCIS tomorrow and see what they say

  11. Hi guys,

    During the process of preparing for AOS, my husband got Social security benefits even though at the time he worked. He called social security to stop sending him money because he has a job. They asked him to fill in an application and send it by mail (which we did). What was supposed to happen is that my husband will return whatever he got from SS by mistake. When we filled the AOS affidavit of sponsorship, we didnt mention about getting money from SS since we thought this is a mistake and that my husband needs to return whatever SS sent him (because he works). Yesterday, months after not hearing from SS, my husband called them again to see what is going on. The woman on the phone told my husband that on the system she has nothing that says my husband got money by mistake or anything that shows that my husband needs to return money and since he got terminated (before filling AOS) he is eligible for SS. The thing is that He still got the money while working for ONE YEAR. He called and went to the office many times but they obviously want to keep giving him money lol.

    My problem is that we didnt mention that on the affidavit thinking that the SS money will be returned and no other payments are going to be done. What to do now? should I call USCIS and tell them about this or should I explain that during the interview? an info-pass?

    Im not sure how serious USCIS can look at this and We dont want to mess with the government for sure.

  12. That damn work authorization card also contains advance parole. I really am stuck. Maybe I should say it in Italian... sono bloccato in America!

    By the way, we do not plan to spend the rest of our life in the US and we would like to keep the option of seeing each other's family. Breaching my immigration status would just prevent us from being able to see each other's family.

    I am also concurrently applying for my husband's European citizenship, which will take about 3 years from the date of wedding for him to get. My hate for the government is not just a hate for the US government. I just think this immigration is BS. There are Mexicans everywhere who just come to the US and give birth to a baby just so they can stay in the US. And there are North Africans who sail in a crappy boat across the Mediterranean to dump themselves on the Sicily coast without any documents so they are forced to stay on European soil because nobody knows from what country they come from.

    We are not that way. We are really in love and the government had done all kinds of wrongdoing upon us. I am so frustrated.

    And I am a Republican too.

    another option is to get a letter from employer and call USCIS for infopass to fasten your EAD. the letter should show real necessity for an early EAD. That might work with you.
