    Yes, as Carla mentioned that´s the best way... to consult an immigration lawyer at this point....and believe me you aren´t alone in paying so much money in seeing each other.... I have done so for the past two years with my partner who lives in Mexico... we see each other every other week or maximum every month.... that´s expensive... been back and forth between Mexico an Miami is expensive...
    We all have gone thru it... and I agree with what Carla say... a lot of people are using the B2 visa as a way to enter "legally" and live here... just because you have a tourist visa that allows you to enter the US does not mean you are ought to live here legally and try to avoid the process... that was a red flag for the officer.... but at least you are both fortunate that you are a USC, compared to other people who live here illegally that have no hope whatsoever... check the timelines and consult a lawyer... good luck!

    Medical student, first off, good luck with your residency applications and I am glad you passed your MLEs.... please see below:
    Tourism and Visit (B-2):
    tourism vacation (holiday) visit with friends or relatives medical treatment participation in social events hosted by fraternal, social, or service organizations participation by amateurs in musical, sports, or similar events or contests, if not being paid for participating enrollment in a short recreational course of study, not for credit toward a degree (for example, a two-day cooking class while on vacation). http://travel.state.gov/visa/temp/types/types_1262.html
    Also.... you mentioned that you had a marriage license and intention to marry in the US after entering with a tourist visa, that´s illegal to do as well.... you cannot enter the US on a tourist visa with the intention to marry a United States citizen... I am not saying that you had intentions of doing things illegally, but remember that immigration officers see things either black or white.... and to them, you were doing something illegal, even if those were not your intentions.... you should have consulted a lawyer before you both decided your fiance was going to move to the US or before enrolling the child in school.... it is just a general concept that in every country you go to, you have to go through legal documents in order to study there... you went through it when you studied in Mexico... I think the people that you should be calling ignorant are those school officials that enrolled the child in school.... we are just trying to provide you with advice.... I understand that you are frustrated, but I do not see any disrespect from the VJers towards you...

    Hello everyone,
    I received a text message at around 10:30pm EST... I went online and........ case APPROVED on November 25, 2013..... wow!!!!! almost exactly three months!!!!!! no RFE!!!!! I guess things are moving along just fine.... we are so happy!

    it depends on each individual.... I would say if you are confident with filling out the application and sending it and have all the proof for the interview, you do not need a lawyer... now, if your case is more complicated, meaning arrests, overstayed in the US, other types of issues, you might want to consult one... good luck!

    if you submitted the form G1145 you should have received a text message and/or email by now... if not, then it will arrive in the mail... hang in there.. it might in today's mail or tomorrow's.... like I said, give it maximum 30 days, if not, call them... take care!

    I just read your entire post like three times.... I was confused with someone who entered the US legally and then got married here... I thought for some reason you both got married here in the states while she was here.... In this case that you got married in Canada and then entered the US on a tourist visa, and want to adjust status here while on a B2 (tourist visa) it is a little bit dangerous.... the officer will ask if you she had the intent of staying here while she entered under the B2 visa and this can lead to the adjustment of status to be denied.... it is illegal to enter the US with the purpose of adjusting the status here....
    To be honest, it might be safer for her to return home and you can file I130 while she is in Canada and once she enters the US then adjust status... that way there is also record of legal admission into the country and not like now that you don´t know or cannot find the information for the I94..... maybe another person that has gone through this situation can help you a little bit more....
    She can definitely visit you while the I130 is pending but in that case I would also recommend short periods of stay for "vacation" purposes.... Have you consulted a lawyer??? There are many out there that would give you free consultations.... try going to a few and see what they say.... I am not a lawyer so I am limited on the suggestions I can give you...
