    I have heard of a handful of cases where an MTR was reopened as a result of providing a new document, but admittedly it is very rare. The typical result is the denial remains.

     

    Correct. There was no reason for the I-130 to be denied as that is unrelated to the I-864/I-944/I-485, etc. The I-130 is only the petition to recognize the legal relationship between petitioner and beneficiary. As long as it was completed properly and that evidence was provided, it should be approved.

     

    When you refile, you only need to file the I-485 packet...not another I-130. Attach a copy of the I-130's NOA1 or NOA2 with the I-485 packet.

    Note that the packet must be complete - I-864, I-944, supporting documents for each, etc. The I-131 and I-765 are optional but highly suggested as there is no extra fee for those here.

     

    You can wait and see what happens. As noted, it's not impossible they will reopen it, but it is pretty unlikely IMO.

    I am hoping that since the i-130 happened after the denial, that our file is still being processed and that they would adjudicate our case along with the new evidence. It is just hard to refile now and not be wary that we would cause confusion and make the process longer. I am thinking we would give it another week or two... at least before the date they are being asked to leave the US before sending the new package. 

  2. Hi @Me & Him do you have any updates to your case? We are in the same boat as you with my parents’ case. We forgot to include the affidavit of support with the i-130 and i-485 (we did concurrent filing) and we got denied, so on March 3 we filed a motion to reopen along with the affidavit of support. How long after you sent the i-290b did you get a notice that they received it? We haven’t gotten any replies yet.

  3. Thank you @Boiler and @geowrian for replying to my thread. Unfortunately I found little info here about concurrent filing and I’m sure now with the new changes it is even more confusing for new filers. Just wanted to give an update on what we did and what recent developments are:

     

    March 3rd we sent an I-290B Notice of Appeal or Motion to reopen our case. I included the affidavit of support along with the new i-944 declaration of self sufficiency. At the time we sent this new packet, uscis status online showed the i-130 as received and the i-485 as denied.

     

    Today, we received a notice in the mail that as of March 11th, the i-130 was approved. This was really good news! However the same notice also mentioned that the next step is to file the i-485. Now that makes things a bit confusing since we already filed that form previously, but now we are not sure if they want us to file the new version of the form (We filed concurrently before they updated the form).

     

    Also worth noting that they haven’t sent us an acceptance notice for the motion yet. What do you guys think? I feel like we should at least wait until they give us an answer about our motion to reopen, before sending another i-485 which might cause more issues. Also want to avoid spending another $1400++ if at all possible.

  4. Hi all, anyone have experience or was recently approved their parents’ immigrant visa using concurrent filing? We files August 2019 but i stupidly forgot to add the affidavit of support. Yesterday we checked the status online and saw that the application was denied. There could be other reasons as we haven’t received the mailed notice of denial yet (online status doesn’t say why it got denied) but i think it is probably because i did not include the affidavit of support. Makes sense they would deny especially with the recent public charge ruling. So my question is, aside from the i-130, i-485, birth certificates and affidavit of support and its supporting documents like tax returns, employment certification etc. are there other documents I need to submit? Do we need to do medical exams/immunization records for them also? If anyone has a checklist they can share that would be greatly appreciated. I successfully did k-1 visa before and now am a US citizen but this is totally different and not much info I can find online. Thank you.

  5. Hey I'm from SD too, National City. Arrived in the US a year ago, and I was in the same boat as you for seven months :) I just started working near at University City, that's near Mira Mesa. Don't worry, it will get better, enjoy the time that you have now! I used to get bored too but it's the best time to take up a hobby and learn how to drive. If you need to hang out just message me, maybe I can visit sometime! I'm from Antipolo in the Philippines.

  6. I had my medical around a month before i had my visa interview, I think that was november 2013. I guess that would make it over a year ago from now. I only did it once.

    Yeah absolutely, when I was waiting I was checking my status everyday and always checking this thread for updates. I know this whole process is a big black box of possibilities and it does help when people share what they did to get an approval. I hope this means that cases will start to move again and more people get approved.

  8. Hey everyone, quick update, I received the NPIW letter last june (dated June 5) and yesterday, Jan 7, the online case status said "new card is being produced". We filed a service request last Dec 8 and exactly after a month my GC got approved. We only filed a service request once. Hope it helps anyone who is still waiting. My husband kept bugging me to file another service request but I wanted to wait until after a month, good thing I didn't file another because that could have messed up the records. Hope this helps.

  9. You need to speak to a Tier 2 person who is an Immigration Officer (IO). The first person that you talk to won't really have anything specific about your case. When I had sent my AOS application in, I was always told that they could not find my file in the system and I insisted on being transferred to the wait for a tier 2 operator. The tier 2 person was always able to update me on the status of my file.

    Hi moemac59 thanks for the tip! I'll try it when I call them again, did not think of that earlier tsk tsk...the tier1 just reiterated what I already knew from their automated system, sigh. Even when my husband, who is in the US navy, tried talking to their lawyers they gave him the same answer. I was hoping they would have more input but yeah...I'm just hoping this just means they are updating our case! I feel like they're just giving us canned answers.

  10. Been calling uscis for the past week, since our case is now outside of normal processing times. Filed last Feb 25, 2014, then got a letter last June 5 that our case will be delayed for approximately 6 months. Now it's December 8 and when I call USCIS the system tells me that my case could not be found. How convenient for them to have their system break down when people are going on vacation and not around to fix stuff...seriously this is making us very frustrated and sad. Anybody else in the same (or worse) situation?

  12. You're husband is a navy man see... :)...i used to live in San Diego, i lived there for 13 good years... just moved here in Hawaii a year ago...Filipino community their is pretty large..as a matter of fact you might meet someone that you know..ull be surprised.. :yes:

    Yes, there really are a lot of Filipinos here! I actually go to a church that has a number of Filipinos, and have already made a few friends :) I'm still looking to meet more hehe, hopefully I do meet someone who I know! Thanks for your advice :) aloha!

    Hi Rob63! Thank you for your suggestion! I will definitely try them out. Right now, though, I'm looking to meet just a small group of people...it really is hard for me to make friends and I have difficulty being in a large group. I know, this might seem snobbish...believe me i'm not snobbing at all, just very shy :P I hope to meet a few people little by little and make new friends slowly :) how's the Filipino community in your area? Did you make friends quicky?

  14. Hello! I recently got accepted for a job and been working for about a month now, it has been a great blessing for both me and my husband. I wonder if there are any other filipinos living bear the San Diego/Miramar/National City area who recently got here or are still adjusting to life in the US? I'm still looking for friends around these parts, most of the Filipinos I know are through my husband who is in the Navy, so I really can't relate sometimes to the conversation :P it would be nice to meet other people who might also be a little homesick like me :) if anyone is interested to meet up, send me a private message! I have work until 5pm and with the horrible traffic we can maybe meet up around 6pm onwards. or if you also work around the miramar area we xan meet up for lunch too! Looking forward to meeting fellow pinoys!

  15. Hey all, just wanted to share the happy news that I just got my driver's license yesterday! It was my first try, too! It was SO nerve-wracking! We practiced an hour before I took the test and I was so nervous that even my husband wasn't expecting me to pass. He told me, "just be careful you don't wreck the car" LOL. The driving test was about 15 mins and I got a few mistakes here and there, but I passed! To all of you out there who are nervous about getting your license, don't fret and just keep practicing. Keep reading your dmv handbook and don't feel bad when your spouse/family criticizes your driving skills! They're really just scared for you and want you to be safe. Try to practice in an area near the DMV office where you'll take your test (you can pick any DMV in your state so pick one that has an easy driving route, that way the test won't be as hard). Keep calm and just drive! It's easier when your nerves are not trying to mess with your driving ;) And memorize the right of way rules!!!

    The process will not necessarily be delayed by exactly six months. It can be longer (happens rarely) or shorter (happens frequently). I got that letter last year and got my GC approved two months after receiving it.

    Checked the thread, wow, I really hope some of them get their gc's especially the ones who have been waiting for more than 12 months! I should consider myself lucky then. Congrats on receiving your gc and good luck on the next step!

  17. HI everyone! Just wanted to know who else is waiting for their green card and received the letter that green card applications are getting delayed? We applied for my green card last Feb 27. I already had my biometrics last March 24 and we received a letter dated June 5 stating that we might not need to go through the interview process, but that the process is getting delayed and we should not expect the green card for at least SIX more months! I plan on going back to school and I can't qualify for any scholarships and grants until I have my green card...Wondering if anybody else is in the same boat? I checked the processing times for LA, and the processing timeframe is November 26, 2013...funny thing is when I checked the processing time last week it said they're on December 2013...funny how it moved back a whole month. :|

    I'm totally in the same boat. I was in I.T. for 3 years back in my home country, and i'm now contemplating whether to keep looking for I.T. jobs or finding entry level work and go back to school. I'm finding it really difficult to go back to I.T. since a lot of the companies here don't seem too keen on investing time to train new hires in the tools that they use. Back home I was used to doing tasks that we're less complicated than what is the norm here. Here, employers expect you to be an expert before they hire you...which is fair but the skills and tools are so varied that it's hard to be an expert in one especially since I didn't spend too much time on any one of those tools, maybe just months...That's why I want to go back to school and get a fresh start. I figure i'm still young enough and the experience of learning alongside other people with sharpen my people skills and I'll get better at interacting with Americans. I have a phone interview in a few minutes....so nervous! The position is quite technical and I'm not sure if they would be open to someone like me. I'm not familiar with the tools that they use but I have a track record for learning quickly.

    Question, if I'm only a green card holder with barely enough credit, what are my options for paying for a college education? Can I get a loan or a scholarship, or will I have to pay for it myself? I really want to study again but our income is limited and we can't afford tuition right now.

  19. Hi! I'm taking a chance posting this on here. I'm not really sure if this is the right forum to post this in. Chose the regional forum because the job will most likely entail working with off-shore teams located in the Philippines, and being fluent in Tagalog is expected :)

    So my former boss is looking for an experienced QA/software test analyst. The job is located in Atlanta, GA. I used to work for the client (as an on-site lead for the offshore team in the philippines) and they wanted to see if I'd like to work for them again. They have three openings, all in QA, and if anyone is interested you can message me for the details.

  20. I'm cracking up just reading this thread :D i'm from the philippines, and from my experience growing up there it's also not that normal for strangers who just met to hug each other. If it's family reunion and relatives meet for the first time then yeah, maybe a hug is normal but if someone introduces you to a friend it's usually just a handshake (or even none at all, i usually just wave my hand a little and say hi :P ) so when i got here, and got introduced to my husbands male friends, it was a little awkward to give them a hug...usually they expect it when we're about to leave the gathering. i usually just end up giving a half-hug, where i put one of my arms around them but not facing each other...i just find it so weird to touch bodies with them haha! I like my personal space, thanks very much. And even the girls, when they hug my husband, i get this little urge to pull him away because it's just so unnatural for me to see that. What's funny is they're from the philippines too so i'm like hey! That is not ok! XD but I just say that in my head haha. This hugging people for no important reason has got to stop, okay? I will hug you, but it will be very awkward and may cause me to avoid you for the rest of the evening :)) and gurrrl if you hug my husband, i'm keepin' my eye on you :P

    Ahaaaa...a Hospital Corpman...one of the ratings you never wanted to ruffle their feathers...the others being the Mess Specialist (Food), and the Disbursing Clerk ($$$). :-) HC's have access to needles and shots...haha. Well, in the day the CT rating was a good rating to be in. Ask you husband if he's heard of it. He's stationed at Balboa?

    I'm being lazy at the moment so I'll Google Antipolo, Rizal later...new places interest me. CDO is just fine and it's a pretty safe city but not as safe as Davao. And yes, you'll enjoy the food!!

    I'll go with "you'll be fine in time", so perservere and things will change...change may be hard, but it's good.

    Feel free to PM me and I'll pass it on to my asawa. Even though she's been here over 2 years, she fully relates to how you feel.

    Yup! He's in NMCSD in Balboa Park. He's a pharmacy technician, so yeah, he's got access to all those free meds :D Balboa park is amazing, especially with all the museums and gardens. I really love living here in San Diego, and I'll miss it if he'll PCS and I have to go with him. Well, there are more places to explore, that's the beauty of his job!

    My wife cooks a lot of international dishes, currently on a Thai cuisine kick which I am enjoying very much. She's on a diet, so she cooks it and then sits across from me while watching me eat it.

    Affairs are overrated, rlogan. I'd rather get cozy with some ice cream and pizza :D You know, when my husband is not at home. LOL!

    Woah, thai food! Send over some pad thai, will ya? Our area is teeming with Thai restaurants, some nights i just get tired of cooking and we drive down to one of two Thai restaurants within a 1 mile radius of our house. And it's always packed! You're one lucky guy!
