  1. This morning I wake up and wonder about the call I got yesterday from USCIS and if it was for real. I know there's scammers out there that pretend and all.

    My case is bit unique in I'm changing my pending AOS from employment to marriage (see timeline below). During this process I got confused/frustrated and emailed some people to help me figure it out, look into my case. Last response I received was that my case was transferred to NBC from Nebraska and that meant I am being processed as a family based case and will be scheduled for interview etc. It also said since my case was out of NSC, my inquiry was being forwarded to appropriate office.

    yesterday got a call (number showed)... and was a nice woman who identified working for USCIS and she just wanted to follow up on my case, see how much progress I'd made. Didn't ask me any personal info except to confirm my address so to send me a report on what is happening next. I gave my email address to speed up hearing back. She told me she was calling because of inquiry I'd placed and she was going to look further into it. she seemed to know all my back info on case.

    so of course a part of me is like waking up and thinking...was it for real?

    I know there are scammers out there but she didn't really ask for any info except mailing address to confirm why I hadn't gotten my interview notice/make sure I get it.

  2. I nearly freaked out as I got a from some USCIS agent.

    She just wanted an update on where my case was and if an interview had been scheduled and I said no. Because of my case not being straightforward (see my signature), I got confused and had emailed some people in USCIS so I suppose my inquiry got forwarded and is being looked at. Agent was really nice and asked if I got interview date which I hadn't. She said she'd look more into it and then email me back...

    Keeping fingers crossed....

  3. Joining to see how I485 at NBC progress...although mine is a bit unique as adjusting status based on marriage but converting old employment I485 by requesting USCIS convert it.

    They transferred my pending I485 (employment based) from NSC to NBC on 8th April with notice received on 14th April that it was at NBS, Missouri.

    I'm not sure if I get a biometrics again since it was all done in 2007 at original filing. How long does it take from here to go to local field office for interview? Does local office or field office schedule interview? Anyone from NY area have experience at this stage?

  4. Also now questioning where to file...I see if it's marriage based it's at Chicago but if it's employment based it can be dallas or phoenix (based on where you live). I'm assuming I file at dallas since I'm at NY and as far as I know it's still employment based since there is no confirmation from USCIS that they converted?

  5. 1. EAD is free when based on a pending I-130/I-485. I am not sure how your EAD filed in a different category would size up here; if it has not yet been converted to family based. If it is a new category, C9, then it is actually a new card, not a renewal.

    2. Fill it out in your married name and include a copy of the marriage cert as proof of name change.

    3. Yes.

    4. Fine.

    5. Should be H1B or whatever visa you have, even if expired.

    6. I would explain the conversion part, but not the married name part. As I said, this is a new card, not a renewal.

    I am not sure how or when a pending I-485 in a different category can be converted. These answers are based on a pending I-485 for family. I am not sure if yours qualifies yet, or when that happens, or if you are able to avail yourself of the C9 category. Good luck.

    My past EADs are also in c9 category based on pending adjustment of status...so that doesn't change although the underlying basis of the adjustment has changed from employment to marriage. So where they ask on what basis, that still remains as c9, so it will be a renewal...as they also ask if you applied before, when, and if granted/denied...

    Besides USCIS will not acknowledge that my conversion has gone through and that I485 is now based on family. It's one of those lesser known processes that leaves you in limbo until you get interviewed and then they just give you GC based on family and at some point take you out of the employment queue. I don't think they ever cancel you out of employment until you get interviewed. It's one of those vague unknown USCIS processes. So in all, I am going to hold on to my I485 is pending based on employment and we've requested USCIS to convert, but are awaiting their decision. Wish they would acknowledge it in some way then I can say the same...they don't.

    My H1 is long gone...since 2007. Never renewed and I traveled out and came back solely on basis of pending I485, adjustment after that....so not sure I can put that as my current immigration status. I no longer work for that employer etc...all that long moved on....

    sometimes it's just easier to pay lawyers and i'm so tempted....

  6. Ok..so after my morning of emails...my case is again updated to "transferred to local office". I hope this time it is transferred to NY. I hope I'm not messing up by constantly emailing them etc but I have no idea why they would send it to NBC that doesn't even process I485. So hope it's going to right place now...I guess emailing did get someone to look and do something...I don't have patience for this anymore... :(

  7. First time I'm trying to do the EAD application on my own without help from lawyer.

    Just want to make sure I did it right from other's experiences...

    I485/AOS/Employment based filed in 2007 and getting EADS since then, renewed every year/two years...

    This is for a renewal EAD. Last one issued in 2010, so expires end of July 2012. (2 yrs validity).

    Got married to US citizen husband and now have an approved I130 and trying to convert I485 employment to marriage (it's doable...have looked into it and based on lawyers and USCIS...lesser known process..so no new I485 filed). USCIS is working on the I485 conversion and I expect them to transfer to local field office for interview....hopefully soon.

    Time to renew EAD.

    Questions:

    1) supporting documents: Copy of last EAD, copy of I485, passport photos, check for USCIS (380?). Should I include copy of marriage cert and I130 approval?

    2) I want to make sure new EAD is in my married name. Should I include a cover letter and include copy of I130 approval and marriage cert? This way I can work on changing my social security number...I can never figure out what to change first, my status or social security...

    3) On questions 1...your family name, I put my married name and in 2) other names, I put my maiden name

    4) question 14, status of last entry, I put "paroled/adjustment of status" as I entered that time last using an advance parole and they put paroled on my I94 card.

    5) question 15, current immigration status...."pending adjustment of status)?

    6) should I include a cover letter explaining my situation that I am in process of requesting a conversion of my pending I485 from employment to marriage and want my new EAD in my married name?

    Please advise....my first time doing this myself. I'm getting tired of my lawyer on many levels and plus paying for lil things like this.

  10. It's outdated. I sent my package in the end of February and received an interview date for mid-May. I've also seen people who applied for AOS back in September and just getting appointments made. It all depends.

    Thanks...good to know it's outdated and that it's not as bad. I just hope my case is not complicated and gets stuck due to the whole employment to marriage. There is no one else going through it for me to follow and see how they get processed... Good luck with interview. Excited? Nervous? Where in NYC do you get interviewed?

    I'm so glad you're seeing movement in your case! Today I was put in the queue for Testing/Interview.

    I find that lately the NYC offices are picking up the pace. Some people are getting their appointment date set for a month or so after they were moved to Testing/Interview or having their filed transferred to the local office. But as we all know there is no real way to determine what will happen in each of our cases.

    Since you'll likely be in the LI City/Queens location, it's not as overloaded as Federal Plaza in Manhattan one so hopefully you'll get news of your interview date sooner.

    I'm so glad to see you moving along. Keep me updated on your interview date. Are you interviewing at LIC location or Federal Plaza one?

    My case is so unique and not a straight line lol like apply, get biometrics done, changes to testing, get interview date, then interview...

    mine is back and forth....I hope and think I won't get biometrics...may get RFE for medicals as I know those require updating but figured before transfer they'd have asked for it....so not sure. Tried to make an infopass to see if I could talk to anyone about my case to at least know what to expect, but no dates seem available.

    The suspense is killing me lol.....

    Did you have to re-do your medical exam or biometrics?

    Well not so far...all I see is they transferred the I485 to local office. I only did medical once and biometrics in beginning. I've had multiple EAD/AP issued and never needed biometrics again. I'm assuming that I will not need biometrics, but maybe updated medical? Not sure what point they will ask. I'd have thought that before transfer, they'd have cleared RFE issues such as medical and then transferred for final interview/approval etc.

    Hoping to hear opinions and other's experience....

  13. Not used to posting on the forum. My signature states my journey with the whole GC. In nutshell, I have pending AOS from 2007, employment based, that is retrogressed for my country. Got married to my USC husband and filed I130 last year, got approved Feb 2014. Lawyers (and some other cases I've seen online) shows USCIS will convert pending AOS from employment to marriage if requested, which was done in my case.

    My pending AOS is now changed to sent to local office (for interview). It changed today.

    I will most likely be interviewing at Long Island City/Queens location since that's where I living.

    My question....how long does it take to get interview scheduled? I already have had my fingerprinting done way back.

    I am excited but also know NYC is VERY slow. Was hoping to get GC before my EAD expires end July....Guess I will still submit EAD renewal, just in case....

    In your opinion, how long is the wait from here on.....anyone with experience...what should I expect.

    I'm sorry I haven't been around to update the spreadsheets as I started a new job and well my life just became super chaotic/busy and I am not around here much. The spreadsheet settings were changed so that others can make changes, so I hope you will feel free to do so.

    If there's anyone who wants to step up and take charge...that would be great.

    Super pressed for time daily right now. I haven't forgotten all of you here. Praying for everyone.

    Not sure. I hate this for you and feel frustrated for you.

    I am sure someone must have posted but is there a way to get a FOIA request on your file. Just to see what they have actually done if anything. At least you will be getting information on what they did (if anything giving you BS in meantime) in case you need to go through with the Writ of Mandamus (prob got that spelled wrong). I agree with Kaylara too that just pass along to the senator (hopefully to her liason as a result) that you are considering a Writ... Not saying you have to file one..but who knows a little fear on them may help.

    This is so ridiculous.
