Two ways for IR-1/CR-1 applicants: 3 years from being a resident (typically the same date as POE, but check the green card to be certain) and being married to the same person or after 5 years of being a resident (doesn't matter if you're still married or not).
If you apply under the 3 year rule, then you'll have to send a bunch of proof of relationship evidence, just like with ROC, and just like with the initial visa. If you apply as just being a resident for 5 years, no such evidence is needed

Just saw this on a thread and thought I'd share here too as it's relevant. You can now get the IRS tax transcripts online (no longer need to wait to receive it by mail)!! Look here: http://www.irs.gov/Individuals/Get-Transcript
This will make it even easier (and way faster) for people to get their tax transcripts to send to NVC

Yes, according to the March spreadsheet, there have been Nebraska transfers with both PD and transfer dates later than us who already have NoA2.

Despite what that email said, you are not being transferred to a local office but to one of the 3 service centers, as rinoa told you. Head over to the April thread and read about the transfers.

You should calm down. Your lack of doubts do not equate to truth. If you believe that the person at the head of any organization can be wholly responsible for the action of all the departments and people within said organization then it is quite reasonable that all should disregard anything you say. People look to this site for information and informed input. You offered neither.

The president didn't sign an executive order that said "Stop processing stand-alone I130's entirely and process the DACA applications." The USCIS decided that. They knew that DACA was coming and made no appropriate plans regarding it. There were a zillion different ways they could have responded to this, and they chose not to. This is because they are accountable to no one and do not have to disclose accurate information to the public.
Congress is bleeping useless. Even if the USCIS breaks the law, and they Congress people are made aware of it, they do nothing. There are no penalties when the USCIS doesn't do it's job. Unless Congress gets some serious pressure on them to fix the system, it's only going to get worse. This idea of comprehensive immigration reform is one that has merit, I think. But not within the framework of the present system. You can't just throw millions of more people at the USCIS and hope that it works.

Although I obviously disagree with the executive decision, I blame the republicans equally for constantly limiting government spending and therefore making it difficult to add the necessary personnel to handle the increased workload at USCIS.

OK, I just hung up with probably the rudest TIER2 so far.
I was calling about a case from 2008 The case number begins with EAC because it was at the Vermont Service Center back then.
I told her I received a status update about my case being revoked. But I explained I withdrew that case back in 2009. She rattled off this ####### about it being approved in 2009 and the NVC sent it back to the USCIS and asked them to reaffirm it. ( even after it was withdrawn and I received a notice confirming it in 2011. I never ever even inquired about that case again until today because I thought it was dead and burried) So I guess somewhere along the line, it was re-approved without my knowledge... HA HA and she said NOW they have to revoke that before they can approve my current petition. So I asked her if my case was assigned to someone.. she was soooo nasty and kept saying it is in process. They are working on Feb 12th. I said I know that, I can read that online. Can you tell me if they are working on my ase since they revoked the old case... and she repeated the same info about the feb 12th #######.. And I said nicely, I already know that information. then she said (extremely rude and sarcastic)... " Then what can I tell you that you don't already know?" and before I could get another word out " thanks for calling the USCIS ! ( rudely) CLICK hung up on me......
So this is what our fees pay for.

You have failed to grasp just how serious this backlog is. It is nearly a half million petitions. USCIS really let this get out of hand. Do you still think this qualifies as a "little backlogged"?

I don't have thousands of dollars sitting around to waste on the chance that they're not going to let him in because of the pending Visa petition. And my kids are not going to understand that YAY, Daddy's back after over a year of being away, but oh, wait, he can't stay.

I believe I and those who share my view did show compassion, in that not a single person here said anyone affected by the disaster deserves anything less than top priority. I want those people to have the help they need. More than that, as someone who is living the very real pain of separation from a spouse, I would never want to subject anyone else to it. I don't begrudge the individuals who will be reunited with their spouses quickly, because I don't wish this horrible feeling on anyone. But that doesn't change my wish for my own personal hell to end. Separate these things in your mind, because there's an important distinction. I don't want to benefit at someone's expense. None of us is wishing to be put ahead of others unfairly. We're simply sharing our mutual disappointment that we are continually shunted backwards in line.
USCIS responded efficiently to DACA, too. New policy after new policy takes precedent over us regular, run-of-the-mill filers. I'll reiterate that I understand the reasons for the way they're approaching this situation, but I'm still frustrated with USCIS and not the people who are benefiting. I'm sure that if anyone actually did file paperwork for an expedite after the typhoon, USCIS didn't bother glancing at it. The agency-wide directive completely erases the need to waste time on that, and I don't think the decision was the result of tons of people wrongfully filing for it -- which, by the way, is something I would never do. There are so many people who are still waiting in line ahead of me, I would never presume their hardships are less than mine. Just because I can't be elated that USCIS is granting free rides, doesn't mean I have no empathy. The world is not black and white. I can be happy that people who desperately need help are being given some, while being sad that people who don't need it are extending the difficult time my spouse and I have to spend apart. I don't feel bad for feeling this way, however much others may feel I need to be scolded for it. I'm not a bad person, and I don't wish bad things on people. It would simply be nice to, for once, not be on the receiving end of bad things myself.

Unfortunately, I have seen this over the years... When there is a big backlog, they start to process the most recent files mind-blowingly fast to manipulate the numbers so it shortens the posted wait times... I have a feeling that there are going to be a few more of these "anomalies " in the coming weeks (so the wait times drop on paper) before they start working on the backlog I earnest. Yes, it sucks and it NOT fair in the slightest and Should,not be done! But it is how the system disfunction's currently.
The silver lining is that after they clear some super "short termers" getting approved they start to make real progress on the older cases... These anomalies are usually a predecessor for real progress...
Now, Don't hate on the applicants, it's just one of those luck of the draw things and Should not diminish the support they receive from this VJ community.

greenivy, congratulations on your quick approval. Over my years here I have seen a few cases like this - and during my own visa journey there were a few instances. Upon investigation, it turns out that when USCIS is training new staff they will often just grab a petition/application from the most recent applications received that haven't yet made it to an adjudicator's desk. They aren't trying to circumvent the waiting time, just that those are the applications that are just coming up from the mail room and are readily available. It looks like they are training new adjudicators right now so there are going to be a number of petitions/applications processed quickly, and as we have a large membership here on Visa Journey, it is not surprising that some of these quick approvals will go to our members.
Is it fair? Nope. Is it frustrating? Absolutely. Is there anything you can do about it other than wish the beneficiary of this largess congratulations? Not likely. Many people - including me - have complained to USCIS about this over the years, and yet, it still happens.

Perhaps you truly don't understand, and that is why you can so flippantly say something like this, while you were approved and now have your fiance here already. After 7 months (give or take) of processing time. You haven't already combined your lives, you're just starting out on being together as spouses. I have actually lived and built a life with my husband already, for years. I'm 8 months into this process, and that's more than enough time to be separated from him. When I filed, the average time for the ENTIRE process was 8-9 months. The USCIS portion was not 8 months.
If their target processing time is 5 months, then their statement that I may have to wait a total of 13 months for just this first step is NOT normal. That they say it's normal, does not make it so. Nearly tripling their processing time is unacceptable. Especially given the fact that they are not processing K3's at the moment.
We don't accept this behavior with ANY other service that we pay for.
I know that if the situation were reversed, and they were taking 2 years to finish the fiance process, I'd be horrified. Not gloating to people who are hurting that I got mine quickly, and oh, don't you know that you aren't entitled to service or a processing time that doesn't stretch into years or accurate information. I'm not going over to the K1 forum and telling everyone who is adjusting their status that they deserve to be stuck in *that* limbo for whatever insane amount of time the USCIS feels like making up this month. Because it's insensitive, it's ridiculous, and it's flat out nasty to behave like that, and I don't wish that ####### on anyone either.
Seriously, if you're sick of reading about people complaining about the waiting time for their spouses, then why are you trolling threads that are obviously going to contain a lot of spouses complaining about their waiting times?

No offense, but the person I'm petitioning is my husband of 7 1/2 years. The father of my children. The person I've lived with for 8 years. The love of my life. My marriage would absolutely have to be in the toilet for me to stop thinking about it until it's been after 11 months.
I feel it every day that he's not here, as do my children. I feel it when I wake up and he's not there. I feel it when we eat breakfast, and he's not there. I feel it the entire day when I'm caring for our children, and I know he's not going to be coming back from work at night. I feel it when I go to sleep at night and he's not there. My children talk about him all the time. They tell me how much they miss him. They cry because he's not here, and I cry because I know that it's MY fault that they are missing their father, because I couldn't cope with living abroad any more. This was supposed to be almost over by now, and we haven't even gotten past the initial review yet.
I love my husband. If he was the kind of person I could forget about, I wouldn't have married him. I can't just put one of the most important people in my entire life out of my head.

Folks, I didn't start this thread to stir the pot, my intention was to provide some insight as to what appears to be the general concensus on the timelines...which we have all very clearly figured out. Being pissed off and frustrated is easy for sure, but when it's all said and done, it is what it is. We're all in the same line.....no prioritization is happening; can't be or none of us would ever get through it. I hate it like everyone else does. I hate that we are 60yo's and clearly will not likely get to plan to spend the next 30yrs together. But I'm in this for the long haul....he's worth me having to do whatever that is.

I demand accurate and timely adjudication of my case. This is something that I'm entitled to by virtue of having paid for a service that is not being rendered. If there is a reason why my case cannot be processed in a timely manner, then I am entitled to real and accurate information as to why. I have not received the service nor the information that I paid for.
The fact that you went through the process comparatively quickly seems to have dulled your ability to feel any compassion whatsoever for anyone who is currently being effected by the situation at the USCIS. Telling people over and over again to not be upset or complain about a ridiculous situation is not helpful. If you don't want to hear people complaining, then why are you continuing to read threads where it is clear that people are going to be upset and complaining? Why are you trying to convince people to take no action to attempt to improve their situation or to fix the clearly broken USCIS?
