  1. The prioritization of our cases is sooooo beyond me. I saw a timeline for someone from Japan on here and they submitted I130 in July and we submitted ours in April and they are done and we are still in NVC. It depends on many things including where you live, if you have children, et etc. If they just processed them in order without giving any sort of favor to any case I would be much more happy but I am not in charge :)

    I thought NVC worked in chronological order. l know USCIS is crazy, but I was expecting something different from NVC. But yeah, you might be right, they prioritize cases. I hope I see some movement tomorrow! :pop:

    Also I submitted DS261 on 3/14, still almost a week after you.

  2. Give it another week, I just got mine on Thursday or Friday and I submitted my 261 at the end of Feb....

    I was freaking out because I saw someone from China who said their IV is available to pay today when they submitted DS-261 on March 18. And another member from Macedonia got the yellow triangle today and they also submitted DS-261 on March 18. I don't get why they are skipping us. Sometimes is so hard to figure out how the NVC works :bonk:

  3. Pls dwheels on the I-1864ez form what do I fill in part 5 no 19 asking for total income,is it the adjusted gross income?

    I-864EZ Instructions:

    For purposes of this affidavit, the line for gross (total) income on IRS Forms 1040 and 1040A will be considered when determining income. For persons filing IRS Form 1040EZ, the line for adjusted Gross income will be considered.

    So, it depends on what IRS form you filed:

    Form 1040, 1040A = Total Income

    Form 1040EZ = Adjusted Gross Income

  4. Ok I think I just got confused ... lol

    For my tax returns I filed 1040 for three years including 2013. Can I not use I-864EZ or only 1040EZ can file I-864EZ?

    Also for the purpose of stating income for past three years, I a going to use AGI or gross income for I-864EZ? It seems like from what you are saying that only if I had filed 1040EZ, I need to state AGI on I-864EZ. Since in my case I filed 1040 I need to use gross income. Is that right?

    1. You are the person who filed or is filing the Form I-130, Petition for Alien Relative, for a relative being sponsored;
    2. The relative you are sponsoring is the only person listed on the Form I-130 petition;
    3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s).
    If you meet the above criteria, then yes, you can file the I-864EZ with your 1040 IRS Form. That's exactly what my husband did, he filed 1040 in 2013, 2012 and 2011 (your case). We used Total Income (this applies to you). The Adjusted Gross Income is just for people using 1040EZ (not your case).
  5. Alright folks, I'm probably going to be away for awhile. I'm moving to another city/state tomorrow, and it's time I pack my computer up XD I still have my laptop, but once I get off work tonight, I'm probably not going to stay up much longer as it'll be an early morning moving.   6. I am thinking about filing out I-864EZ instead of I-864 as I am only planning on using my income and not the joint sponsors or any household member's income. Just wondering if it's ok? Anyone here has done the same thing? And for I-864EZ it's the AGI and not the gross income.

    Yes, it is ok if you meet the three criteria. My husband filed the I-864EZ using Total Income since his IRS Form was 1040. You need to use the Adjusted Gross Income only when your IRS Form is the 1040EZ. That's what the instructions states smile.png

  8. Hi Everyone,

    Just got off the phone to NVC and got told case complete as off 11th March - Whoo Hoo!! Told the lady I spoke to that she had made our day!! Called the wife and gave her the good news - so happy!!! No Checklists at all!!!

    One thing the lady did tell me is that we have to wait for an interview to be scheduled which I understand, but she did add that the London Embassy is still scheduling April interview slots!! So hopefully we should get a late April or early May slot!!! Which is fantastic news!!

    Good Luck to everyone and I hope you get a speedy and easy passage through the NVC phase.

    Hi, did you have your case expedited?, I mean by your signature you got approved Feb. 26 and already have a case number and paid the AOS fee. That's nice!

Thanks for your reply, but the lady at NVC said that usually they ship 129F to the embassy from NVC, but it may take a week or two, so my understanding was that they have the 129F form on the system, which can go to the embassy any time now... But my I-130 has been received, but it may take up to 30 business days to get it to their system... And I am worried that my 129F can arrive to the embassy earlier than my 130 will receive a case number... If this happens, would it be possible for me not to pursue K3, but just wait for the 130 processing?

    Also, has your 129F case number started with "MSC" as well?

    Different reps. from NVC told me the same thing the first calls I made inquiring about our I-129F, but when they knew our I-130 was also there they just said that they will make a decision regarding the I-129F. This one never left the NVC.

    In case your I-129F gets to the embassy first, yes, you can choose not to pursue the K3. When you receive any instructions from the embassy related to the I-129F, you can just email or call them and let them know that you're processing the I-130 at NVC and that you don't want to apply for a K3 visa. They know how it works, so that shouldn't be a problem.

    Our USCIS case numbers start with MSC (Missouri) but our NVC case numbers for I-129F and I-130 start with BGT (Bogota).

You're such a famous woman in VJ lol and I just came here to let you know that many people care about your case and pray for you. I hope you can join us to the NVC thread very soon! or even better, that your I-129F gets to the CR embassy and your love can get the K3 visa.     Both my 129F and 130 forms have been received by NVC yesterday, on March 12, so please update the spreadsheet.

    I was told, however, that my 129F has been assigned a case number (though when I put it on the USCIS website, I am being told that this case number does not exist) and it should be forwarded to the embassy within a week or two. My 130 form has arrived as well, but it is not in the system yet and they have not assigned the case number. I thought that once both forms are approved at the same time (which happened in my case), the 129F is "killed" and you only have one route - IR1/CR1. Is this correct?

    I do not want to pursue K3 anymore because of some logistical issues and costs associated with AOS in the U.S. How can I pursue CR1 instead of K3? Please help, as I am a bit confused...

    Our I-130 and I-129F were approved at the same time as well and both got to the NVC. However, NVC didn't process our I-129F although we wanted to get that one and we made them known this, but they said we couldn't decide over that. We got a case number that never work on the ceac site.

    I-129F petitions that are approved separately from the I-130 are usually forwarded to the embassy. That's not your case, so don't worry about it, you will have to continue with the I-130 process as most people here.
